PERFORMANCE WORK STATEMENT
NASA Data Panel Support
I. BACKGROUND
The National Institute of Standards and Technology (NIST) has entered into a three-year agreement with the National Aeronautics and Space Administration (NASA) to participate in the NASA Panel for Data Evaluation and to provide evaluated data for inclusion in the report of the panel, “Chemical Kinetics and Photochemical Data for Use in Atmospheric Studies”. The entire scientific community involved in atmospheric studies over the world has come to rely on the kinetic and photochemical data recommended by the NASA Panel for atmospheric modeling. In particular, the major international scientific assessments by the World Meteorological Organization on climate change and ozone depletion accept these NASA recommendations as the kinetic and photochemical basis for the atmospheric studies. In recent years, the focus of the panel has expanded somewhat to include the upper troposphere, necessitating an expansion in the types of data included in the Report. Much of the work in the agreement between NIST and NASA is associated with this expansion. The present version of the Panel report can be obtained at http://jpldataeval.jpl.nasa.gov/.
As part of its contract with NASA, NIST has agreed to carry out a number of data evaluation activities and laboratory kinetics studies. The data evaluation activities include an expansion of the table of thermodynamic properties for the NASA Report to include more detailed comments; an analysis of radical production from ozone reactions with alkenes; and an evaluation of aqueous phase reactions of halogenated oxidants of possible importance to the chemistry of the upper troposphere.
The present contract is to support the NIST effort in several specific areas of data evaluation. The evaluated data will be provided to NIST and to the NASA Panel for Data Evaluation in formats appropriate for inclusion in the NASA Report updates, as determined by the chairman of the NASA data panel. This activity is partly funded by that agency. Fulfillment of the requirements of this project requires that the Contractor be or become a member of the NASA Panel for Data Evaluation. Membership in the Panel requires an invitation from the Chairman of the Panel, with the concurrence of the Panel membership.
II. SCOPE OF WORK
The Contractor shall improve the reliability of atmospheric models by improving the quality of the data incorporated into them, so that atmospheric models can better be utilized by policy makers in making decisions relating to anthropogenic effects on the environment.
SPECIFIC TASKS
The Contractor shall provide all labor, supervision, materials, equipment, and facilities (unless otherwise stated herein) to complete the following tasks:
Tasks for Base Period:
Maintain an active membership on the NASA Panel for Data Evaluation and attend all meetings of that Panel through February 28, 2010. Panel meetings will be scheduled by the Chairman of the Panel at locations to be determined.
(1) Update Table of Thermodynamic Properties by checking for new literature values, providing detailed comments where changes are made for the following:
i. Part 1. The halogen oxides.
ii. Part 2. Metal compounds of possible importance in the stratosphere for inclusion in the Table.
iii. Part 3. Water complexes of possible importance to the upper troposphere for inclusion in the Table.
(2) Prepare a report in both electronic and written format containing a finalized update of the Table of Thermodynamic Properties of gas-phase species needed by the NASA Data Panel. Incorporate recommended Panel changes, for example enthalpy values at 0 K. Detailed comments will be provided by the Contracting Officer’s Technical Representative (COTR) where changes are made.
Tasks for Option Year 1:
Maintain an active membership on the NASA Panel for Data Evaluation and attend all meetings of that Panel through February 28, 2011. Panel meetings will be scheduled by the Chairman of the Panel at locations to be determined.
(3) Prepare a report in both electronic and written format containing a review of the heterogeneous chemistry of bromine and iodine compounds, with the goal of a better understanding of the differences in transport of the active species into the stratosphere. Make recommendations for new data products.
(4) Prepare a report in both electronic and written format containing tables of the solubility of organic compounds in sulfuric acid at low temperatures.
(5) Prepare a report in both electronic and written format containing detailed models describing the reactions of ozone with alkenes of atmospheric interest as specified by the NASA Data Panel. The report shall provide recommendations for radical yields for small alkenes.
(6) Prepare a report in both electronic and written format containing an updated and revised (as appropriate) Table of Henry’s Law Constants for atmospheric species of interest as specified by the NASA Data Panel.
Tasks for Option Year 2:
Maintain an active membership on the NASA Panel for Data Evaluation and attend all meetings of that Panel through February 29, 2012. Panel meetings will be scheduled by the Chairman of the Panel at locations to be determined.
(7) Prepare a report in both electronic and written format containing equilibrium constants for halogen-containing inorganic species in aqueous solution.
(8) Prepare a report in both electronic and written format containing values of rate constants for the reactions of halogen-containing inorganic species in aqueous solutions of importance to halogen activation in the atmosphere.
(9) Prepare a report in both electronic and written format containing values of the thermodynamic properties of water complexes of possible importance to the upper troposphere for inclusion in the Table of Thermodynamic Properties of gas-phase species needed by the NASA Data Panel. Detailed comments shall be provided.
(10) Prepare a report in both electronic and written format containing tables of the solubility of inorganic compounds in sulfuric acid at low temperatures.
The aim of this project is to provide NIST and the NASA Panel with both completed products for inclusion in the NASA Report, and detailed plans for the expansion of the data tables. All data products generated under this contract are subject to the Quality Assurance Plan detailed below.
The fulfillment of the requirements for this effort will require the Contractor to attend various meetings of the NASA Data Panel. The Chairman for the NASA Data Panel will determine the dates and locations of the meetings of the Data Panel.
III. DELIVERABLES AND DELIVERABLE DUE DATES
The Contractor shall determine the exact format of the presentation of the data on radical production from ozone – alkene reactions. The information included shall include both recommended extents of radical production, if possible as a function of temperature and pressure. Also to be included shall be notes with more detailed explanation of the reasoning behind the recommendation.
Deliverables for Base Period:
(1) A report in both electronic and written format containing an update of the halogen oxides for the Table of Thermodynamic Properties of gas-phase species needed by the NASA Data Panel. Due no later than 10/31/2009.
(2) A report in both electronic and written format containing values of thermodynamic properties of metal compounds of possible importance in the stratosphere for inclusion in the Table of Thermodynamic Properties of gas-phase species needed by the NASA Data Panel. Due no later than 12/31/2009.
(3) A report in both electronic and written format containing values of the thermodynamic properties of water complexes of possible importance to the upper troposphere for inclusion in the Table of Thermodynamic Properties of gas-phase species needed by the NASA Data Panel. Due no later than 01/31/2010.
(4) A report in both electronic and written format containing a finalized update of the Table of Thermodynamic Properties of gas-phase species needed by the NASA Data Panel. Shall incorporate recommended Panel changes, for example enthalpy values at 0 K. Due no later than 02/28/2010.

