Pest Control Services VA San Francisco Health Care System
Section 1: General Information
1.1 General: This is a non-personal services contract to provide fully certified and California licensed pest control services for the VA San Francisco Health Care System (VASFHCS). The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government.
1.2 Period of Performance:

1.3 Place of Performance:

1.4 Hours of Operation: The contractor shall perform regular scheduled services Monday through Friday, between the hours of 7:00 a.m. to 3:30 p.m., excluding Federal holidays, unless prior authorization is given for vendor to arrive before or after normal working hours.
Federal Holidays: New Year’s Day, Martin Luther King Day, President’s Day, Memorial Day, Juneteenth Independence Day, Independence Day, Labor Day, Columbus Day, Veteran’s Day, Thanksgiving Day, Christmas Day, and any other day specifically declared by the President of the United States to be a federal holiday.
1.5 Invoicing: All invoices from the contractor shall be submitted electronically in accordance with VAAR Clause 852.232-72 Electronic Submission of Payment Requests.

Section 2: Tasks and Requirements:
2.1 Integrated Pest Management (IPM): Vendor will conduct services with an IPM approach, which is a decision-making process which considers cultural, biological, and chemical controls. Control mechanisms are selected as each situation warrants. Where chemical control is indicated, specific pest populations are targeted for treatment when they are most vulnerable rather than a general application. Using appropriate control measures and proper application, IPM can result in a reduction in the use of pesticides, which may adversely impact human health and the environment.
2.1.1 Contractor is to furnish all labor, equipment, supplies, supervision, personnel, and materials to provide pest control services at: Department of Veterans Health Care System San Francisco, 4150 Clement Street San Francisco, CA 94121
2.2 Contractor shall utilize pesticides that are of a low volatility and odor free in order to keep levels from affecting patients.
Note: No Pest Control Material shall be placed where they may be recovered by patients. No pest control materials shall be allowed to come in contact with food and/or cooking utensils.
2.3 The use of integrated pest management treatment options that do not impact patients, visitors, employees, facilities or the environment VHA DIRECTIVE 1850, 5.D
2.4 Contractor personnel are required to interrupt their work at any time so as not to interfere with normal functioning of the facilities, fire protection systems, passage of facility patients', personnel, equipment and/or carts.
2.5 The Contractor shall conform to all applicable Federal, State and local regulations governing examining and licensing of pest control operators, performance of pest control, use of approved pest control chemicals and equipment, which may be in effect in the area in which the work under the contract will be performed.
2.5.1 The pesticide, insecticide, baits, or traps used shall comply with regular local standards and it should be harmless to humans.
2.6 All contractor personnel must always have their name and the company’s name visible on their uniforms, so they are easily recognizable. Contractor personnel must have an approved Contractor Badge, issued by VA Police, visible at all times.
2.6.1. Personnel may be required to be escorted by a VA employee. Most areas will be accessible to the vendor without guidance, yet sensitive areas such as the Pharmacy, or certain odd jobs, may require surveillance.
2.6.2 In cases where the contractor has two or more persons reporting for work under the contract, one of these will be designated as a supervisor and must be fully certified in all categories of Pest Management in which work is to be performed.
2.6.3 A manager or supervisor from the service provider will meet with a representative of the COR, on a regular basis, to present program effectiveness. Provide periodic progress reports to the COR.
2.6.4 Service technicians must be certified by the California Department of Agriculture in the categories for the service being rendered.
2.7 Training programs must be designed, administered, and monitored for effectiveness.
2.8 On each visit, the applicator(s) shall report to the COR prior to performance on any work.
2.9 The Vendor shall not dispose of any excess pesticide containers, or any other materials contaminated by pesticides at any location on the VA premises.
2.10 The Vendor will ensure all safety requirements are followed when servicing the buildings. Prior to servicing the buildings, the contractor is required to submit Safety Data Sheet (SDS) for the pesticide, insecticides, and baits that will be used to the VA Safety Officer to review and approve.
2.11 Any safety related discrepancies or hazards noted by the contractor when servicing the building and perimeter areas should be corrected immediately and reported to the VA safety officer or COR to ensure that his/her employees take all necessary safety precautions regarding appropriate safety attire (masks, breathing apparatus, clothing, etc.) while performing the services under this contract.
2.12 Contractor shall ensure full compliance with all Federal EPA and OSHA rules and regulations, along with local Cal-OSHA rules and regulations, when applying pesticide and insecticides inside and/or outside the facility buildings.
2.12.1 If any of the chemicals spill on the ground/floor during application, the contractor will be responsible for immediate clean up at contractor's expense.
2.13 Storage of pest control materials: No pest control materials or equipment shall be stored or left at any VA Installation when the operator is not working.
Section 3: Call back requirement:
3.1 The Contractor shall within 24 hours after receipt of notification by the Contracting Officer or COR, and at no additional charge to the Government, retreat previously treated areas when inadequate control (as per specifications) was obtained.
3.2 Required contractor reporting:
3.2.1 The Contractor is responsible for supplying and completing and submitting all reports required or requested by Federal, State, or local ordinances, which pertain to, any work contained in the contract.
3.2.2 In addition to service application logs, specialized documentation will be required for certain services provided. Specific information relative to this additional documentation will be included under various services. All documentation will need to be maintained by the service provider.
3.1 The Contractor will be required to furnish the COR, prior to any application of pesticides, SDS and the trade names (if any) and chemical names of the chemicals used and a label showing the contents, the use strength of the chemical as applied and the antidote thereto.
3.2 Contractor will furnish SDS each time he changes chemicals or products used in the performance of this contract. This information is required by the VA Medical Service for emergency treatment in the event of ingestion of and/or contact with the material by humans.
3.3 Statement of conditions found, and treatment rendered:
Following each visit and inspection of a building, the Contractor shall leave a signed and dated notice in writing with the COR or his designee stating the conditions found existing and treatment rendered.

