STATEMENT OF WORK
A. GENERAL INFORMATION
Title of Project: Purchase of two (2) 5,000# Capacity Internal Combustion Lift Trucks for West Texas VA Health Care System (WTVAHCS)
Scope of Work: This equipment is essential for material handling at various WTVAHCS warehouse locations.
Background: The Lift Truck is designed for use in indoor and outdoor areas (rough terrain), such as attached and detached warehouse and distribution centers, for loading and unloading trucks, transporting, picking, and stacking. This is essential as it is being ordered for a Logistics Service secondary warehouse.
Performance Period: The contractor shall complete the work required under this SOW in 120 calendar days or less from date of award, unless otherwise directed by the Contracting Officer (CO). Work at the government site shall not take place on Federal holidays or weekends.

The lift truck conforms to current Federal EPA regulations for off-road large spark ignited engines.
Quote MUST Include all freight, local dealer prep service, delivery to destination, and operator orientation on the new forklifts at no additional charge to the government.

Any changes to this SOW shall be authorized and approved only through written correspondence from the CO. A copy of each change will be kept in a project folder along with all other products of the project. Costs incurred by the contractor through the actions of parties other than the CO shall be borne by the contractor.

No contractor personnel required. This is for purchase of equipment.
J. SECURITY
The Certifications and Accreditation requirements do not apply, and a Security Accreditation Package is not required.
VHA Supplemental Contract Requirements for Combatting COVID-19
1. Contractor employees who work in or travel to VHA locations must comply with the following:
a. Documentation requirements:
1) If fully vaccinated, contractors shall show proof of vaccination.
i. NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination.
2) If unvaccinated, contractors shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor’s order or an FDA approved over-the-counter test that includes an affiliated telehealth service.
3) Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel.
4) Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.
2. Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the COVID-19 Screening Tool. Check regularly for updates.
a. Contractor employees who work away from VA locations, but who will have direct contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance, each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered https://www.va.gov/covid19screen/ https://www.va.gov/covid19screen/ https://www.va.gov/covid19screen/ contractor workplaces. Contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.
3. Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities.
4. For indefinite delivery contracts: Contractor agrees to comply with VHA
Supplemental Contract Requirements for any task or delivery orders issued prior to this modification when performance has already commenced.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. MONITORING AND COMPLIANCE (JUL 2018)
(a) This solicitation includes VAAR 852.219-10 VA Notice of Total Service-Disabled Veteran- Owned Small Business Set-Aside.
(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. (a) Pursuant to 38 U.S.C. 8127(k)(2), the offeror certifies that—
(1) If awarded a contract (see F(a)FAR 2.101 definition), it will comply with the limitations on subcontracting requirement as provided in the solicitation and the resultant contract, as follows:

*Pricing: Contractor shall submit line item pricing that incorporates all the requirements within the Statement of Work. Contractor shall submit unit prices rounded to the nearest hundredth.
Please ensure unit price and total amounts are correct.
Period for acceptance of offers: The offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers.
Failure to submit a complete offer may result in a non-responsive determination.
BASIS FOR AWARD
This is a competitive best value selection in which competing offerors' technical capability, lead time/delivery schedule and price will be evaluated to determine who represents the greatest benefit to the Government at a price that can be determined fair and reasonable. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement or inability to perform or provide all services/supplies requested shall result in an offer being determined technically not capability. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:
A. Following receipt of quotes, the Government will perform a comparative analysis of the quotes received. The Government will compare quotes to one another to select the quote that best benefits the Government in fulfilling the requirement. The evaluation of Government requirements outlined in this Request for Quote will determine suitability.
B. Contractors may submit more than one quote; however, contractors are strongly encouraged to submit their best lead time/delivery schedule and prices in response to this request for quote.
Offerors are encouraged to clearly demonstrate in their quote how their approach provides a better value to the Government beyond that of the minimum requirements.
C. Once the Government determines there is/are a contractor(s) that can provide forklift trucks that meet(s) the requirements of this request for quote, the Government reserves the right to communicate with only those contractors quoting the best-suited service to address any remaining issues.
D. The Government will evaluate quotes for award purposes using the following factors:
FACTOR 1: Technical Capability
The Contractor shall provide the following documentation with their offer:
1. Capability Statement, maximum 2 pages which can validate Technical Capability:
a. Vendor shall provide supporting document/s of how they will meet or exceed the General Requirements as outlined in the Statement of Work. (Two page maximum).
FACTOR 2: Lead Time/Delivery Schedule
The Contractor shall provide the following documentation with their offer:
1. Statement, maximum 2 pages which can validate lead time/delivery schedule:
a. Vendor shall provide supporting document/s of how they will meet or exceed the Performance Period as outlined in the Statement of Work. (Two page maximum).
b. Vendors shall provide their Best and Realistic delivery times; This is an urgent requirement for the West Texas VA Health Care System. Offerors are encouraged to clearly demonstrate in their quote how their ability to deliver forklift trucks immediately will provide a better value to the Government beyond that of the minimum requirements and performance period stated in the Statement of Work.
FACTOR 1: Price
The Contractor shall provide the following documentation with their offer:

• Period for acceptance of offers: The offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers.
• Prices will be evaluated for completeness and reasonableness.
Unrealistically high or low proposed costs or prices, initially or subsequently, may be grounds for eliminating an offeror from competition either on the basis that the offeror does not understand the requirement or has submitted an unrealistic offer. Additionally, unbalanced pricing poses an unacceptable risk to the Government and may be reason to reject an offer. The burden of proof for credibility of proposed costs/prices rests with the offeror. The Government reserves the right to amend the solicitation and remove any set-aside should pricing of all quotes be found unreasonable.
E. The Government intends to award a contract without discussions with respective offerors.
The Government, however, reserves the right to conduct discussions if deemed in its best interest.