Standards for Acceptance of Deliverables: The COTR will provide comments on each deliverable within 15 calendar days from receipt of a given deliverable. The Contractor shall make any needed changes to the deliverables within 30 calendar days from receipt of electronic or written comments from the COTR.
IV. PERIOD OF PERFORMANCE AND PLACE OF PERFORMANCE
For Base Period:
The period of performance for the base period shall be 09/08/2009 through 02/28/2010.
For Option Year 1:
The period of performance for the first option shall be 03/01/2010 through 02/28/2011.
For Option Year 2:
The period of performance for the second option shall be 03/01/2011 through 02/29/2012.
All work shall be accomplished at the Contractor’s facility or the NIST Gaithersburg, MD campus, unless traveling to attend NASA Panel meetings.
V. GOVERNMENT-FURNISHED PROPERTY, DATA AND/OR INFORMATION
All materials provided by the Government during the performance of this project remain the property of the Government and shall be surrendered to the Government upon completion or termination of this requirement.
NIST will provide access to library facilities, including on-line databases and journals. This will require the provision of a computer with a NIST IP address.
VI. TRAVEL
Travel to attend the Panel meetings will be at Contractor’s own expense. No funds are available for travel.
VII. RISK ASSESSMENT
The HSPD-12 Security Risk Level assigned to this contract is LOW risk.