4.1 Vendor will be escorted while servicing the Outpatient Pharmacy and may require supervision when treating other sensitive areas during an Odd Job. Vendor is expected to be familiar with and autonomous when inspecting and treating the listed departments above.
Section 5: Odd Jobs Requirement
5.1 Outside of the regularly inspected/treated areas (listed above), vendor will be required to respond to ‘Odd Job’ pest concerns throughout the SFVAMC facility. An ‘Odd Job’ is defined as an area less than 500 square feet. An area found to be in excess of 500 square feet but less than 1000 square feet will be considered as TWO Odd Jobs.
5.1.1 Vendor will respond and inspect and/or treat Odd Jobs within SIX hours of notice.
5.1.2 Vendor will be expected to respond and inspect and/or treat 5 Odd Jobs per month. If the facility did not require 5 Odd Job inspections in a single month, excess Odd Job calls will carry over into the following month. For example; if only three Odd Jobs calls are made in July, August will be allotted 7 Odd Jobs calls. Odd Jobs will zero out at the end of the base year and at the end of subsequent option years.
5.1.3 If a requirement goes beyond the regularly inspected/treated areas and the Odd Jobs coverage, the vendor must send an estimate for the work within 12 hours of notice.
5.1.4 The Contractor shall, within 24 hours after receipt of notification by the Contracting Officer or COR, and at no additional charge to the Government, retreat previously treated areas when inadequate control (as per specifications) was obtained.
Section 6: Quality Assurance Surveillance Plan (QASP)
The Government shall use these standards to determine contractor performance and shall compare contractor performance to the Acceptable Quality Level (AQL). The COR will evaluate the services required to ensure compliance

