THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN
ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6-STREAMLINED PROCEDURES FOR
EVALUATION AND SOLICITATION FOR COMMERCIAL ITEMS-AS SUPPLEMENTED WITH
ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES
THE ONLY SOLICITATION; QUOTATIONS ARE BEING REQUESTED, AND A SEPARATE WRITTEN
SOLICITATION DOCUMENT WILL NOT BE ISSUED. THE RESULTANT AWARD SHALL BE A FIRM
FIXED PRICE AWARD.
This solicitation is a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-80, effective March 2, 2015.
This acquisition is 100% set-aside for small business.
The associated North American Industrial Classification System (NAICS) code for this procurement is 334516 with a small business size standard of 500 employees. In accordance with the non-manufacturer rule, the contractor shall be a small business under the applicable size standard and shall provide either its own product or that of another domestic small business manufacturing or processing concern. See FAR 19.102(f) for additional information.
STATEMENT OF WORK
Introduction
The contractor shall furnish the necessary personnel, material, equipment, and/or services for this requirement. NIST requires a contractor to provide an Amplified Laser that will be used to pump a parametric down conversion source to provide a high rate of photon pairs.
Background
The mission of the Quantum Optics Group of the Quantum Measurement Division is to develop and characterize measurement methods that take advantage of the quantum nature of light so as to achieve better performance, uncertainties, or to enable new applications that are not possible with classical methods. This acquisition is for a laser to pump a system to produce photon pairs at a particular wavelength and at a high rate for a system that will ultimately allow the generation of certifiably random numbers.

Specifications/Minimum Requirements The system shall meet or exceed the technical specifications identified below. All items must be new.
Prototypes, demonstration models, used or refurbished equipment will not be considered for award.
Output Wavelength 405 nm
Wavelength tunability ~5 nm
Spatial mode TEM00
Polarization Linear 100:1
Spectral bandwidth: less than 0.1 nm
Output Power: 600 mW or more out of a single mode fiber
Output Power stability better than 2% over 24 hr
Optical isolator on output with a minimum of 60 dB isolation minimum 1 year or 3000 hr warranty on the system
Additional preference will be given to those offerors that exceed the following minimum requirement:
Output power of 600mW
Express Warranty
A warranty period of at least 1 year (or 3000 hours), from the date of acceptance, shall be included.
Packaging and Marking
All information and deliverables shall be delivered to the address shown in Section 5 entitled - Place of Delivery - and shall be marked as follows:
1. Name and address of the Contractor;
2. Contract Number;
3. Description of item contained therein; and
4. Consignee's name and address.
NIST LOCAL_39 MARKING/PACKING INSTRUCTIONS
1. If the total contract/order includes multiple quantities of the same or like item(s), segregated as separate CLIN/Item numbers, deliverables shall be packed accordingly. Each individual package/container in the shipment shall include deliverables on a per-CLIN or Item basis.
2. For each shipment made under this contract/order, the Contractor shall furnish itemized packing list(s), enumerating the specific contents of each shipping container and what specific individual components constitute a full and complete "unit" for each bid item. The packing list shall include the brief description of each item found in the Schedule. If more than one container is required for each unit, each container should be marked accordingly, e.g., "Box 1 of 2," "Box 2 of 2," and the boxes, where feasible, should be taped or shrink-wrapped together as an issuable unit.
3. The contract number AND CONTRACT LINE ITEM NUMBER (CLIN) OR ORDER ITEM NUMBER shall be placed on the exterior of all containers.

Delivery Requirements
FOB Destination delivery terms are required, and shall take place within 24 weeks after receipt of Purchase Order.
Installation
The laser system shall be installed by the Contractor and meet contract specifications no later than 45 days after delivery. Installation, at a minimum, shall include uncrating/unpackaging of all equipment, rigging, set-up and hook-up of the system, demonstration of all specifications, and removal of trash.
Onsite installation and demonstration shall be done at NIST, Gaithersburg, MD. Upon delivery, the vendor shall contact the Technical Point of Contact (TPOC) to coordinate a time for installation.
Training
Training shall occur onsite at NIST, no more than 45 days after delivery, and shall occur on the same day as installation. Training shall be included for up to two (2) NIST users.
Inspection and Acceptance
Inspection and acceptance shall take place upon installation. In addition to the inspection and acceptance terms articulated in 52.212-4, the Government reserves the right to perform such performance tests and evaluations as defined below to verify specified system performance. Such tests and evaluations, if performed, shall be conducted within the environment that the system is to be operated. The Contractor has the right to be present during the tests and evaluations, if performed, at the Contractor’s expense. Inspection and acceptance will take place upon completion of the relocation.
Payment for this requirement will be made upon completion and acceptance.
Security Requirements Because of heightened security, contractors who need access to the NIST site shall call or e-mail their intention to visit to NAME OF COR/TIC, at NAME@nist.gov or 301-975-XXXX not later than forty-eight hours before the proposed visit, with the following information:
1) Company name
2) Names of all individuals visiting
3) Country of Citizenship of all individuals visiting
For non-US Citizens, the following additional information will be required:
1) Title
2) Employer/Sponsor
3) Address
Contractors must pick up a Visitor's Badge at the Visitor's Registration Center located at the Main Gate (Gate A, off Bureau Drive) Please ensure all individuals bring photo identification or they will be denied access to the facility.
Under the REAL ID Act of 2005, agencies, including NIST, can only accept a state-issued driver’s license or identification card for access to federal facilities if issued by states that are REAL ID compliant or have an extension. Currently, all but 9 states and territories are either compliant or have received an extension. The Jurisdictions that do NOT meet the REAL ID standards are:
AMERICAN SAMOA; ARIZONA; LOUISIANA; MAINE; MONTANA
Effective July 21, 2014, drivers’ licenses from these states and territories will NOT be accepted for entry to NIST.