The output shall be reviewed, both in preliminary and in final form, by both the COTR and by the NASA Panel for Data Evaluation.
X. CONTRACTOR’S MINIMUM QUALIFICATIONS
The Contractor shall have at least a Ph.D. degree or higher in physical chemistry. The Contractor shall have at least 15 years of experience in physical chemistry, atmospheric chemistry and data evaluation. Contractor shall have authored or co-authored relevant publications that appear in peer-reviewed journals.
XI. QUALITY ASSURANCE SURVEILLANCE PLAN
All work carried out under the agreement between NIST and NASA is subject to extensive review by the NASA Panel on Data Evaluation. This Panel consists of pre-eminent experts in the chemistry and photochemistry of the upper atmosphere and lower troposphere. Data to be considered for inclusion in the Panel Report are presented to the Panel by several methods: First, tables or other data formats are uploaded to the NOAA server, to a password-protected section reserved for use by the Panel members. Second, these data can be distributed by e-mail to Panel members. This method is primarily useful within a working group of the Panel, for example, the working group on heterogeneous chemistry. Third, and most important, all data proposed for inclusion are presented at a meeting of the entire Panel. The data are discussed extensively and the results are included only after a consensus of the Data Panel is reached. All work under this contract will first be reviewed by the COTR for consistency with the requirements of the contract and the policies of NIST, and is then subject to the exhaustive technical review of the Data Panel.
A. Objective: The purpose of this plan is to provide a quality assurance surveillance plan for this project. This plan provides a basis for the COTR to evaluate the quality of the Contractor's performance. The oversight provided for in the contract and in this plan shall help to ensure that the topics and assessment are maintained at the required levels throughout the Period of Performance of the contract. Further, this plan provides the COTR with a proactive way to avoid unacceptable or deficient performance.
B. Performance Standards:
1. Quality Level: By monitoring the Contractor, the COTR will determine whether the Performance Standards set forth in the contract have been attained. Performance Standards for all tasks are specified in the Performance Requirements Summary of the Performance Work Statement.
2. Frequency: During the performance of this contract, the COTR will periodically review random draft reports (conduct surveillance) to determine content is appropriate for the work being performed and progress is being made.
3. Management Responsiveness: The COTR will determine whether the Contractor has managed the contract effectively and efficiently with successful completion of the topics and assessment as specified in the Performance Standards set forth in the Performance Requirements Summary.
Evaluation Methods: The COTR will perform performance evaluations based on Section II above and the required Performance Standards set forth in the contract. The following techniques may be used to perform surveillance:
All Tables shall be provided in a format that is easy to utilize by atmospheric modelers and is recognized as authoritative by the user community. The notes shall be concise but complete. The Tables shall be submitted to the COTR in sufficient time to allow for requested editorial changes (by COTR and/or Panel) prior to expiration of the period of performance.
Deliverables shall meet the requirements of the Quality Assurance Plan. The Contractor shall provide monthly reports to the COTR on progress under this contract.

The Contracting Officer is the only person authorized to make or approve any changes in any of the requirements of this contract and notwithstanding any provisions contained elsewhere in this contract, the said authority remains solely in the Contracting Officer. In the event the Contractor makes any changes at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the contract terms and conditions, including price.

(a) The Contractor warrants that, to the best of the Contractor's knowledge and belief, there are no relevant facts or circumstances which would give rise to an organizational conflict of interest, as defined in FAR Subpart 9.5, or that the Contractor has disclosed all such relevant information.
(b) The Contractor agrees that if an actual or potential organizational conflict of interest is discovered after award, the Contractor will make a full disclosure in writing to the Contracting Officer. This disclosure shall include a description of actions which the Contractor has taken or proposes to take, after consultation with the Contracting Officer, to avoid, mitigate, or neutralize the actual or potential conflict.
(c) Remedies - The Contracting Officer may terminate this contract for convenience, in whole or in part, if it deems such termination necessary to avoid an organizational conflict of interest. If the Contractor was aware of a potential organizational conflict of interest prior to award or discovered an actual or potential conflict after award and did not disclose or misrepresented relevant information to the Contracting Officer, the Government may terminate the contract for default, debar the Contractor for Government contracting, or pursue such other remedies as may be permitted by law or this contract.
(d) The Contractor further agrees to insert provisions which shall conform substantially to the language of this clause, including this paragraph (d), in any subcontract or consultant agreement hereunder.

