PERFORMANCE WORK STATEMENT (PWS)

SECTION 1

General Terms and Conditions: The terms and conditions contained in this section are applicable to all services for chiller systems located at all five locations identified in Attachment 1, unless otherwise stated in the specific subparagraphs on each locations equipment. Refer to Attachment 1 for all VA equipment associated with this performance work statement (PWS).

1.1 Not Used.

1.2 Maintenance Services

A.Maintenance Services includes Preventative Maintenance (PM) (paragraph 1.3), Repair Maintenance

(RM) (paragraph 1.4), Emergency Service (ES) (paragraph 1.5), and Call Back Service (CB) (paragraph

1.6).

B. Notwithstanding any term(s) to the contrary, the Contractor is responsible to perform all

PM and CB services, at no additional cost to the Government.

C. Whether a specific maintenance service is a PM, RM, ES, or CB service will determine financial liability for the associated costs. Such determination will be made by the Contracting Officer (CO) based on available facts and evidence. If the Contractor disagrees with the determination of the CO, the

Contractor has specific remedies available under the terms of the contract. The Contractor shall proceed diligently with performance of this contract, pending final resolution of any dispute arising under the contract.

1.3 Preventative Maintenance (PM)

A. Contractor shall supply all labor, tools, parts, material, equipment, supervision, and transportation necessary to perform complete Preventative Maintenance inspection and service of all items as identified in Attachment 1 during the contract period.

B. The PMs shall be performed in accordance with the terms and conditions, chart and tables contained herein, and the manufacturer’s recommended maintenance procedures.

C. It is the sole responsibility of the service Contractor to schedule and perform all preventative maintenance inspections at the intervals specified, at a time mutually agreeable with the COR or his

Engineering designee. The Department of Veterans Affairs does not assume any responsibility for reminding the service Contractor that a preventive maintenance inspection is due to be performed.

D. The Contractor shall provide out-of-cycle or missed PM services, as required, which may consist of calibration, cleaning, oiling, adjusting, replacing PM parts, and maintaining the equipment, including all intervening calls necessary between regularly scheduled PMs at no additional cost for parts or labor, including providing documentation (see paragraph 1.10).

E. The Contractor is responsible for paying for all normal PM parts and fluids (including batteries and PM parts shipping expenses).

F. Parts and Labor not included within the PM or CB Service will still be considered “Within

Scope” of this PWS, however, must be obtained through a separate modification that has been authorized by the Contracting Officer. The cost of Parts will be based on the Contractor’s actual cost of the item less any discounts received by the Contractor on those parts and fluids, plus shipping charges.

1.4 Repair Maintenance (RM)

A.The contractor will provide RM services when the equipment fails or breaks-down. Repair services may consist of calibration, cleaning, oiling, adjusting, repair service and replacing failed parts.

B. RM Contractor labor, parts and fluids are considered ‘Within Scope’ of this PWS, however, must be obtained through a separate modification that has been authorized by the Contracting Officer.

Contractor shall evaluate the extent of the required repair and provide the Government with a cost estimate (parts and labor to be included). Contractor shall note that all proposals are subject to negotiation. The Government may pay the Contractor shipping costs, labor costs, and the actual cost of the parts and/or fluids less any discounts received by the Contractor on the supplied parts and fluids.

Contractor shall note that prior to purchasing parts and/or performing the RM, Contractor must obtain written approval by the Contracting Officer (or an authorized designee).

1.5 Emergency Services (ES)

A. Emergency Service calls are service calls, necessitated by damage to equipment caused by actions of Government employees, actions of other Government Contractors (e.g. PG&E, or other utility providers), and/or acts of nature or forces beyond the control of the Government (such as floods, tornadoes, acts of Terrorism, etc.).

B. ES Services including all parts, fluids and direct Contractor labor are costs considered ‘Within

Scope’ of this PWS, however, must be obtained through a separate modification that has been authorized by the Contracting Officer. Contractor shall evaluate the extent of the required repair and provide the

Government with a cost estimate (parts and labor to be included). Contractor shall note that all proposals are subject to negotiation. The Government may pay the Contractor shipping costs, labor costs, and the actual cost of the parts and/or fluids less any discounts received by the Contractor on the supplied parts and fluids. Contractor shall note that prior to purchasing parts and/or performing the RM, Contractor must obtain written approval by the Contracting Officer (or an authorized designee). Contractor shall provide the Government documentation upon ES service completion (see paragraph 1.10).

1.6 Call Back Service (CB)

A.Call Back Services is a service call, which is required due to incomplete repairs by Contractor. The

Contractor shall provide such service calls as required, at no cost to the Government, and provide documentation upon completion (see paragraph 1.10).