Visitors from these locations must present a REAL ID compliant form of identification.
In addition, only Enhanced Driver’s Licenses (EDL) issued by the states of Minnesota, New York, and Washington will be accepted for access to the NIST campus. These drivers’ licenses are easily identifiable by the American Flag on the face of the license.
NIST currently accepts other forms of federally issued identification in lieu of a state-issued driver’s license, such as a valid: Passport ; Passport Card ; DOD’s Common Access Card (CAC); Veterans ID;
Federal Agency HSPD-12 IDs; Military Dependents ID; Transportation Workers Identification Credential
(TWIC)

During the life of this contract, Contractor performance will be evaluated on an interim (if applicable) and final basis pursuant to FAR Subpart 42.15. 52.232-39 UNENFORCEABILITY OF UNAUTHORIZED OBLIGATIONS (JUN 2013)
(a) Except as stated in paragraph (b) of this clause, when any supply or service acquired under this contract is subject to any End User License Agreement (EULA), Terms of Service (TOS), or similar legal instrument or agreement, that includes any clause requiring the Government to indemnify the Contractor or any person or entity for damages, costs, fees, or any other loss or liability that would create an Anti- Deficiency Act violation (31 U.S.C. 1341), the following shall govern:
(1) Any such clause is unenforceable against the Government.
(2) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement. If the EULA, TOS, or similar legal instrument or agreement is invoked through an “I agree” click box or other comparable mechanism (e.g., “click-wrap” or “browse-wrap” agreements), execution does not bind the Government or any Government authorized end user to such clause.
(3) Any such clause is deemed to be stricken from the EULA, TOS, or similar legal instrument or agreement.
(b) Paragraph (a) of this clause does not apply to indemnification by the Government that is expressly authorized by statute and specifically authorized under applicable agency regulations and procedures.
52.232-40 PROVIDING ACCELERATED PAYMENT TO SMALL BUSINESS SUBCONTRACTORS
(DEVIATION)(AUG 2013)
This clause implements the temporary policy provided by OMB Policy Memorandum M-12-16, Providing Prompt Payment to Small business Subcontractors, dated July 11, 2012, and the extension to that policy provided by OMB Policy Memorandum M-13-15, Extension of Policy to Provide Accelerated Payment to Small Business Subcontractors, dated July 11, 2013.
(a) Upon receipt of accelerated payments from the Government, the contractor is required to make accelerated payments to small business subcontractor to the maximum extent practicable after receipt of a proper invoice and all proper documentation from the small business subcontractor.
(b) Include the substance of this clause, including this paragraph (b), in all subcontracts with small business concerns.
(c) The acceleration of payments under this clause does not provide any new rights under the Prompt Payment Act.
52.247-35 F.o.b. Destination (Nov 1991)
(a) The term “f.o.b. destination,” as used in this clause, means—
(1) Free of expense to the Government, on board the carrier’s conveyance, at a specified delivery point where the consignee’s facility (plant, warehouse, store, lot, or other location to which shipment can be made) is located; and
(2) Supplies shall be delivered to the destination consignee’s wharf (if destination is a port city and supplies are for export), warehouse unloading platform, or receiving dock, at the expense of the Contractor. The Government shall not be liable for any delivery, storage, demurrage, accessorial, or other charges involved before the actual delivery (or “constructive placement” as defined in carrier tariffs) of the supplies to the destination, unless such charges are caused by an act or order of the Government acting in its contractual capacity. If rail carrier is used, supplies shall be delivered to the specified unloading platform of the consignee. If motor carrier (including “piggyback”) is used, supplies shall be delivered to truck tailgate at the unloading platform of the consignee, except when the supplies delivered meet the requirements of Item 568 of the National Motor Freight Classification for “heavy or bulky freight.” When supplies meeting the requirements of the referenced Item 568 are delivered, unloading (including movement to the tailgate) shall be performed by the consignee, with assistance from the truck driver, if requested. If the contractor uses rail carrier or freight forwarded for less than carload shipments, the contractor shall ensure that the carrier will furnish tailgate delivery, when required, if transfer to truck is required to complete delivery to consignee.

(b) The Contractor shall— (1)(i) Pack and mark the shipment to comply with contract specifications; or
(ii) In the absence of specifications, prepare the shipment in conformance with carrier requirements;
(2) Prepare and distribute commercial bills of lading;
(3) Deliver the shipment in good order and condition to the point of delivery specified in the contract;
(4) Be responsible for any loss of and/or damage to the goods occurring before receipt of the shipment by the consignee at the delivery point specified in the contract;
(5) Furnish a delivery schedule and designate the mode of delivering carrier; and
(6) Pay and bear all charges to the specified point of delivery.
52.203-99, Prohibition on Contracting with Entities that Require Certain Internal Confidentiality Agreements (DEVIATION 2015-02) (FEB 2015)
a) The Contractor shall not require employees or subcontractors seeking to report fraud, waste, or abuse to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.
b) The contractor shall notify employees that the prohibitions and restrictions of any internal confidentiality agreements covered by this clause are no longer in effect.
c) The prohibition in paragraph (a) of this clause does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information.
d) (1) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015 (Pub. L. 113-235), use of funds appropriated (or otherwise made available) under that or any other Act may be prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause.
(2) The Government may seek any available remedies in the event the Contractor fails to comply with the provisions of this clause. (End of clause)