(a) "North American Industry Classification System (NAICS) code and small business size standard." The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) "Submission of offers." Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) "Period for acceptance of offers." The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) "Product samples." When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) "Multiple offers." Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) "Late submissions, modifications, revisions, and withdrawals of offers."
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)
(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) "Contract award (not applicable to Invitation for Bids)." The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h)" Multiple awards." The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(4) A summary of the rationale for award;
(5) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.
(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

Factor 1 - Technical Approach and Capability - the offeror shall provide sufficient information to demonstrate the degree of its understanding of the requirements by describing its technical approach to accomplishing the tasks and its capability to collect from the scientific literature, critically evaluate, and present data for discussion of physical-chemical properties of the compounds of atmospheric interest in both gas and condensed phases, including: a) reaction rate constants and equilibrium constants of halogen-containing inorganic species in aqueous solutions; b) reactions of ozone with alkenes; c) thermodynamic properties of gas-phase halogen oxides, metal compounds, and water complexes; d) Henry’s Law Constants and the solubility of organic compounds in sulfuric acid at low temperatures; and, e) the heterogeneous chemistry of bromine and iodine compounds;
Factor 2 - Qualifications/Experience - the offeror shall demonstrate that its key personnel have the qualifications described in Section X (10) of the Performance Work Statement (PWS). The offeror shall have internationally recognized credentials, as evidenced by peer-reviewed publications in the various covered herein; the offeror shall also provide a detailed resume for its proposed key personnel;

Interested Contractors are invited to review the PWS NASA DATA PANEL SUPPORT and provide an electronic response to be received no later than 4:00PM Local Time 08/31/2009 addressed to randy.schroyer@nist.gov. It is the responsibility of the Offeror to confirm NIST's receipt of quotation. Offerors shall submit a complete response. Responses that are not substantially complete will not be considered for award. Offers of partial performance will be rejected. Quotations shall be submitted in MS Word or Adobe Acrobat and shall be in the form of an e-mail with attachments. A one (1) page letter shall transmit the quotation signed by an individual authorized to commit the organization. Each response shall be on 8-1/2" x 11" paper, in a commercially standard font, not smaller than a size 12 font. Each page in the response shall be separately numbered. A page of paper printed on both sides is considered two (2) pages. The quotation shall be limited to fifteen (15) single-sided pages, single-spaced, (excluding letter of transmittal, resumes, representations, certifications, and letters of commitment). Pages that exceed this limitation will be removed from the offeror's quotation and will not be evaluated which may adversely impact the offeror's rating. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose quotation, conforming to the solicitation, represents the best value to the Government, non-price factors and price considered.
(b) The Government intends to evaluate quotations and award a contract without discussions with offerors. Therefore, the offeror's initial quotation should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any and or all quotations if such action is in the public interest; accept other than the lowest price quotation; and waive informalities and minor irregularities in quotations received.
(c) Quotations will be evaluated based on the factors listed below in descending order of importance. Technical Factors 1 and 2 are of equal importance and are slightly more important than Past Performance. Technical and Past Performance are significantly more important than price. The importance of price in the evaluation will increase with the degree of equality among quotations of the non-price factors. In addressing the evaluation factors below, the offeror shall demonstrate:

Factor 1. Technical Approach and Capability - the Government will evaluate the overall technical merit and the feasibility and reasonableness of the technical approach and the extent of its understanding of the solicitation's requirements
Factor 2. Qualifications and Experience - the Government will evaluate the offeror's experience and the resume(s) of its proposed key personnel to ensure key personnel have the qualifications described in Section X (10) of the PWS and to determine the nature and extent of the offeror's successful completion of similar services
Past Performance - the Government will evaluate the offeror's past performance information to determine its relevance to the current requirements and the extent to which it demonstrates that the offeror has successfully completed relevant contracts
Price - the Government will evaluate the offeror's proposed hourly rate(s) and labor categories, as added together and multiplied by the offerors proposed level of effort to derive a total price to determine whether it is realistic and fair and reasonable
(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are discussions after its receipt, unless a written notice of withdrawal is received before award.
