About this file

This is a Sole Source Justification form from NASA Shared Services Center (NSSC) recommending the procurement of Code V software license maintenance and 12 months of support from Synopsys. The justification explains that GSFC requires this specific software for developing complex optical models for various instruments, including observatory and science instruments for projects like JWST and WFIRST.

The document details that Synopsys is the only viable vendor as Code V is proprietary software developed at private expense and licensed on a lease basis. A market survey examining alternatives like ZEMAX and OSLO found no compatible alternatives. The justification emphasizes that thousands of existing optical models have been developed using Code V, and GSFC must maintain compatibility to modify existing models and exchange new science instrument models with other agencies. The document warns that using another vendor would cause delays to time-critical projects, extend schedules beyond current fiscal year funding dates, and create risks to mission operations. The estimated period of performance is 12 months, with the document dated March 15, 2017.

NATIONAL AERONAUTICS AND SPACE ADMINISTRATION

NASA SHARED SERVICES CENTER

RECOMMENDATION AND DETERMINATION TO SOLICIT FROM ONE SOURCE

OR BRAND NAME

PICK ONE

Sole Source:

☒I recommend that NASA, NASA Shared Services Center negotiate with Code V only for renewal of Code V. The total estimated cost of this effort is and the estimated period of performance or lead-time for delivery is 12 months.

OR

Brand Name Justification:

☐I recommend that NASA, NASA Shared Services Center negotiate with only with vendors who can provide the subject band name from Manufacture Name for Enter Supply or Service to be procured. The total estimated cost of this effort is Enter Dollar amount and the estimated period of performance or lead-time for delivery is Date.

This recommendation is for the acquisition of supplies or services determined to be reasonably available from only one source/only one manufacture. Competition is impractical for the following reasons (please answer the questions below):

1. What are the reasons for soliciting only the suggested source/suggested brand name? Please provide the unique characteristics of the items or services along with the supporting rationale and the market research performed to substantiate your reason for the suggested source/brand name.

This sole source justification is for the purchase of software license maintenance to include 12 months of support. .This software is proprietary and the vendor does not employ any distributors for its product line. The source quoted is the only source available to fulfill this procurement request.

This recommendation is made pursuant to FAR 13.106-1(b)(1), for the acquisition of supplies or services determined to be reasonably available from only one source. Competition is impractical for the following reasons:

1. Only one source is capable of providing the supplies or services required at the level of quality required because of exclusive licensing agreements.

Enter further details justifying the sole source of this procurement

GSFC is tasked with developing unique and complex optical models for many instruments, including the observatory and science instruments, and numerous other projects. To meet mission goals, GSFC must obtain software that is designed to develop and implement these models.

Numerous other agencies and support contractors are performing optical modeling using the CodeV software. Presently, thousands of optical models have already been developed using the CodeV software, GSFC must be able to utilize and modify the existing models, and freely exchange all the new science instrument models that are developed with other agencies. For these reasons, the software to be acquired by NASA must be compatible with the existing CodeV software optical models.

An informal market survey was performed by examining the user manuals and online support documents of other optical modeling programs, including ZEMAX (Focus Software Inc.) and

Page 2 V2.0 3-15-2017

OSLO (Lambda Research Corp.). Based on this survey, none of these programs were found to be compatible with the CodeV models.

The software to be procured by GSFC must be compatible with CodeV so that GSFC may use and modify existing optical models and exchange new optical models developed in the future with other agencies and support contractors. CodeV software is a commercial product for which Synopsys is the only vendor. The development of a technical data package, specifications, and/or development of a technical data package is not feasible, because the Government is restricted from gaining access to Synopsis’s source code information and from reverse engineering or duplicating this software. Even if these barriers and restrictions could be overcome, the amount of time and resources necessary to develop “CodeV” compatible software would result in unacceptable mission delays, increased technical risk to the JWST and other programs, and a substantial increase in cost.

Synopsys is the only supplier of software that is compatible with the unique and complex requirements of the breadth of projects supported by the GSFC Optics Branch. The required CodeV software has been used to develop existing JWST, WFIRST and numerous other models, and continues to be used by other agencies and support contractors involved with JWST telescope and instrument models and hardware. In order to provide software that is proven to be compatible with the CodeV software, other vendors would need to have the CodeV source code data. The CodeV optical design software was developed at private expense by Synopsys and it is licensed on a lease basis. Existing leasing and licensing agreements make the copyrighted CodeV software the proprietary and confidential property of Synopsys, which restricts any duplication or disclosure of the software by leasers or licensees.

2. What is the impact to the government if another vendor/brand is used? Include any dollar, schedule, or compatibility impacts if possible.

Delays of time-critical projects will extend their schedules beyond their current fiscal year funding dates, and hence reduce designers’ abilities to produce the expected product, or cancel the projects. Delays in customer support of post launch missions will be an impact to mission operations creating risk to the mission success.
