About this file

This is a NASA Shared Services Center Recommendation and Determination to Solicit from One Source or Brand Name document dated March 15, 2017.

NASA Shared Services Center recommends sole source negotiation with ThermoFisher Scientific for a service contract extension covering a Plasma Focused Ion Beam (PFIB) instrument. The contract period of performance extends from September 14, 2026 through September 13, 2027. The document identifies the PFIB as an existing FEI Helios PFIB electron microscope originally purchased from FEI Company through a competitive bidding process. The recommended contractor will provide routine maintenance and repair services for the microscope, with the service agreement becoming necessary upon expiration of the current comprehensive warranty on September 13, 2026.

The justification for sole source procurement centers on technical and warranty compatibility factors. FEI Company, as the original equipment manufacturer, employs the only certified technicians capable of servicing the microscope while maintaining necessary component warranties. The document states that no other known vendor can provide equivalent service or replace system components without voiding selected warranties on damaged components. Competition is deemed impractical due to the specialized nature of the equipment and the manufacturer's exclusive ability to maintain warranty coverage during repairs.

RECOMMENDATION AND DETERMINATION TO SOLICIT FROM ONE SOURCE

OR BRAND NAME

PICK ONE

Sole Source:

☒I recommend that NASA, NASA Shared Services Center negotiate with ThermoFisher Scinetific only for Service contract extension for Plasma Focused Ion Beam instrument. The total estimated cost of this effort is and the estimated period of performance or lead-time for delivery is September 14, 2026 through September 13, 2027.

OR

Brand Name Justification:

☐I recommend that NASA, NASA Shared Services Center negotiate with only with vendors who can provide the subject brand name from Manufacture Name for Enter Supply or Service to be procured. The total estimated cost of this effort is Enter Dollar amount and the estimated period of performance or lead-time for delivery is Date.

This recommendation is for the acquisition of supplies or services determined to be reasonably available from only one source/only one manufacture. Competition is impractical for the following reasons (please answer the questions below):

1. What are the reasons for soliciting only the suggested source/suggested brand name? Please provide the unique characteristics of the items or services along with the supporting rationale and the market research performed to substantiate your reason for the suggested source/brand name.

We need to have a service agreement for a PFIB. This PFIB an existing FEI Helios PFIB electron microscope. This microscope was purchased under order number from FEI Company under a competitive bidding process. No other known vendor provides the services of this contract.

2. What is the impact to the government if another vendor/brand is used? Include any dollar, schedule, or compatibility impacts if possible.

This contract will support routine maintenance and any required repair of the above specified PFIB.

The current comprehensive warranty will expire on September 13, 2026 and a service contract needs to be in place by that time, otherwise we may be responsible for any damage or maintenance that is required at that time.

FEI Company is the manufacturer of our PFIB and have the only certified technicians to supply service to this microscope while maintaining the necessary warranty of all appropriate components.

As the manufacturer of the existing microscope, FEI Company provides the required service agreement as a standard service. I am not aware of any other company that can provide such a service while also being able to replace any component on this system without voiding selected warranties on any damaged components.
