FOR PACKAGING, TRANSPORTATION AND
DISPOSAL OF HAZARDOUS WASTE

1. INTRODUCTION
The mission of the National Institute of Allergy and Infectious Diseases (NIAID) is to conduct and support basic and applied research to better understand, treat, and ultimately prevent infectious, immunologic, and allergic diseases.
This is a non-personnel services contract to provide packaging, transportation and disposal of chemical waste materials from Rocky Mountain Laboratories (RML). RML is a federal biological research facility operated by the National Institutes of Health in Hamilton, MT. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
2. BACKGROUND
Currently, RML is registered with the State of Montana as a Small Quantity Hazardous Waste Generator. For reference, during 2014 RML generated approximately 4,000 pounds of hazardous waste. All of which was shipped off-site to licensed disposal facilities. The wastes to be disposed are primarily spent chemicals generated during biological research and building maintenance operations. The waste will not contain biological or radioactive materials.
Discrete chemical wastes streams generated by RML's biomedical research activities tend to be small in volume and often contain exotic chemical compounds and complex mixtures. RML laboratories and support activities annually generate approximately 600 to 700 containers of non-biological/non-radioactive solid and liquid waste, usually ranging in volume from five milliliters to twenty liters. Approximately 800 Liters (213 gallons) of chemical wastes are collected annually in satellite containers ranging in size from 1 gallon to 5 gallons, as well as approximately 760 liters (202) gallons of xylene waste collected in 55 gallon drums.
3. SCOPE
The scope of this effort includes services necessary to provide packaging, transportation, and disposal of chemical waste materials from RML to a federally approved hazardous waste disposal site(s). The selected Contractor will provide all qualified personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to package, transport and dispose of chemical waste materials in accordance with applicable U.S. Environmental Protection

Agency (EPA), Occupational Safety & Health Administration (OSHA) and Department of Transportation (DOT) rules and regulations.
4. PERIOD OF PERFORMANCE
The period of performance for this requirement is date of award for a period of one (1) year thereafter, hereto referred to as the Base Year. This effort includes four (4) option years, which may be unilaterally exercised by the Government. Each option year shall not exceed one year in duration. The presence of Option Years does not obligate the Government to exercise the Option Year(s). All terms and conditions applicable to the base period shall extend to the option unless otherwise agreed upon. The option year is subject to the availability of funds. Estimated dates:
Base Year: April 1, 2016 to March 31, 2017 Option Year 1: April 1, 2017 to March 31, 2018 Option Year 2: April 1, 2018 to March 31, 2019 Option Year 3: April 1, 2019 to March 31, 2020 Option Year 4: April 1, 2020 to March 31, 2021
5. REQUIREMENTS
The contractor must have demonstrated corporate experience, qualified personnel, and applicable licenses to meet the following requirements.
5.1. It is the responsibility of the contractor to insure that ALL OSHA regulations applying to this work are adhered to at all times.
5.2. All Contractor personnel who have any responsibility for handling, packaging, manifesting, or transporting hazardous wastes must be properly trained in accordance with all applicable regulatory requirements including OSHA requirements in accordance with 29 Code of Federal Regulations (CFR) 1910.120, DOT requirements in accordance with 49 CFR 172.704; and RCRA requirements in accordance with 40 CFR 264.16.
5.3. Any facility used to dispose of the RML hazardous waste must be EPA permitted to accept and dispose of the material at their facility.
5.4. RML waste shall not be deep well injected.
5.5. While performing work under this contract, the Contractor shall comply with all applicable federal, State and locals laws, regulations, executive orders, Packaging, Transportation and Disposal of Hazardous Waste resolutions, operating permits and licenses governing the management and transportation of hazardous wastes including but not limited to the following:

