B.2 STATEMENT OF WORK

STATEMENT of WORK:

Preventative Maintenance of Bioness Vector Elite Gait System

SCOPE:

Contractor shall provide a contract to cover hardware and software for one (1) Base year and four (4) option years for a total of five (5) years which during that time is to include any required Preventive Maintenance, software support, to exclude upgrades, and clinical support, repair and/or replacement of damaged or missing parts for the following two (2) Bioness Vector Elite Gait and Safety Systems, workstation, and rails unit operates on.

SCOPE OF WORK/SPECIFICATIONS:

1.0 DESCRIPTION OF SERVICES:

Contractor will provide the following:

a. All materials, tools, and equipment necessary to provide services for Preventative Maintenance, software support, and clinical support, repair and/or replacement of damaged or missing parts for the following two (2) Bioness Vector Elite Gait and Safety Systems, workstation, and rails unit operates on

2.0 SERVICES

The Contractor shall provide:

a. All equipment and materials must be new, not refurbished, not rebuilt, nor 3rd party substitutes are acceptable.

b. Provide all materials, tools, and labor for total project scope.

c. The technician must be an Original Equipment Manufacturer (OEM) trained and certified by the Original Equipment Manufacturer (OEM) Bioness, Inc

d. In regards to both units, contractor will provide unlimited service repair visits, software support ( excuding upgrades), one (1) Preventative Maintenance per year for both units, phone support, 100% coverage on replacement parts, 48 Hour in-person response time for down systems, 100% coverage on labor and travel expenses, and extended coverage hours.

e. Each unit must include one (1) Preventative Maintenance per annual, Parts and labor on Vector Elite Gait and Safety System services to include all services required during preventive maintenance, safety inspections, troubleshooting, repairs, replacement of parts, tune-ups, calibrations with certified calibration checks and replacement of defective parts. Contractor must have an extensive US parts stocking and delivery network to minimize part delivery time. Contractor is to provide 100 percent of all services, parts hardware, proprietary software, tools, equipment needed to perform service, supplies, and labor.

B. Conformance Standards

a. All services provided under this contract must be performed in conformance with the Code of Federal Regulations Part 21, National Fire Protection Agency (NFPA), Occupational Safety and Health Administration (OSHA), and Original Equipment Manufacturer standards and specifications

3.0 GENERAL INFORMATION

a. Hours of Operation

i. Normal hours of operation are Monday through Friday from 8:00 am to

5:00 pm CST, excluding holidays. All services shall be performed during normal hours of coverage unless requested and approved by the COR.

1. Federal and National Holidays observed by the VAMC are:

a. New Year's Day, Labor Day, Memorial Day, Thanksgiving

Day, Christmas Day, Martin Luther King’s Birthday, Columbus Day, President’s Day, Veterans Day, and Independence Day.

i. Also included would be any other day specifically declared by the President of the United States to be a National Holiday.

2. When a holiday falls on a Sunday, the following Monday shall be observed as a legal holiday by U.S. Government agencies. When a holiday falls on a Saturday, the preceding Friday shall be observed as a legal holiday.

5.0 Additional Charges

There shall be no additional charge for time spent at the site (during or after the normal hours of coverage) awaiting the arrival of additional FSE and/or delivery of parts.

6.0 COMPLIANCE WITH SECURITY REQUIREMENTS

a. Identification:

i. All contractors working shall be fingerprinted prior to being allowed to work on campus. Contractor ID badges can be obtained from PIV office typically 3-5 days after approved SAC form is received and fingerprints clear. ID badges are required for contractor employees working at Audie L. Murphy Medical Center.

b. Contractor Personnel Vaccinations:

i. Seasonal Influenza Vaccination/Tuberculosis Testing:

A. VHA Directive 1192.01 establishes policy and provides guidance for the prevention of seasonal influenza in VHA facilities, through the vaccination of health care personnel (HCP). HCP are individuals who, during the influenza season, work in VHA locations or who come into contact with VA patients or other HCP as part of their duties. HCP include all VA contractors who are expected to perform any or all of their work at VA facilities.

Contracting Officers shall ensure the flu vaccination requirements outlined in this directive are expected in all HCP contracts. VA contracting officers are responsible for on-site HCP contract and will inform the contractors about this directive and its requirements.

ii. Tuberculosis Testing:

A. All Contractor personnel who will be working onsite must provide documentation of a completed tuberculosis (TB) skin test within the prior year before beginning work.

iii. All contractors must show proof of NEGATIVE TB test results, annual Flu vaccination, and any other requirements deemed necessary by Infection Prevention or the Secretary of the Departments of Veteran Affairs.

iv. All contractors must attend a mandatory Infectious Control Training held every Tuesday at 10 am at the Audie L. Murphy Memorial Hospital located at 7400 Merton Minter , San Antonio, Texas 78229, room E002.

v.

c. Parking:

i. It is the responsibility of the Contractor to park in the appropriate designated parking areas. Information on parking is available from the VA Police Section. The VAMC will not validate or reimburse for parking violations from the Contractor under any conditions.

d. Smoking, Weapons, and VA Regulations

i. Smoking and vaping are prohibited inside any building at the VAMC and on the STVHCS campus (including parking areas). Possession of weapons is prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of the VA regulations may result in citation answerable to the United States (Federal) District Court, not a local district, State, or Municipal court.