Section 7: Services rendered include but are not limited to:
7.1 Rodent control – to include rats, mice, gophers, voles, and others.
7.2 Crawling insect control – to include ants, cockroaches, mites, bed bugs, silverfish, fleas, and others.
7.3 Flying insect control – to include gnats, flies, bees, wasps, termites, and others.
7.4 Specialized pest management applications for standard insecticides, rodenticides, termiticides, thermal fogging’s, cold fogging’s, avicides, herbicides and fumigants.
7.5 Service technicians must be certified by the California Department of Agriculture in the categories for the service being rendered.
7.6 Specific information relative to this additional documentation will be included under various services. All documentation will need to be maintained by the service provider.
7.7 No pesticides and/or equipment will be stored for future use on VA property.
7.8 All traps will be clearly identified with a self-adhesive sign place at the facility.
7.9 Rodent bait feeding stations will be deployed throughout the outside areas of the regularly inspected areas. Bait stations must be labeled in accordance with Federal and State laws and regulations.
7.10 All rodent feeding stations will be “secured” in a manner acceptable in the pest control industry.
7.11 A fresh supply of E.P.A. registered rodenticides and/or traps will be maintained in the rodent feeding stations.
7.12 All multiple catch traps will be placed according to the manufacturer recommendations.
7.13 All devices will be boldly numbered, and their placement depicted on a map of the facility. This map is to be a part of the customized Rodent Control Report which is to be submitted after each service. The report will document device by device, the activity found.
7.14 Each control device will be checked, emptied as needed, cleaned, rewound and/or re-bated during each service attached to each device will be a service date sticker which the technician will fill in at the time of each service.
7.15 All devices will be serviced a minimum of 1 time per month.
7.16 In the event of activity in any of the devices, the technician will determine whether to supplement the existing measures with additional controls. The technician will inspect the areas near the site of any pest activity to determine any surrounding infestation and any possible ways of entry.
7.17 Vendor is expected to provide all services and materials. If the vendor is not capable of providing a service or material for a specific requirement the vendor is required to subcontract the requirement out at no extra expense to the government.
7.18 Violation by a subcontractor of any provision set forth within this contract will be attributed to the Contractor.
Section 8: Regulations
8.1 Pest management operations shall meet all Federal requirements as identified in Public Law 92-516, Federal Insecticide, Fungicide and Rodenticide Act, dated November 28, 1975, as amended, and Executive Order 12088 (Federal Compliance with Pollution Control Standards) and appropriate Occupational Safety and Health standards regarding hazard communication, personal protective equipment, and exposure standards. The Contractor shall ensure pesticides and pest control operations are in compliance with California Code of Regulations (Title 3, Food and Agriculture), Division 6, Pesticides and Pest Control Operation.
Section 9: Record Keeping and Documentation
9.1 Contractor shall comply with all applicable records management laws and regulations, as well as National Archives and Records Administration (NARA) records policies, including but not limited to the Federal Records Act (44 U.S.C. chs. 21, 29, 31, 33), NARA regulations at 36 CFR Chapter XII Subchapter B, and those policies associated with the safeguarding of records covered by the Privacy Act of 1974 (5 U.S.C. 552a). These policies include the preservation of all records, regardless of form or characteristics, mode of transmission, or state of completion.
9.2 In accordance with 36 CFR 1222.32, all data created for Government use and delivered to, or falling under the legal control of, the Government are Federal records subject to the provisions of 44 U.S.C. chapters 21, 29, 31, and 33, the Freedom of Information Act (FOIA) (5 U.S.C. 552), as amended, and the Privacy Act of 1974 (5 U.S.C. 552a), as amended and must be managed and scheduled for disposition only as permitted by statute or regulation.
9.3. In accordance with 36 CFR 1222.32, Contractor shall maintain all records created for Government use or created in the course of performing the contract and/or delivered to, or under the legal control of the Government and must be managed in accordance with Federal law. Electronic records and associated metadata must be accompanied by sufficient technical documentation to permit understanding and use of the records and data.
9.4. Veteran Affairs and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Records may not be removed from the legal custody of Veteran Affairs or destroyed except for in accordance with the provisions of the agency records schedules and with the written concurrence of the Head of the Contracting Activity. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701.
In the event of any unlawful or accidental removal, defacing, alteration, or destruction of records, Contractor must report to Veteran Affairs. The agency must report promptly to NARA in accordance with 36 CFR 1230.
9.5. The Contractor shall immediately notify the appropriate Contracting Officer upon discovery of any inadvertent or unauthorized disclosures of information, data, documentary materials, records, or equipment. Disclosure of non-public information is limited to authorized personnel with a need-to-know as described in the [contract vehicle]. The Contractor shall ensure that the appropriate personnel, administrative, technical, and physical safeguards are established to ensure the security and confidentiality of this information, data, documentary material, records and/or equipment is properly protected. The Contractor shall not remove material from Government facilities or systems, or facilities or systems operated or maintained on the Government’s behalf, without the express written permission of the Head of the Contracting Activity. When information, data, documentary material, records and/or equipment is no longer required, it shall be returned to Veteran Affairs control or the Contractor must hold it until otherwise directed. Items returned to the Government shall be hand carried, mailed, emailed, or securely electronically transmitted to the Contracting Officer or address prescribed in the [contract vehicle]. Destruction of records is EXPRESSLY PROHIBITED unless in accordance with Paragraph (4).
9.6. The Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, contracts. The Contractor (and any sub-contractor) is required to abide by Government and Veteran Affairs guidance for protecting sensitive, proprietary information, classified, and controlled unclassified information.
9.7. The Contractor shall only use Government IT equipment for purposes specifically tied to or authorized by the contract and in accordance with Veteran Affairs policy.
9.8. The Contractor shall not create or maintain any records containing any non-public Veteran Affairs information that are not specifically tied to or authorized by the contract.
9.9. The Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected from public disclosure by an exemption to the Freedom of Information Act.
9.10. The Veteran Affairs owns the rights to all data and records produced as part of this contract. All deliverables under the contract are the property of the U.S.
Government for which Veteran Affairs shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. Any Contractor rights in the data or deliverables must be identified as required by FAR 52.227-11 through FAR 52.227-20.
Section 10: Contractor Contingency Plan
The Contractor shall have a contingency/back-up plan in the event the Contractor is unable to perform services or have services performed as required. The Contractor shall immediately notify the COR or designee and provide a justification for non-performance and institute the contingency and/or back-up plan as quickly as possible
Section 11: Storage of Pest Control Materials
No pest control materials or equipment shall be stored at any VA installation when the operator is not working.

