FEDERAL BUREAU OF INVESTIGATION
FINANCE DIVISION | PROCUREMENT SECTION
JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND OPEN COMPETITION
IN ACCORDANCE WITH FEDERAL ACQUISITION REGULATION 13.106-1(B)(1), I HEREBY DETERMINE THAT THE BOGEN COMMUNICATIONS LLC EQUIPMENT LISTED ON DJF-22-0200-PR-0004557 IS AVAILABLE FROM ONLY ONE SOURCE, AND COMPETITION IS PRECLUDED AS THERE ARE NO SUBSTITUTES AVAILABLE.
1. Identification of the agency and contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation (FBI) has prepared this justification for other than full and open competition for Senior Leader Course Strive Performance Coaching Pilot Program, which is a web-based platform that will provide feedback and offer virtual coaching, on behalf of the Leadership Development Unit, Training Division.
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
It is the intent of the LDU, Training Division, to acquire a sole source firm fixed price contract with Arena Labs Strive Web-based virtual coaching platform. The period of performance will be a 6-month pilot program to determine the efficacy of the platform for the Senior Leader Course.
3. A description of the supplies or services required to meet the agency’s needs.
The requirement is to provide LDU with a virtual platform that in addition to content, coaching, and skill building, will also integrate wearable technology to provide feedback on physiological markers that will correspond back to leadership and performance, that will supplement the Senior Leader Course for a period of performance of 6 months.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
Arena Labs is uniquely qualified to meet LDU requirements for this pilot program based upon the following:
They have created a product that is unique in that it contains elements of human performance and physiological metrics combined with an asynchronous course that is combined with personal coaching along with digital content tied to well-being and leadership. Strive integrates your physiological markers and your perception of the stress and environment that you are in and provides feedback and suggestions of content that will address your needs in real time. They have also created the ability to request and receive one on one coaching from their world-renowned staff. Strive currently is integrated with the WHOOP band with plans to increase the suite of wearables that can be utilized, which will provide the physiological markers that will be used to direct the participant to relevant content. The application also will provide historical data and trend analysis and provide tools and skills that will help the participant cope with high stress environment and increase performance and will help reduce the impact of stress.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
The FBI will publicize this requirement on the SAM. GOV website. This announcement will give an opportunity for other vendors to demonstrate their ability to meet the FBI's specific needs through a submission of technical capabilities and cost information.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Before awarding a contract, the Contracting Officer will determine that the proposed price is fair and reasonable in accordance with FAR 13.106-3.
8. A description of the market research conducted and the results.
Extensive market research was conducted via the internet searching for human performance and leadership coaching applications. Arena Labs is the only that was found with the capability to meet all LDU’s requirements. There are hundreds of applications for all kinds of coaching Strive is the only that integrates physiological markers as well as surveys on stress, and then provides real-time tools as well as live one on one coaching.
9. Any other facts supporting the use of other than full and open competition.
No other product was found after extensive internet searches, for the purposes of this pilot program to prove the efficacy of holistic web-based/application content, coaching and human performance application to be used in conjunction with LDU leadership programs there are no other applications that meet LDU’s requirements at this time.
10. A listing of any sources that expressed a written interest in the acquisition.
A synopsis will be posted on the SAM. GOV website. This synopsis will give an opportunity for other vendors to demonstrate their ability to meet the FBI's specific needs through a submission of technical capabilities and cost information.
11. A statement of any actions the agency may take to remove or overcome any barriers to competition if subsequent acquisitions are anticipated.
No decisions will be made on further acquisition until LDU is able to evaluate the efficacy of the Strive application at the end of the pilot program. The FBI will continue to research market conditions, to determine whether alternative products and/or suppliers might be able to fulfill future requirements image1.jpeg image2.png