1.7 Response Time/Days and Hours of Work

A.Days and Hours of Work: RM, ES, and CB services required in the PWS shall be performed on an “on call” basis. Contractor shall respond (on-site physical response) to these service calls and proceed with the service without undue delay within three (3) hours after being notified, twenty-four (24) hours a day, seven (7) days a week, (365) days a year.

B. PM inspections shall be performed Monday thru Friday, between 8 AM and 4 PM at a time agreed upon by the Government. The Contractor shall notify the COR or his Engineering Designee at least (48) hours in advance of all preventive maintenance visits. VA Engineering contact information shall be provided to the Contractor upon contract award.

C. The Contractor phone number for the VA to call to initiate all maintenance service at all sites being serviced shall be provided to the VA within 10 business days of contract award.

1.8 Competency of Personnel Servicing Equipment

A.All Contractor service technicians must be fully trained and with at least three years of relevant experience. Technicians shall have received any necessary training or certifications to perform tasks associated with this PWS to the standards detailed therein.

B. Contractor staff shall include a "Fully Qualified" service technician and a "Fully Qualified" service technician who will serve as the backup.

C. "Fully Qualified" is determined based upon documented training and experience in the field. For training, the service technician must have successfully completed a formalized training program for the

VA Heating, Ventilation, and Air Conditioning (HVAC) equipment listed in Attachment 1 - VA HVAC

Equipment Listing and/or associated documents. For field experience, the service technician must have a minimum of three (3) years experience with respect to maintenance and repair service on VA HVAC equipment in Attachment 1.

D. All work shall be performed by "Fully Qualified" competent service technicians.

E. The Contractor shall submit as part of their proposal written assurance of the competencies of their personnel and provide credentials of their “Fully Qualified” service technicians. The Contracting

Officer (CO) may request training certificates or credentials from the Contractor at any time for any personnel who are servicing or installing any VA equipment. The CO, or their authorized designee, may authenticate the training certifications.

F. The CO and/or the COR specifically reserve the right to reject any of the Contractor's personnel and refuse them permission to work on the VA equipment.

G. The Department of Veterans Affairs will not provide service manuals to the Contractor. The

Contractor shall obtain, keep on file, and make available to its employees all operational and technical documentation (such as; operational and service manuals, schematics, and parts list) which is necessary to meet the requirements of this PWS. Each technician performing work on the instrumentation included in this agreement shall maintain a complete file of technical documentation on the product he/she works on.

The location and listing (by name) of the service data manuals and/or the manuals themselves shall be provided to the VA upon request. Records to be kept on file, and presented to the VA upon request include the following:

1.Complete Wiring Diagrams

2.Service Manuals

3.Trouble Shooting Guides

4.Service Update memos

1.9 Availability of Test & Repair Equipment and Spare Parts

A.Contractor shall have the necessary test and calibration equipment and replacement parts available within 24 hours after the initial service call has been placed. The Contractor need not own equipment, but can rent, lease, or borrow if it is necessary. If equipment is not owned, Contractor shall be able to prove that such equipment will be available, when needed within 24 hours.

B. Contractor shall show proof of order for parts replacement within 24 hours when a part is not included in their inventory. The Contractor shall make arrangements for the fastest delivery and will resume work upon receipt of part(s) the following calendar day.

C. Contractor shall accomplish repairs without borrowing parts or supplies from any other facility.

D. Each Contractor employee shall have available the manufacturers recommended basic parts.

E. All parts replaced shall be identified by part number shown on the manufacturer’s part list. All parts replaced shall be new or Factory Rebuilt replacement parts, which meet the original manufacturer’s specifications.

1.10 Documentation

A.At the completion of each maintenance service, the Contractor shall present a written service report to the COR or his Engineering designee. The report shall clearly indicate the date of the service, the type of service performed, the model and serial number(s) of the equipment serviced, parts used/replaced/needed for service, the name of the field service technician, actual versus acceptable operating parameters and a brief description of the service performed. The COR or his Engineering designee will sign the report and shall be provided a legible copy from the Contractor.

B. Refrigerant Log Book (RLB): Contractor shall establish and maintain an RLB at each facility which will track and document refrigerant usage.

1.11 Technical Support

A.If the equipment listed herein has a malfunction that remains undiagnosed after 24 hours (one day) once repairs have begun, the Contractor shall contact the COR or his Engineering designee. After consultation with the Contractor, the VA representative will make a determination of how to proceed.

