UNCLASSIFIED//FOUO
FEDERAL BUREAU OF INVESTIGATION
FINANCE and FACILITIES DIVISION I PROCUREMENT SECTION
JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND
OPEN COMPETITION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH 41 U.S.C. 3304 {A) {X}f
Requisition Number: DJF-23-1800-PR-0003195
Date: 03/24/2023
1. Identification of the agency and contracting activity.
{U//FOUO) The U.S. Department of J ustice, Federal Bureau of Investigation {FBI), Science and
Technology Contracts Unit, has prepared this justification for other than full and open competition for RF Shielded Tent Enclosures on behalf of the Tactical Computer Access Unit
(TCAU), Operational Technology Division {OTD).
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
{U//FOUO) This procurement will be conducted as a limited source, brand name only procurement. Only one responsible source will meet the necessary requirements. The Large LX
Black Shell RF/EMI Shielded Enclosure Room manufactured by Faraday Defense
Corporation has critical features that are unique to this supplier.
3. A description of the supplies or services required to meet the agency's needs.
{U//FOUO) The requirement is to provide {3) Faraday Defense - Large LX Black Shell RF/EMI
Shielded Enclosure Rooms -{1) with vestibule and (2) without vestibule. These enclosures shall include the following features:
1) Size -Minimum of 7' x 7' x 6'
2) Frame -Heavy duty tubular steel frame
3) Heavy Duty Vinyl Flooring
4) RF shielding- Minimum of-90 dB attenuation from 30 MHz -10 GHz
5) Power Filter - Minimum -100 dB attenuation from 100 kHz -40 GHz
6) 1/0 Port Plate w/ {1) USB-C, (1) RJ-45 lG, (1) HDMI, {1) USB2.0, (2) SMA, {1) N connector
7) Ventilation fan and exhaust
8) EMI hardened lighting
9) Protective outer layer of nylon fabric (LX Black Shell)
4. The statutory authority permitting other than full and open competition.
(U) The statutory authority permitting other than full and open competition is 41 U.S.C. 3304
(a)(l) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency
Requirements."
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
(U//FOUO) The RF Shielded Tent Enclosures manufactured by Faraday Defense Corporation are the only products identified that meet the minimum requirements necessary to meet the governments need. Specifically, the Faraday Defense - Large LX Black Shell RF/EMI Shielded
Enclosure Room is rated to provide an average shielding effectiveness of -90 dB in the range of
30 MHz to 10 GHz and -92 dB attenuation in the range of 1 GHz to 40 GHz. The Faraday
Defense product provides -100 dB of attenuation near 5-6 GHz, which is crucial for many of the expected testing procedures. Other products on the market do not provide the same level of RF attenuation at frequencies of interest to the government. Ineffective RF shielding performance would jeopardize sensitive testing activities and potentially render such tests inaccurate.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
(U//FOUO) During market research, several sources were identified that are dealers for Faraday Defense products. Quotes were obtained from three sources.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
(U//FOUO) Quotes were obtained from three suppliers with the lowest quote being directly from the manufacturer, Faraday Defense Corporation.
8. A description of the market research conducted and the results.
(U/ /FOUO) Market research identified Faraday Defense Corporation as the manufacturer of the only product that met the minimum specifications required. Other products were evaluated, however, none provided the necessary level of RFattenuation at frequency ranges important to the government. Furthermore, discussions with colleagues at other agencies provided information on products available in the marketplace. Faraday Defense Corporation's products received positive reviews from other government customers with similar requirements.
9. Any other facts supporting the use of other than full and open competition.
N/A
10. A listing of any sources that expressed a written interest in the acquisition.
N/A
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
(U) There are no current plans for future acquisitions of this product. If additional procurement becomes necessary, then market research will be used to ensure that all possible sources are evaluated.