7.0 TECHNICAL REQUIREMENTS

b. The Contractor shall perform preventive maintenance and all required system tune-up services during the contract year as arranged with the COR for the following described equipment. Any parts that need to be replaced or repaired shall be performed in accordance with the published manuals and checklists for the equipment listed below.

c. The Contractor shall utilize the Original Equipment Manufacturers (OEM’s) established procedures and checklists, (or Contractor-supplied equivalent satisfactory to the COR).

d. A Field Service Report shall be supplied to the COR at the completion of each tune-up.

e. The Contractor shall notify the COR of the existence or development of any defects in, or repairs to the equipment covered under this contract which the Contractor considers he/she is not responsible for under the terms of the contract (such as operator misuse).

f. The contractor shall perform any follow up service work required for the system at any time during the normal business hours at the request of the COR during the Service Maintenance Agreement period. All exceptions to the service work scheduled shall be arranged and approved in advance with the Contracting Office.

8.0 Parts

The Contractor shall furnish all proprietary software and parts as necessary to maintain the equipment, covered by this contract, in accordance with the Conformance Standards Section. All proprietary licensed software and parts supplied shall be in accordance to the manufacture and have full compatibility with existing equipment. Documentation of intended parts source(s) shall be provided to the Contracting Officer upon request. All parts necessary for the maintenance or repair of this equipment shall be furnished as part of this contract. Refurbished parts will not be acceptable. Parts are to be delivered as soon as possible in order to minimize down time of covered systems or at the soonest available time.

9.0 Documentation/Reports:

The Contractor shall submit a legible field service report within 3 working days of completion, which shall include detailed descriptions of the Tune-up and/or emergency repair services performed, including replaced parts and estimated prices required for the service call.

NOTE: Any additional charges to be claimed must have been approved by the COR before service was performed and a valid purchase order must be obtained prior to initiation of the service repair if outside scope/hours of coverage.

10.0 Competency of Personnel Servicing Equipment:

a. The Contractor’s staff shall include a “fully qualified” Field Service Representative assigned to this area and a “fully qualified” Field Service Representative who shall serve as the backup.

b. “Fully qualified” is based upon training and on experience in the field. For training, the Field Service Representatives must have successfully completed a formalized training program for the equipment covered under this contract. For field experience, the Field Service Engineers must have a minimum of one (1) year of experience providing tune-ups and emergency repair services on the same make and model of equipment covered under this contract.

c. Personnel with any laptops, thumb drives or CD/DVD’s intended to be plugged in to the equipment are required to allow these devices to be scanned by Biomedical Engineering personnel for malware before they are plugged in to the systems. After repairs are completed, these systems must be brought to Biomedical Engineering personnel to be scanned for possible patient personal health history.

11.0 Test Equipment:

Upon request of the COR or the Contracting Officer, the Contractor shall provide a copy of the current Calibration Certification of all test equipment which is to be used by the Contractor to perform service under this contract. Calibration of equipment shall be traceable and in conformance with test equipment Original Equipment Manufacturer standards.

12.0 Safety Requirements:

In the performance of this contract, the Contractor shall take such safety precautions as the Contracting Officer may determine to be reasonably necessary to protect the lives and health of occupants of the building. The Contracting Officer shall notify the Contractor of any safety issues and the action necessary to correct these issues. Such notice, when served on the Contractor or his representative at the work site, shall be deemed sufficient for the corrective actions to be taken. If the Contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping all or part of the work, and hold the Contractor in default

13.0 DEFINITIONS/ACRONYMS

a. Acceptance Signature – VA employee who is authorized to sign-off on the ESR, which indicates that the PM has been concluded or is still pending completion, or that the Emergency Repair has been accomplished or is still in a pending status.

b. Authorization Signature – the COR’s signature; indicates that the COR accepts work status as stated on the ESR.

c. CO – Contracting Officer

e. VAMC – Department of Veterans Affairs Medical Center

14.0 INFORMATION SYSTEMS OFFICE, INFORMATION PROTECTION

The contractor will not have access to VA Desktop computers, nor will they have access to online resources belonging to the government while conducting services. If removal of equipment from the VA is required, any memory storage devices, such as hard drives, solid state drives and non-volatile memory units will remain in VA control and will not be removed from VA custody.

15.0 PRIVACY OFFICER

The contractor will not have access to protected Patient Health Information (PHI) nor will they have the capability of accessing patient information during the services provided to the VA and if removal of equipment from the VA is required, any memory storage devices, such as hard drives, solid state drives and non-volatile memory units will remain in VA control and will not be removed from VA custody. All research data available for Contractor analyses is de-identified.

16.0 RECORDS MANAGER

There will be no federal records created, maintained, used or dispositioned with this contract; regardless of format [paper, electronic, etc.] or mode of transmission [e-mail, fax, etc.]

17.0 TYPE OF CONTRACT

STVHCS anticipates award of a FIRM FIXED PRICE contract based on the contents of this solicitation.

18.0 SECURITY REQUIREMENTS

The C&A requirements do not apply, and a Security Accreditation Package is not required.

(d) Comptroller General Examination of Record. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR

EQUIPMENT (NOV 2021)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it ‘‘does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument’’ in paragraph (c)(1) in the provision at 52.204–26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212–3, Offeror Representations and Certifications– Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it ‘‘does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services’’ in paragraph (c)(2) of the provision at 52.204–26, or in paragraph (v)(2)(ii) of the provision at 52.212–3.

(a) Definitions. As used in this provision—

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204–25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.

Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services.”

(d) Representations. The Offeror represents that—

(1) It [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds “will’’ in paragraph (d)(1) of this section; and https://www.sam.gov/

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that—

It [ ] does, [ ] does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services.

The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds “does’’ in paragraph (d)(2) of this section.

(e) Disclosures. (1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded “will’’ in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment—

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand;

model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services—

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