1.12 Engineering Changes

A.All Engineering Changes (EC) issued by the manufacturer for the propose of enhancing the level of maintenance or reducing the incidents of equipment problems leading to downtime of equipment will be communicated to the COR by the Contractor. Implementation by the Contractor of all Engineering changes requires written authorization by the Contracting Officer (CO). The COR will assist in coordination with the CO, if necessary, in order to obtain the written authorization (email may be appropriate at CO’s discretion) for the Contractor to proceed with the implementation of the EC.

Implementation of an EC is considered ‘Within Scope’ to this PWS, however, must follow similar procedures for RM or ES services. Once the EC has been implemented and the negotiated costs paid for by the VA, that EC then becomes a regular part of the ongoing PM service, at no additional cost to the

VA.

1.13 Identification, Parking, Smoking, Cellular Phone Use and VA Regulations

A.The Contractor's maintenance technician shall wear visible identification at all times while on VA campuses. It is the responsibility of the Contractor to park in the appropriate designated parking areas.

Information on parking is available from the VA Police-Security Service. The VA will not invalidate or make reimbursement for parking violations of the Contractor under any conditions. Smoking is prohibited inside all VA buildings and on VA campuses excluding designated smoking areas. Cellular phones and two-way radios are not to be used within six feet of any medical equipment. Possession of weapons is prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in a citation answerable in the United States (Federal) District Court, not a local district state, or municipal court.

1.14 Compliance with OSHA Bloodborne Pathogens Standards

A.Contractor QAQC plan shall detail methods by which all employees are educated as to risks associated with bloodborne pathogens.

B. Contractor QAQC plan shall have policies and procedures which reduce the risk of employee exposure to bloodborne pathogens.

C. Contractor QAQC plan shall detail mechanisms for employee counseling and treatment following exposure to bloodborne pathogens.

D. Contractor shall provide appropriate personal protective equipment/clothing such as gloves, gowns, masks, protective eyewear, mouthpieces for all employees throughout the performance of this contract.

1.15 Recommendations for Optimum Performance

A.If applicable, Contractor shall provide recommendations and information concerning additional maintenance, repair, or replacement to obtain/maintain systems at optimal performance.

1.16 Refrigerant Requirements

A.Contractor shall supply all refrigerants, as required for PM purposes, for each chiller at no additional cost to the VA and shall follow the appropriate service procedures for billing according to the service type as stated within paragraphs 1.3.F, 1.4, .1.5.

B. Contractor shall only use certified technicians and certified equipment when evacuating or charging the refrigerant for the centrifugal chillers. Contractor shall provide, upon request, documentation demonstrating proper certification.

1.17 Maintenance Services Exceptions

A.The water towers at all VA facilities are not included in the maintenance service requirements of this

Performance Work Statement (PWS).

B. The purge assembly on the Building 98 McClellan chiller shall be included in the maintenance service requirements, however the Purge equipment at VA Facilities (with the exception of the McClellan campus) are not part of the maintenance service requirements of this PWS.

1.18 Records Management

A.The following standard items relate to records generated in executing the contract and should be included in a typical Electronic Information Systems (EIS) procurement contract:

1. Citations to pertinent laws, codes and regulations such as 44 U.S.C chapters 21, 29, 31 and 33;

Freedom of Information Act (5 U.S.C. 552); Privacy Act (5 U.S.C. 552a); 36 CFR Part 1222 and Part

1228.

2. Contractor shall treat all deliverables under the contract as the property of the U.S. Government for which the Government Agency shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest.

3. Contractor shall not create or maintain any records that are not specifically tied to or authorized by the contract using Government IT equipment and/or Government records.

4. Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected by the Freedom of

Information Act.

5. Contractor shall not create or maintain any records containing any Government Agency records that are not specifically tied to or authorized by the contract.

6. The Government Agency owns the rights to all data/records produced as part of this contract.

7. The Government Agency owns the rights to all electronic information (electronic data, electronic information systems, electronic databases, etc.) and all supporting documentation created as part of this contract. Contractor must deliver sufficient technical documentation with all data deliverables to permit the agency to use the data.

8. Contractor agrees to comply with Federal and Agency records management policies, including those policies associated with the safeguarding of records covered by the Privacy Act of 1974. These policies include the preservation of all records created or received regardless of format [paper, electronic, etc.] or mode of transmission [e-mail, fax, etc.] or state of completion [draft, final, etc.].

9. No disposition of documents will be allowed without the prior written consent of the Contracting

Officer. The Agency and its Contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. Records may not be removed from the legal custody of the Agency or destroyed without regard to the provisions of the agency records schedules.

10. Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (Subcontractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, this contract. The Contractor (and any Subcontractor) is required to abide by Government and Agency guidance for protecting sensitive and proprietary information.

