This project is to upgrade the electrical circuits that feed the main kitchen located in building 200 at Northport VA

Medical Center, 79 Middleville Rd, Northport, NY 11768.

The Contractor shall furnish all materials, supplies, equipment, personnel and supervision to accomplish project number

632-19-112, upgrade electrical circuits that feed the kitchen area, 109 replace Building 5 Electircal Switchboard in

109acoordance wi th the Statement of Work (SOW), specifications and drawings attached hereto.

Contractor will be responsible to coordinate and schedule work to minimize to short duration and shall be expected to plan work typically during duty hours of 8 AM to 4:30 PM eastern time except as noted in the general conditions and as approved by the CO. Work shall comply with VA Specifications and regulations, all applicable Federal, State and Local codes, including specific regulations related to working at the Northport VA Medical Center.

This is a Service-Disabled Veteran Owned Small Business (SDVOSB) set aside procurement and is conducted in accordance with Public Law 109-461. All prospective offerors must be registered in SAM (www.sam.gov) under the North American

Industry Classification System Code (NAICS) 238210, Duns & Bradstreet (www.DNB.com) and are verified/visible/certified in VetBiz (www.vetbiz.gov) at the time of offer submission and before award of this procurement. Offerors must submit the annual Vets-4212 Report. The NAICS is 238210 & BusinessSize is $16.5 Million. Magnitude of Construction is between

$250,000.00 and $500,000.00. Completion Time is 180 calendar days from the Notice-to-Proceed date.

A site visit date is scheduled for Thur. 6/18/2020 at 10:00AM, 11:30am, or 1:00pm EST. Email Delfo.Sacomizhquiri@va.gov to schedule a time for the site visit. Space is limited due to current meeting size restrictions. Interested parties without a confirmed appointment time will not be permitted on site. Prospective bidders are to meet at 70 Middleville

Rd., Building 17 Conference Room, Northport NY 11678. This will be the only site visit date for the project, absolutely no other visits will be scheduled.

Project Name: Northport Kitchen Equipment Upgrades Project No. 632-19-112

PART A – GENERAL INFORMATION:

1. Summary:

The Northport VAMC has a requirement to upgrade the main kitchen location in building

200. This upgrade will help the kitchen staff be more efficient in the preparation of patient meals.

Current State:

The current kitchen Layout and installed equipment does not lend itself to a made to order, or an efficient way of preparing a variety of meals for the facility. All electrical circuits that feed the kitchen area are in need of these upgrades in order to address code and safety issues.

PART B – WORK REQUIREMENTS:

1. Scope of Services:

a. Northport Facility will provide a Kitchen Floor Layout for installation of existing and new kitchen equipment. Also, Northport will provide a design showing replacement of all electrical panels serving kitchen area.

b. In house design to include Drawings, Design Specifications, IGCE, and SOW.

c. All construction work required for this project will be contracted outside for installation and commissioning.

PART C – SUPPORTING INFORMATION:

1. Place of Performance:

Northport VA Medical Center

79 Middleville Rd, Northport, NY 11768

2. Period of Performance:

All areas of the Northport VAMC and offsite facilities are expected to be occupied during construction. The phasing of this project would be coordinated with Chief of

Nutrition and Food Service and the Contracting Officer’s Representative (COR).

Each phasing of work would be planned and approved by the Contracting Officer prior to commencing of work.

The contractor would prepare and submit proposal to perform all work in normal business hours (8:00am to 4:30pm) while the project area would be closed for kitchen operation for contractor’s performance. Alternate method of food preparation will be arranged by Chief of Nutrition and Food Service.

The contractor shall begin work as soon as possible, but no later than 15 calendar days after the arrival of the parts and equipment that need to be ordered and completed it within 180 calendar days after receiving “Notice to Proceed” (NTP).

The start date must be approved and coordinated with the VAMC Contracting

Officer’s Representative (COR).

3. Special Considerations:

A. Contractor Furnished Materials - All labor, materials, equipment to perform the job.

When “furnish”, “provide”, “install”, or similar term is used it shall mean a complete installation, ready for use. The vendor shall supply all parts, equipment, material and labor to conduct work as listed in the Statement of Work above. The work will include all items as described in the Scope of Work listed above.

B. Government Furnished Materials and Services - Government furnished property, if any, will be identified and will only be used for the performance of this contract unless otherwise authorized by the Contracting Officer. The Contractor shall, at all times, take any and all steps necessary for maintenance and preservation of all

Government-furnished property. The Contractor shall comply with all reasonable requests of the Contracting Officer to enclose, or specifically protect, all Government and Government-furnished property. Any Government property disturbed or damaged by the Contractor shall be restored by the Contractor to pre-project condition.

C. Qualifications of Key Personnel - Contractor’s employees should be knowledgeable of standards associated with the scope of work.

D. Supervision/Communications - At all times during the performance, the Contractor’s

Superintendent shall be available by cellular phone. Prior to beginning any work, the

Contractor shall supply the COR with the telephone number for the Superintendent.

The Contractor’s “Competent Person” that meets OSHA training guidelines, is capable of making decisions and acting on behalf of the Contractor shall be physically located on site at all times during performance of the contract.

E. Security Requirements - Contractor shall identify which employees will be working under the awarded contract. Contractor personnel shall include employees, sub-contractors, subcontractor employees, suppliers and delivery personnel entering the

Medical Center. This does not apply to suppliers and delivery personnel making deliveries to the VA warehouse dock only. Those employees shall bring photo ID to obtain a VA Contractor identification badge that shall be worn above the belt at all times while on Medical Center property. Contractor’s employees shall return all I.D.

badges to designated personnel at time designated in the task order.

