Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C241-23-AP-1987

1. Contracting Activity: Department of Veterans Affairs, Network/Program Contracting Office 1, located at Bedford MA, in support of VISN 01, VA Health Care System at Boston Medical Center 2237 # 523-23-2-7077-0029

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

This replacement equipment will replace our current vitrectomy units due to the malfunctioning laser ports. These lasers are reaching expected end of life and are not operating as expected. This equipment (for pars plana vitrectomy) is the primary technology required to perform nearly all vitreoretinal surgeries. This vitrectomy unit is used to cut and remove the vitreous in a highly specialized manner (very high cut rates- 20,000 cuts/min- to prevent excessive traction on the retina during surgery). The unit also provides infusion (fluid replacement) for any volume removed from the eye during surgery. It also provides illumination inside the eye. Additionally, the unit has a laser attachment so that retinal laser applications can be made using an instrument inside the eye (endolaser).

The estimated value of the proposed action is $111,538.23

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

Currently, there are only 3 vitrectomy systems on the market: Alcon Constellation (the current systems we have at the VA), Bausch and Lomb Stellaris Elite, and DORC EVA. By far, the most commonly used system is Alcon Constellation and this is the system that all of our retina surgeons have most familiarity with. We have used the Alcon Constellation for vitrectomy for the past 8 years at least. Our retina surgeons have all expressed the desire to continue to use the same system. The Constellation has several features which contribute to making it a leader in this space: superior aspiration, greater vitreous flow, increased control, minimized vitreous traction, enhanced fluid control, and pneumatic hand piece control. O.R. Elder, Inc. is the sole distributor of this equipment for the VA.

4. Description of market research conducted and results or statement why it was not conducted: The VA rule of two cannot be met. The OEM provided a letter stating that SDVOSB O.R. Elder is the only authorized distributor to the VA.

Market research did not reveal any other sources. Posted an Sources Sought notice and received no responses from capable sources.
