JUSTIFICATION AND APPROVAL
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department
2. Description of the Action Being Approved
Award of a firm fixed priced contract on a sole source basis for critical software renewals to be used by the Naval Surface Warfare Center, Dahlgren Division (NSWCDD). The requiring office is manufactured by Real Time
Innovations (RTI).
3. Description of Supplies/Services
The software being acquired is as followed: RTI Connext DDS Secure Developer Subscription (PN:899-20-85-00-03); quantity of five (5) each, RTI Customer Target Library (CTL) Annual Maintenance (PN:535-50-00-00)on 5.3.1.22 RedHawk 6.5 x64 & x86 GCC 4.9.2, with a quantity of one (1) each, and 4.5d RedHawk 54.
X86 GCC 4.9.2; quantity of one (1) each, and 5.3.1.33 for RedHawk Linux 7.5.3 on x86 CTL; quantity of one (1) each, and Basic Support, User Subscription (PN: 869-20-00-00) with a quantity of one (1). This applies to the two option years prospectively.
Delivery is 30 days after receipt of order. The period of performance date of 1 September 2022 through 31 August 2023 (Base Year), 1 September 2023 through 31 August 2024 (Option Year 1), and 1 September 2024 through 31 August 2025 (Option Year 2) for continued coverage. The Government's minimum needs have been verified by the certifying technical and requirements personnel.
The estimated cost of the proposed contract action is for the base year, for option year one (1), and

for option year two (2), with an estimated overall total of . Fiscal Year (FY) 2022 Research, Development, Test, and Evaluation, Navy (RDT&EN) funds will be utilized for this procurement.
4. Statutory Authority Permitting Other Than Full and Open Competition
41 U.S.C. 1901 as implemented in FAR Subpart 13.5.
5. Rationale Justifying Use of Cited Statutory Authority
The RTI DDS software is the de facto standard track service must develop software with the associated licenses and libraries in order to The RTI CTLs for RedHawk are required in order for projects to develop and build software in the required RTI platform. The required software must be compatible in all aspects (form, fit, and function) with existing systems presently installed. Without these libraries for this required middleware software, tasks to integrate system development efforts could not continue. There would be no way for each system to communicate with each other ending all integration efforts. Awarding to another vendor other than RTI, would require changing to a new platform. This would result in a substantial duplication of costs in excess of $750,000.00 and a minimum of two (2) months downtime to the government that is not expected to be recovered through competition.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research has not identified any other vendors who can meet the Government’s requirements. Additional market research through contacting the software publisher continues to show there are no authorized resellers for this software. Since the initial purchase, licenses have been renewed from RTI, purchasing/renewing licenses through RTI ensures communication and integration between systems. It has been determined that no other manufacturer’s software will provide the current capabilities or meet the Government’s minimum requirements.
The proposed contract was synopsized on SAM.GOV website on 30 June 2022 and there were four quotes received however, only RTI, which is the manufacturer and only authorized seller, will be considered for this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than RTI to provide the required software support.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, Dahlgren Contract Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