F. The COR is responsible for the inspection of the work called for in this job. The

Contracting Officer’s Representative will be identified in the task order by name, telephone number and location. Inspections made by the COR are for the sole benefit of the Government and do not relieve the Contractor of any quality control responsibilities.

G. The Safety Manger is responsible for safety inspections of all contract operations.

The Safety Manager will be identified in the task order by name, phone number and location.

H. Verification of Work - The Contractor shall visit the job site to thoroughly familiarize himself with all the details of the work and working conditions. The Contractor shall also verify all dimensions in the field and shall advise the Contracting Officer’s

Representative of any discrepancy before performing any work. The Contractor shall be specifically responsible for the coordination and proper relation of his work to the building, structure, phasing and ensure the safety of employees and workmen.

I. Smoking Policy - The Contractor shall not allow smoking in any building or on any

VA property. The Contractor shall ensure employees smoke only in designated outdoor areas.

J. Parking/Traffic Regulations - The Contractor shall not park in any areas without prior approval from the COR. In the event that the Contractor parks on VA property with prior authorization, the Contractor will be held responsible for all damages.

K. This contract does not involve VA sensitive information/data.

Bids providing less than 120 Calendar Days of Government Acceptance after the date bids are due will not be considered and will be rejected.

The bidder agrees to perform the work required at the prices specified below in strict accordance with the terms of the solicitation, if this bid is accepted by the Government in writing within 120 calendar days after the date bidders are due.

BASE BID: Upgrade the electrical circuits that feed the main kitchen located in building 200 at

Northport VA Medical Center as per Statement of Work (SOW), Specifications, and Drawings.

This upgrade will address (but not limited to) all deficiencies to comply with safety codes and improve kitchen efficiency.

A. ITEM I, GENERAL CONSTRUCTION: Work includes general construction, alterations, walks, grading, electrical equipment necessary for the upgrade of electrical circuits that feed the kitchen in building 200.

The work shall be performed, as shown for Project Number 632-19-112 Electrical Circuits

Upgrades - Kitchen Equipment located at Department of Veterans Affairs, Northport VA Medical

Center, Building 200, 79 Middleville Rd, Northport, NY 11768, in accordance with contract documents.

The contract completion time is 180 calendar days from receipt of Notice to Proceed.

INFORMATION REGARDING BIDDING MATERIAL, BID GUARANTEE

AND BONDS

(a) Bidding materials consisting of Invitation for Bids, drawings, specifications and contract forms will be available on https://beta.sam.gov/ in electronic format only by searching for solicitation number 36C24220B0040. All interested parties (subs & primes) should register at https://beta.sam.gov/ as an “Interested Vendor” so that others will know of our interest in participating in this procurement. A Bidder’s mailing list WILL NOT BE prepared by the Contract

Specialist. SOLICITATION AMENDMENTS: Amendments to the solicitation will be posted at https://beta.sam.gov/ Paper copies of the amendments will NOT be individually mailed. By registering to “Receive Notification”, you will be notified by e-mail of any new amendments that have been issued and posted. No other notification of amendments will be provided. Bidders are reminded that they are responsible for obtaining and acknowledging all amendments to this solicitation prior to the time for receipt of bids.

(b) If bid exceeds $150,000 a bid bond must be submitted. A bid guarantee is required in an amount not less than 20 percent of the bid price but shall not exceed $3,000,000. Failure to furnish the required bid guarantee in the proper form and amount, by the time set for opening of bids, will require rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.

(c) If the contract will exceed $150,000 (see FAR 28.102-1 for lesser amount), the bidder to whom award is made will be required to furnish two bonds, a Payment Bond, SF 25A, and a

Performance Bond, SF 25, each in the penal sum as noted in the General Conditions of the

Specification. Copies of SFs 25 and 25A may be obtained upon application to the issuing office.

(d) If the bid is between $30,000 - $150,000. The bidder to whom award is made will be required to furnish a Payment Bond, Standard Form 25A or alternative payment protection which conforms to the requirements set forth in FAR Clause 52.228-13, Alternative Payment

Protections, as noted in the General Conditions of this Specification. Copies of the Standard

Form of Payment Bond may be obtained upon application to the Issuing Office.

DESCRIPTION OF WORK: GENERAL CONSTRUCTION: The Contractor shall furnish all necessary professional Construction services to provide complete scope of work for project 632-

19-112, Upgrade the Electrical Circuits that feed the kitchen area, in accordance to the project drawings and specifications for the Northport VA Medical Center, Northport, NY.

Magnitude of Construction: $250,000.00 and $500,000.00

SECONDARY SITE OF THE WORK (MAY 2014)

(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.3 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO

ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION

(FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action

Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the

Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. (c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action

Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order

11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for

Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the—

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is

2.4 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—

CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material,"

"domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials"

(Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the

Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the

Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR

52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

2.6 52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury

Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds—

(1) To unsuccessful bidders as soon as practicable after the opening of bids; and

(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.

(c) The amount of the bid guarantee shall be percent of the bid price or , whichever is less.

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

RESOLUTION (OCT 2018)

(a) Any protest filed by an interested party shall—

(1) Include the name, address, fax number, email and telephone number of the protester;

(2) Identify the solicitation and/or contract number;

(3) Include an original signed by the protester or the protester’s representative and at least one copy;

(4) Set forth a detailed statement of the legal and factual grounds of the protest, including a description of resulting prejudice to the protester, and provide copies of relevant documents;

(a) Definitions. As used in this provision—

Covered telecommunications equipment or services, critical technology, and substantial or essential component have the meanings provided in clause 52.204–25, Prohibition on

Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after

August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.
