The U.S. Coast Guard, Surface Forces Logistics Center (CG-SEA-C-SFLC) intends on awarding a one-time Firm-Fixed Price contract in order to purchase original equipment manufacturer (OEM) Fin Stabilizer System and components parts in support of USCG 154’ Patrol Boats (WPCs).

All items listed are parts manufactured by Quantum Marine Engineering, Inc., the OEM. To ensure proper form, fit, and function of the parts, only OEM parts shall be used. Items submitted under this solicitation which are other than OEM parts will be rejected as unacceptable.

I. This is a combined synopsis/solicitation for commercial items prepared in accordance with (IAW) the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Quotes are being requested and no further written solicitations will be issued.

II. This solicitation is being issued as a request for quotes (RFQ). Solicitation number 70Z08025Q16005B00 is assigned to the procurement for tracking purposes only. This requirement will be satisfied using FAR Subpart 13.5, Simplified Procedures for Certain Commercial Items.

III. The incorporated clauses and provisions are those in effect through Federal Acquisition Circular (FAC) 2025-05.

IV. Set-aside Status: Small Business. North American Industry Classification System (NAICS) Code is 333998 with a small business size standard of 700 employees. This combined synopsis/solicitation is being issued as restricted, total small business set-aside, sole source award under FAR 13.106-1(b)(i), as the required products are available from only one responsible source. A copy of the executed Justification for Other Than Full and Open Competition is attached to this announcement.

V. A list of the contract line-item numbers (CLINS), items, quantities and units of measure to be acquired can be found in ATTACHMENT 1 - SCHEDULE OF SUPPLIES AND PRICES. Unit prices are to include the cost of shipping, free on board (F.O.B.) destination, and the cost of individual preservation, packaging, packing and marking and bar-coding (PP&M) IAW ATTACHMENT 2 –Preservation, Packaging, Marking and Barcoding. All prices on CLINS shall be firm, fixed price for this one-time purchase.

If the quoter considers any additions, deletions or part-number changes of the parts required under this requirement, the contract specialist must be notified in WRITING PRIOR TO THE CLOSING DATE OF THIS SOLICITATION. All items will be shipped F.O.B. Destination as stated in FAR 52.247-34.

VI. Description of Requirement: The CG-SEA-C has determined, consistent with 6.303-2, that there is only one responsible source, and no other supplies or services will satisfy agency requirements. The statutory authority permitting other than full and open competition is Section 3205 of Title 10, U.S. Code, implemented by FAR Subpart 13.501(a) sole source (including brand name) acquisitions as defined in FAR 2.101.

The Contractor shall furnish all necessary labor, material, services, equipment, supplies, power, accessories, facilities and such other things as are necessary, except as otherwise specified, to provide the genuine OEM parts outlined in Attachment 1. All items to be individually packaged, marked and shipped F.O.B. destination IAW this solicitation and the attached specification titled, Preservation, Packaging Marking and Barcoding (Attachment 2).

Failure to read the specification in its entirety will not relieve the quoter from the responsibility for properly estimating the difficulty or price of successfully performing the work. Failure to do so will be at the quoter’s risk. All Quotes submitted in response to this solicitation shall stand firm for 120 calendar days from the response date of this solicitation.

Contract Type: This solicitation will result in the SEA-C SFLC awarding one (1) Contract.

Period of Performance: The period of performance of the subsequent contract shall be time of award, until final delivery and payment of contract.

Place of Contract Performance: Contractor’s facility Extent of Obligation: The Government is obligated only to the extent of authorized purchases actually made under this contract.

Individuals Authorized to Place Orders: The SEA-C-SFLC, CPD C&P1, Patrol Boat Product Line is the only contracting office authorized to place orders against this Contract.

VII. FAR 52.211-8 TIME OF DELIVERY (JUN 1997)

Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, may be considered nonresponsive and may be rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when a quoter offers an earlier delivery schedule than required above. Quoter shall fill in the Delivery Schedule on Column I of Attachment 1 with their proposed delivery schedule. If the quoter proposes no other delivery schedule, the required delivery schedule above will apply.

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful quoter, results in a binding contract. The Government will mail or otherwise furnish to the quoter an award or notice of award not later than the day award is dated. Therefore, the quoter should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor’s date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term “working day” excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer may be considered nonresponsive and may be rejected.

Final acceptance of the supplies or services furnished IAW this contract shall be made at destination by a Government Representative. Acceptance shall be contingent upon the Representative's verification of no damage in transit, correctness and completeness of the order and the contractor’s conformance to Shipping and PP&M requirements for this requirement.

VIII. FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (SEP 2023) APPLIES TO THIS ACQUISITION AND IS INCORPORATED BY REFERENCE.

(ADDENDUM)

A. To ensure timely and equitable evaluation of the quote, the quoter must follow the instructions contained herein. The quote must be complete, self-sufficient, and respond directly to the requirements of this solicitation. Quoter(s) may be required to submit other than cost and pricing data to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.

