About this file

This document is a justification for other than full and open competition under FAR 13.106-1(b). The United States Coast Guard Civil Engineering Unit Juneau requires a mooring analysis and structural assessment of the USCG Base Kodiak Fuel Pier in Kodiak, Alaska to evaluate its ability to temporarily moor the USCGC Alex Haley for up to two years. The analysis will be conducted by Kodiak Tribal Resources, which previously completed a similar analysis of the pier under a prior contract. Awarding this follow-on work to KTR on a sole-source basis will allow the analysis to be completed more efficiently by leveraging KTR's existing work product and historical knowledge. Future requirements are planned for full and open competition.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)

SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE. Do not use marketing language in this document. Language such as “This company has made its mark,” “This company is recognized as industry’s best,” and “This company is the leader in…” is unacceptable.

IDENTIFICATION OF THE AGENCY AND THE CONTRACTING OFFICE, AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A “JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION.” PLEASE CITE THE AUTHORITY AND TYPE OF

JUSTIFICATION.

United States Coast Guard, Civil Engineering Unit Juneau. This is a justification for other than full and open competition as authorized by FAR 13.106(b)(1)(i).

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE.

Perform a mooring analysis and structural assessment of the USCG Base Kodiak Fuel Pier to assess the Fuel Pier’s ability to serve as a 2-year temporary mooring site for USCGC ALEX HALEY.

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES

OR SERVICES CAN BE USED.

FAR 6.302-1(a)(2)(iii)(A) permits contracting without providing for full and open competition when it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. In this case, the costs to develop a digital model of the Fuel Pier and to perform met-ocean analysis for Women’s Bay would be duplicated. Those costs are not expected to be recovered through competition.

A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY

POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE).

The original mooring analysis was part of a competitive procurement under an A/E IDIQ contract (which has since expired). The KTR acted as subconsultant to the prime IDIQ awardee. Since the IDIQ contract has expired, this logical follow-on work is being procured under FAR 13.106-1(b) instead of FAR 16.505(b). The KTR is no longer a subconsultant the current AE IDIQ, therefore, a direct sole source contract ensures efficiency; time is not lost completing repetitive work that can be found in the calculations, reports, documents, and other historical information the KTR holds.

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.

In May 2020, The United State Coast Guard (USCG) Civil Engineering Unit (CEU) Juneau requested a mooring and berthing analysis for the Fuel Pier at USCG Base Kodiak, AK. PND Engineers Inc. (PND) was tasked by the USCG to perform the analysis on two vessels under a range of environmental conditions. The two vessels were the MT Empire (49k TDW Oil Tanker) and the WMSL Legend-class Cutter. KTR considered under this solicitation completed the original analysis and has accessibility to the original calculations, reports, etc. which should expedite the completion of new analysis.

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND

OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.

Ordinarily this type of requirement would be solicited via open competition, but with the historical information available to the suggested KTR and the Mission need to find adequate mooring position for the USCGC Alex Haley. Due to compelling needs of mooring space for the Haley it is imperative to complete the mooring analysis as quickly as possible.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY

BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED.

Future requirements are planned to be competed. This is a particular case due to KTR historical knowledge and possession of information.