MAINTENANCE SERVICE OF CHILLERS AT VANCHCS MARTINEZ, FAIRFIELD (TRAVIS

AFB) AND MARE ISLAND OPCS (ITEMS 1 THRU 14 OF ATTACHMENT 1 )

2.1 General Information

A.Contractor shall provide all labor, tools, parts, material, equipment, supervision, and transportation necessary to perform maintenance services on eleven (11) chillers/air conditioning units and associated equipment. Equipment is located at the following locations:

Martinez Outpatient Clinic (OPC) – 150 Muir Road, Martinez, CA 94553

Fairfield Outpatient Clinic (OPC) – 103 Bodin Circle, Travis AFB, CA 94535

Mare Island Outpatient Clinic (OPC) – 201 Walnut Avenue, Vallejo, CA 94592

2.2 Maintenance Services

A.The Contractor shall perform maintenance services to ensure that equipment identified in paragraph

2.1. functions in conformance with the manufacturers’ technical performance specifications.

1.One (1) annual PM inspection will be performed during the month of April, and quarterly preventive maintenance inspections in the months of October, January and July, on items 1, 2, 3, 6, & 11.

2.Quarterly PM inspections shall be completed during the months of October, January, April, and July on items 4, 5, 7, 8, 9, 10.

B. The Contractor shall provide and utilize procedures and checklists with worksheet originals indicating work performed and actual values obtained and provide copies to the maintenance Supervisor or his designee at the completion of the service (see Tables 2.1 and 2.2).

2.3 Top End Valve Replacements

A.The Contractor shall perform top end valve replacements every 5,000 hours on all four York J Series compressors (items 1 & 2 on contract) per manufacture’s recommendations with "Top Head Valve

Replacement Kits". Contractor shall provide all parts and labor necessary to furnish and install "Top Head

Valve Replacement Kits" on each compressor every 5,000 hours of operation. Compressors typically run between 2,000- 3,500 hours per year, based on previous estimates.

B. All costs for these “Top End Valve” replacements are part of the PM services noted above in paragraph 1.3 Preventative Maintenance (PM). Contractor will provide all labor and materials to perform these replacements and perform this work at no additional cost to the Government.

2.4 Documentation

A.The Contractor shall provide and utilize procedures and checklists indicting work performed at the completion of each maintenance service call and provide copies to the COTR or his/her designee at the completion of the service at the following locations:

Building #12 at Martinez OPC

Room #1108 at Mare Island OPC

Room #A147 at Fairfield OPC

3.1 General Information

A.Contractor shall provide all labor, tools, parts, material, equipment, supervision, and transportation necessary to perform maintenance services on two (2) Carrier 19XR Chillers and associated equipment located at the Sacramento Medical Center, 10535 Hospital Way, Mather, CA 95655.

3.2 Maintenance Services

A.The Contractor shall perform Maintenance Services to ensure that equipment listed therein functions in conformance with manufacturer’s technical performance specifications.

B. Monthly PMs shall be performed monthly and consist of inspections, lubrication, adjustment, painting, and other maintenance as required to ensure that the water chillers are operating at optimal efficiency and in conformance with the manufacturer’s technical performance specifications. Monthly PM tasks include:

1.Contractor shall observe all danger, caution, warning, and safety considerations outlined in the maintenance instructions.

2.Contractor shall review unit operation with Maintenance and Operations personnel prior to beginning work.

3.Check oil level and pressure.

4.Check Refrigerant charge level at full load.

5.Inspect the control center; tighten any loose connections.

6.Perform automated control test in the service menu, inspect any problems noted.

7.Inspect starter contacts for wear or pitting.

8.Check condenser and evaporator approach temperatures; make tube cleaning recommendations.

9.Review any problems with the MOS or his/her designee.

10.Provide a written report upon completion of monthly maintenance.

C. Annual PMs shall be performed and consist of inspections, lubrication, adjustment, painting, tube cleaning, and other maintenance as required to ensure that the water chillers are operating at optimal efficiency and in conformance with the manufacturer’s technical performance specifications. Annual PM tasks includes:

1.Contractor shall observe all danger, caution, warning, and safety considerations mentioned in the maintenance instruction

2.Perform Compressor Motor continuity check.

3.Check and tighten motor terminals, motor starter contacts and wiring.

4.Record motor nameplate amps. Meg the motor (3 phases).

5.Check Compressor oil level and pressure.

6.Check guide vane linkage; adjust as necessary.

7.Check motor bearing and temperature sensor for accuracy.

8.Using the control test feature, check the accuracy of the pressure and temperature transducers/sensors.