B. Submission of offers. Submit signed and dated quotes electronically to Dana Solomon at Dana.D.Solomon@uscg.mil on or before September 15, 2025, by 12:00 PM Eastern Standard Time. Documents may have to be sent in separate emails due to USCG email size restrictions, ZIP files are not permitted. As a minimum, offers must show:

1. The solicitation number;

2. Company address; point of contact name, phone number and e-mail address; SAM Unique Entity ID number (UEI); cage code; small business status and company’s business size

3. Schedule of Supplies and Prices only for the OEM parts listed filled out with a firm, fixed-price associated with each priced CLIN including any discount terms, see Attachment 1 of this solicitation

4. Warranty terms and conditions-Standard Manufacturer’s Warranty, see Warranty section of this solicitation on page 23

5. Address where all work will be performed

6. Completed copy of provision 52.212-3 Offeror Representations and Certifications – Commercial Products and Commercial Services

7. Proposed delivery schedule, if different from required delivery schedule, see Attachment 1 of this solicitation.

8. Invoicing point of contact

9. Signed SF 30 Amendment(s), if applicable; and

D. Specific Instructions:

The quotation shall be submitted electronically with four (4) attachments:

1. Attachment 1: Technical Capabilities Statement which details your ability to provide genuine OEM Quantum Marine Engineering, Inc. parts

2. Attachment 2: Price and Delivery Schedule –Enter pricing and delivery schedule data to Attachment 1, Schedule of Supplies and Price

3. Attachment 3: Warranty Information – Standard Manufacturer’s Warranty

4. Attachment 4: Reps. and Certs

· Questions are due via email no later than September 08, 2025, by 3:00 PM Eastern Standard Time to email address Dana.d.Solomon@uscg.mil. After this date further request may not be accepted due to time constraints. Keep in mind that any questions that are important, such as those that create needed changes to the specification, will still be addressed regardless of the time it was received. A determination will be made as to whether the change dictates an extension to the solicitation closing date and deadline for questions. All answers to questions will be provided in SF 30 Amendments to the RFQ and will be furnished to all prospective quoters. Receipt of all amendments must be acknowledged by signing each amendment and providing them with the quote/proposal by the RFQ due date/time.

· Quotations are due no later than September 15, 2025, by 12:00 PM Eastern Standard Time to Dana.d.Solomon@uscg.mil.

· All submissions shall include 70Z08025Q16005B00 in the subject line of the email. All offerors submitting quotations must be registered and active in SAM. https://www.sam.gov at time of submittal. If you are not actively registered in SAM, your quotation will not be considered.

· Late submissions will not be accepted.

INCURRED COSTS

The USCG shall not be liable for any cost incurred by the quoters in submitting quotes in response to this solicitation.

DHS NOTICE TO QUOTERS

It is DHS policy that pricing for competitive negotiations should be based on adequate price competition. However, in the event only one responsible quoter is obtained as a result of this solicitation, that quoter may be required to submit Data Other Than Certified Cost or Pricing Data (FAR 15.403-3) to support a determination that prices are fair and reasonable.

IX. FAR 52.212-2 - EVALUATION—COMMERCIAL ITEMS (NOV 2021) (ADDENDUM)

(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:

· Factor 1 – Price

· Factor 2 – Past Performance

Award will be made by identifying “from all quotations or offers received one that is suitable to the user” based on the lowest priced quotation offering the genuine OEM parts required in this solicitation. This is a commercial item acquisition utilizing simplified acquisition procedures, FAR Subpart 13.5. The evaluation and award procedures in FAR 13.106 apply IAW FAR Subparts 13.5(c) and 12.602(a).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quotation, shall result in a binding contract without further action by either party. Before the quotation’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

EVALUATION FACTORS

1.1 Factor 1: Price

a. Submission Requirements: The Schedule of Supplies and Prices ATTACHMENT 1 of the solicitation shall be completed by the contractor and submitted with their quote. Prices for all CLINS listed in the schedule shall be filled in. All unit prices shall be firm, fixed-price. Unit prices are to include the cost of shipping, free on board (F.O.B.) destination and the cost of individual PP&M IAW Attachment 2.

b. Minimum Requirement: Unit prices must include the cost of labor, shipping free on board (F.O.B.) destination and individually packaging/crating, packing and marking/bar coding IAW Attachment 2 –Preservation, Packaging, Marking, and Barcoding. An explanation of any unusual costs shall be included in the quote. The contractor’s price shall represent the best price in response to the request for quotations. The total contract amount shall be evaluated to determine whether the proposed prices are fair and reasonable.

1.2 Factor 2: Past Performance

a. Submission Requirements: There are no submission requirements for past performance.

b. Minimum Requirement: Evaluation of past performance will be based on contracting officer’s representative’s knowledge of and previous experience with the supply being acquired IAW FAR 13.106-2(b)(3)(ii)(D). In evaluating a contractor’s past performance, the government intends to review Contractor Performance Assessment Reporting System (CPARS) records, other existing past performance ratings on relevant contracts and other publicly available information. General trends in a contractor’s performance will also be considered.

The quoter shall complete only paragraph (b) of this provision if the quoter has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. FAR 52.204-24 - REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products or Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision—

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) ( https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".

(d) Representation. The Offeror represents that—

(i) For covered equipment—

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services—

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

FAR 52.209-5 – CERTIFICATION REGARDING RESPONSIBILITY MATTERS (AUG 2020)

(a) (1) The Offeror certifies, to the best of its knowledge and belief, that—

(i) The Offeror and/or any of its Principals–

(A) Are □ are not □ presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have □ have not □, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks "have", the offeror shall also see 52.209-7, if included in this solicitation);

(i) The taxpayer has received a statutory notice of deficiency, under I.R.C. § 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. § 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. § 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation.
