JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SMALL BUSINESS INNOVATIVE RESEARCH

I. CONTRACTING ACTIVITY

This Justification and Approval to request authority for Other Than Full and Open Competition supports requirements generated for the Defense Logistics Agency, DLA Aviation-FAQE. The contracting authority for this requirement is DLA Aviation, FAQE. The purchase request number supporting this contracting action is 1000189213.

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

Due to the circumstances described herein, this activity requests authority to acquire the items/spares listed in this document using Other Than Full and Open Competition as prescribed by FAR 6.302-5, Authorized or Required by Statue This action will result in the award of a new contract, which will be a firm-fixed price. This sole source requirement will be purchased from the following company:

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

Under the contemplated contract, AMG Engineering & Machining, Inc. will provide the following supplies which are required to support the Aircraft, C-130 in sustainment of the Small Business Innovation Research (SBIR) program. The contract type is an indefinite delivery indefinite quantity for a base period of 5 years with no options. The guaranteed minimum delivery order will be 61 each with an estimated annual quantity of 244 each.

TOTAL POTENTIAL CONTRACT VALUE:

Delivery for the First Article Testing Material (1 each) will be 200 Days After receipt of Order. Government evaluation time is 60 days. Delivery of production materials will be 250 Days After First Article Approval. The total delivery time for this requirement is 510 Days After Receipt of Order.

This NSN has an AMC/AMSC of 1C. “1” indicates suitable for competitive acquisition for the second or subsequent time. “C” indicates this part required engineering source approval by the design control activity in order to maintain the quality of the part. Solicitation Number: SPE4A724R0803.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

10 USC 3204(a)(5), 15 USC 638( r )( 4 ) and 15 USC 638(r)(4)(B): Issue without further justification, Phase III awards relating to technology, including sole source awards, to the Small Business Innovation Research (SBIR) award recipients that developed the technology.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF

THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE

The NSN for this purchase requisition is part of the Small Business Innovation Research Program (SBIR).

Supplier, AMG Engineering and Machining Inc., CAGE 0FYD1, has gone through the DLA SBIR program and the Engineering Support Activity determined that AMG Engineering and Machining Inc., has the capability to manufacture this item in accordance with the specifications. As a result, they were added as an approved manufacturing source for this NSN in June 2024.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

This requirement will not be synopsized in accordance with FAR 5.202(a)(7). The proposed contract action results from acceptance of a proposal under the Small Business Innovation Development Act of 1982 (Pub.L.97- 219).

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO

THE GOVERNMENT WILL BE FAIR AND REASONABLE

The overall cost of this acquisition will be fair and reasonable to the Government. In accordance with FAR 15.404, it is anticipated that negotiations will be conducted using information other than cost and pricing data from the contractor. Thorough price analysis will be conducted using available information and approved pricing techniques that will support the contracting office in making a determination that the price paid to the contractor is fair and reasonable to the Government. Based on the foregoing, the Contracting Officer hereby determines the anticipated cost to the Government will be fair and reasonable.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR

STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED

Market research was conducted to determine whether CAGE 0FYD1 is available, capable and willing to perform the work needed to perform under a potential purchase order. Market research was not conducted to identify alternate sources due to justification provided in sections IV, V and VI. Due to procurement being a critical application item, alternate equipment or substitutes that might fill the Government needs with only minor modifications were not researched.
