Description of Action: This procurement will be awarded as a new one-time buy against a delivery order/task order.

3. Description of Supplies or Services:
The estimated value of the proposed action is $ 75,000.00
To renew VHA’s Sponsorship of the National Academies of Sciences, Engineering and Medicine’s Forum on Microbial Threats. Annual cost is $75,000.00.
The Sponsorship provides VHA with membership on the Forum to participate in matters involving infectious diseases and infection prevention and control that affect Veteran patients and staff.

4. Authority:
Order Against FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:
An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);
Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405- 6(a)(1)(i)(C)); or
Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).
5. Rationale/explanation to support cited authority:
VA Rule of Two cannot be met. This is the only Forum of such prominence in the world.
This is the only known Forum in the world that conducts work of the nature described in the Statement of Work (SOW) and VHA’s Sponsorship has continued for several decades since a former Under Secretary for Health requested and established it. The Forum is actively involved in issues pertaining to COVID-19. This is the only Forum of such prominence in the world.

The Forum is actively involved in issues pertaining to COVID-19. A former VHA Under Secretary for Health wanted VHA to participate in the Forum. VHA has been participating since the 1990’s. It has been occurring ever since. The yearly charge is $75,000.00. National Academy of Sciences have scientific forums that are held during annual exchanges to formalize cooperative relations between communities via public lectures. The Veterans Health Administration has several other affiliations with the National Academies of Sciences. Convene discussions among the nursing and doctors of government and community hospitals for knowledge updates and synchronicity among the medical fields. NAS assumes full technical and legal responsibility under its Act of Incorporation for the work to be carried out under any resultant agreement.
NAS is a private federally chartered corporation exempt from federal Internal Revenue Service Code section 501(c) (3).

6. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