Oil differential pressure transducer, condenser pressure transducer, and cooler pressure transducer.

Calibrate as necessary.

9.Inspect the control center; tighten any loose connections, clean cabinet as necessary.

10.Perform automated control test in the service menu, inspect any problems.

11.Inspect Benshaw panel, tighten any loose connections, clean cabinet as necessary.

12.Perform a complete leak test of the chillers using an electronic leak detector and bubbles if necessary.

13.Take oil samples for laboratory analysis and provide report.

14.Change oil filter, oil reclaim filter, and refrigerant filter.

15.Check condenser and evaporator approach. Open bell end of condenser; brush tubes as necessary, make cleaning recommendations as necessary.

16.Remove and clean condenser sensors.

17.Check operation of automatic condenser tube cleaning system valves; replace brushes as necessary.

18.Disconnect relief valve vent piping and inspect valve body for corrosion

19.Provide report of all items tested/inspected at the completion of the annual maintenance to the M&O

Supervisor or designee.

20.Annual maintenance is to be performed in the winter months between December and March.

4.2 Maintenance Requirements

A.The Building 98 (McClellan Clinic) Trane Chiller model number CVHE-025F-

APGB2475CEZ14CEZA0000000062J00 water chiller PM requirements are as follows:

1.One Annual PM shall be performed in April of each year, and includes inspections, lubrication, adjustment, painting, tube cleaning, and other maintenance as required to ensure that the water chillers are operating at peak efficiency in conformance with the manufacturer’s technical performance specifications, and in accordance with Tables 4.1, 4.2, 4.3, and 4.4.

2.Twelve Monthly PMs, one each month, in accordance with paragraph 4.3.A below (items 1 thru 8). The

April Monthly PM may be performed concurrently with the Annual PM.

B. The Building 88 Trane Model CGAEC30GAAA19 Serial J94A66661 water chiller PM service requirements are follows:

1.One (1) Annual PM in April in accordance with paragraph 4.3.B below (items 1 thru 15).

2.Three (3) Quarterly PMs in October, January, and July, in accordance with paragraph 4.3.C below

(items 1 thru 7).

A.Perform the following Purge System Control Check

1.Turn the chiller OFF and remove the purge power fuse located in the chiller control panel.

2.Confirm that there is no power between 6TB1-l to 6TB1-3 and 6TB-2 to 6TBl-3.

3.Remove power from 6TBl-7 and 6TB1-8. This will disable the “remote fault Indication” circuit, if used.

4.Disconnect and isolate the RUN signal lead that connects the chiller control panel to 6TB 1-2.

5.CAUTION: Failure to disconnect the RUN signal lead will cause the chiller to start during test procedure.

6.Connect a test switch between terminals 6TB1-l and 6TBl-2 in the purge control panel to simulate a chiller RUN signal during testing. Turn this switch OFF.

7.On retrofit units, switch purge control switch 6S3 to OFF.

8.Record original timer setting and reset fault timer 6DL2 time setting to 1.6 minutes.

9.Manually close the shut off valves on both the purge tank inlet (suction) line and the

10.liquid return line to isolate the purge tank from the chiller condenser.

11.Disconnect the ¼” copper line between the pump our compressor 3B6 and isolation solenoid valve

3L3. Disconnect the line that vents the pump-out compressor discharge to the rupture disc vent line at the pump-out compressor outlet. Using a temporary line (¼” minimum), connect the vent line to the outlet of solenoid valve 3L3 (on top of the control panel). This will vent the purge tank to outside atmosphere during testing.

12.Replace the purge power fuse and confirm power across terminals 6TB1-1 to 6TB1-3.

B. Purge Tank Checkout and Water Removal

1.Isolate the purge by closing the valves on the purge vapor inlet and liquid return lines (between the chiller condenser and the purge tank).

2.With the purge condensing unit turned off, pressurize the purge tank through the water bleed valve located on the tank sump to a maximum of 15 psig and test the solenoid valves to insure they seal properly.

3.Check the purge tank sump sight glass for water. If no water is visible, proceed to “drier core replacement (2 COR-49)”

4.If a layer of water is visible on the refrigerant in the purge sump sight glass: with the purge tank isolated from the chiller, pressurize the purge tank through water bleed valve with dry air or nitrogen to a maximum 15 psig. Close valve to contain pressure within purge. Disconnect nitrogen and connect a refrigerant hose from the angle valve to a suitable approved containment vessel. Open water bleed valve.

The water and a small amount of refrigerant will flow into the containment tank.

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

(a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. (1) Within a reasonable time after the defect was discovered or should have been discovered;

and

(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.