C.2 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR
2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.
VHA Supplemental Contract Requirements for Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors
1. Contractor employees who work in or travel to VHA locations must comply with the following:
a. Documentation requirements:
1) If fully vaccinated, shall show proof of vaccination.
i. NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination.
2) If unvaccinated and granted a medical or religious exception, shall show negative COVID-19 test results dated within three calendar days prior to desired entry date.
Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor’s order or an FDA approved over-the-counter test.
3) Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel.
4) Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.
2. Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the COVID-19 Screening Tool. Check regularly for updates.
a. Contractor employees who work away from VA locations, but who will have direct contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance, each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.
3. Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities.

AND COMPLIANCE (JUL 2018)
(a) This solicitation includes the clause: 852.215-70 Service-disabled veteran-owned and veteran-owned small business evaluation factors. Accordingly, any contract resulting from this solicitation will include the clause 852.215-71 Evaluation factor commitments.
(b) The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) to assist in assessing Contractor compliance with the subcontracting commitments incorporated into the contract. To that end, the support contractor(s) may require access to the Contractor's business records or other proprietary data to review such business records regarding contract compliance with this requirement.
(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.
(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor compliance with the subcontracting commitments.

C.5 VAAR 852.223-71 SAFETY AND HEALTH (SEP 2019)
(a) To help ensure the protection of the life and health of all persons, and to help prevent damage to property, the Contractor shall comply with all Federal, State, and local laws and regulations applicable to the work being performed under this contract. These laws are implemented or enforced by the Environmental Protection Agency (EPA), Occupational Safety and Health Administration (OSHA) and other regulatory/enforcement agencies at the Federal, State, and local levels.
(1) Additionally, the Contractor shall comply with the following regulations when developing and implementing health and safety operating procedures and practices for both personnel and facilities involving the use or handling of hazardous materials and the conduct of research, development, or test projects:
(i) 29 CFR 1910.1030, Bloodborne pathogens; 29 CFR 1910.1450, Occupational exposure to hazardous chemicals in laboratories. These regulations are available at https://www.osha.gov/.
(ii) Nuclear Regulatory Commission Standards and Regulations, pursuant to the Energy Reorganization Act of 1974 (42 U.S.C. 5801 et seq.) Copies are available from the U.S. Nuclear Regulatory Commission, Washington, DC 20555-0001.
(2) The following Government guidelines are recommended for developing and implementing health and safety operating procedures and practices for both personnel and facilities:

(b)(1) The Contractor shall maintain an accurate record of, and promptly report to the Contracting Officer, all accidents or incidents resulting in the exposure of persons to toxic substances, hazardous materials; the injury or death of any person; or damage to property incidental to work performed under the contract resulting from toxic or hazardous materials and resulting in any or all violations for which the Contractor has been cited by any Federal, State or local regulatory/enforcement agency.
(2) The report shall include a copy of the notice of violation and the findings of any inquiry or inspection, and an analysis addressing the impact these violations may have on the work remaining to be performed. The report shall also state the required action(s), if any, to be taken to correct any violation(s) noted by the Federal, State, or local regulatory/enforcement agency and the time frame allowed by the agency to accomplish the necessary corrective action.
(c) If the Contractor fails or refuses to comply with the Federal, State or local regulatory/enforcement agency's directive(s) regarding any violation(s) and prescribed corrective action(s), the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action (as approved by the Federal, State, or local regulatory/enforcement agencies) has been taken and documented to the Contracting Officer.
No part of the time lost due to any such stop work order shall form the basis for a request for extension or costs or damages by the Contractor.
(d) The Contractor shall insert this clause in each subcontract involving toxic substances or hazardous materials. The Contractor is responsible for the compliance of its subcontractors with the provisions of this clause.