5.6. The Contractor shall ensure that all vehicles used to transport RML wastes have all the all required stickers, permits and licenses required by federal, state and local regulatory authorities for the transportation of hazardous materials in commerce.
6. SPECIFIC TASKS
6.1. PICKUP AND TRANSPORTATION
6.1.1. Pickup waste at least once every 6 months within 30 days of request made by the designated government representative, regardless of volume or type of waste to be collected.
6.1.2. RML wastes under the control of the Contractor shall be properly secured at all times.
6.1.3. The Contractor shall provide the 24 hour emergency phone number required by 49 CFR 172.604 and provide coverage of the number during periods when RML waste shipments are in transit to treatment, storage, and disposal facilities (TSDFs).
6.2. DOCUMENTATION
6.2.1. The contractor must provide certificates of treatment, destruction, or
Packaging, Transportation and Disposal of Hazardous Waste recycling, accounting for every container manifested from the RML. These documents must indicate the date, location, and tracking number for each shipped container.
6.2.2. The Contractor shall use the Uniform Hazardous Waste Manifest (EPA Form 8700-22) in accordance with EPA and State regulations. No later than 24 hours prior to a planned shipment of wastes, the Contractor shall deliver a complete set of shipping documents, including the land disposal restrictions (LDR) forms, to the Project Officer for review. The Project Officer or designee will be available for signing manifests and other required shipping documents on the day of shipment during core business hours (Monday-Friday 8 a.m. – 5 p.m., except on holidays).
6.2.3. Container Contents Sheets: The Contractor shall prepare a container contents sheet (CCS) for each container, lab pack and bulk, in the waste shipment. The Contractor shall submit completed forms to the Project Officer for review and signature along with the hazardous waste manifest.
The signed original of these forms shall accompany the shipment and copies submitted to the COR.
6.2.4. The Contractor shall provide DOT emergency response guide information in accordance with 49 CFR 172.602.
6.3. DISPOSAL
6.3.1. The Contractor, in good faith, shall maximize the use of permitted disposal options that result in the recycling or beneficial reuse of RML waste. The Contractor shall use domestic treatment facilities that employ permitted, best available technologies to permanently destroy or render the RML waste non-hazardous.
6.3.2. Land disposal of RML wastes is not permissible. The Contractor shall prepare in accordance with 40 CFR 268.7, notification and certification forms, land disposal restrictions for all shipments of hazardous wastes.
6.4. HANDLING
6.4.1. Shipment Discrepancies: The Contractor shall notify the Project Officer immediately if a discrepancy occurs with a waste shipment and shall work with the TSDF and Project Officer to resolve any issues. The proper manifest corrections shall be made on generator and facility copies of the
Packaging, Transportation and Disposal of Hazardous Waste manifest if both parties fully agree with the changes. When discrepancies cannot be corrected on all manifest copies, the Contractor shall prepare manifest discrepancy letters for the review and signature of the Project Officer. The Contractor shall ensure that the return copy of all manifests are delivered to the Project Officer within the regulatory required time frame otherwise an exception report will have to be prepared and submitted to the appropriate regulatory authority. §264.72 Manifest discrepancies. (c) Upon discovering a significant difference in quantity or type, the owner or operator must attempt to reconcile the discrepancy with the waste generator or transporter (e.g., with telephone conversations). If the discrepancy is not resolved within 15 days after receiving the waste, the owner or operator must immediately submit to the Regional Administrator a letter describing the discrepancy and attempts to reconcile it, and a copy of the manifest or shipping paper at issue.
6.4.2. All spills or releases shall immediately be reported to the Contracting
Officer’s Representative (COR).
6.4.3. Spills or releases resulting from Contractor negligence: The Contractor shall provide, at no cost to the Government, all labor, materials and services for clean-up of all releases (as defined in 40 CFR 302.3) and spills of hazardous wastes due to the negligence of the Contractor, from the point of pick-up to the point of final treatment, storage, recycling or disposal.
The clean-up of spilled or released wastes or materials shall be performed in compliance with all applicable regulations and to the maximum extent possible to return the contaminated area to its original condition prior to the spill or release.
7. WASTE DESCRIPTION AND COST PROPOSAL CALCULATIONS
1. Units of Measure for Payment and Verification of Quantities
All documentation of waste shipping, processing and reporting the final disposition of wastes shall be in metric units of mass (kilograms) unless otherwise specified. Wastes may be billed or invoiced in non-metric units such as pounds or gallons (U.S.).

Price must include all handling, manifesting, labeling, transportation, disposal costs, access fees, surcharges, insurance, taxes, etc.
2. Bulking and Consolidating Wastes The RML will offer liquid waste streams in satellite waste containers ranging in size from 1 gallon to 5 gallons. The Contractor shall bulk (consolidate) compatible liquid wastes from multiple containers into a larger container(s) of appropriate size and type. The purpose of waste consolidation is to reduce the number of containers requiring storage or shipment for off- site disposal. Vendor will bulk, consolidate and dispose these wastes according to Price Schedules G-1.
In accordance with Price Schedule G-1, Contractor agrees to provide the following services regarding waste from RML:
(a) Consolidate, remove and dispose of non-halogenated, flammable, toxic liquid wastes. These wastes will include some, but not all of the following flammable or combustible chemical: acetone, benzene, cyclohexane, dioxane, MEK, ethanol, ethyl ether, toluene, hexanes, heptane, propanol, methanol, xylene, styrene, pentanes, formaldehyde, tetrahydrofuran, nitrobenzene, isoprene, other alcohols, ketones, and esters.
(b) Consolidate, remove and dispose of halogenated, flammable, toxic liquid wastes. These wastes will include some, but not all of the following chemicals: chloroform, methylene chloride or any compound containing fluorine, chlorine, bromine, and iodine elements of Group VllA as indicated on the Periodic Table of Elements.
(c) Consolidate, remove and dispose of corrosive liquid wastes. These wastes will include some, but not all of the following chemicals: nitric acid, formic acid, trichloroacetic acid, chromic acid, hydrofluoric acid, triflouracetic acid, and phenolic acid.
(d) Consolidate, remove and dispose of multi-component, non-halogenated, toxic liquid waste mixed with some organics. These wastes will include but not be limited to the following chemicals: 2-mercaptoethanol, silver nitrate, tris(hydroxyethyl) aminomethane (aka Tris Buffer), guanidine hydrochloride, formaldehyde, and paraformaldehyde.
(e) Remove and dispose of waste oil-based paint material.
(f) Remove and dispose of 55 gallon drums of xylene waste and provide replacement 55 gallon drums accordingly.
(g) Remove and dispose of 55 gallon drum containing crushed mercury bulbs and provide replacement 55 gallon drum.
3. Lab/Commodity Pack Services

The RML will offer solid and liquid waste streams in either original or disposable containers of appropriate size for lab packaging. Individual containers will range from five milliliters to 4 Liters in capacity. Vendor will be responsible for Lab Pack services in DOT specification containers with vermiculite absorbent packaging according to Price Schedule G-2. Wastes shall include all hazard classes and divisions except for Class 1 and Class 7.
RML generates numerous types of chemical wastes that are contained either in the original container or a container of appropriate size for the amount of chemical present. An inventory of all wastes generated at RML to date for calendar year 2015 will be provided to quoters upon request.
The Contractor agrees to provide lab/commodity pack services, removal and disposal services in accordance with Price Schedule -2.
4. Wastes requiring special processing.
In accordance with Price Schedule G-3, Contractor agrees to provide the following services regarding waste from RML:
a) Remove and dispose of dangerous goods including:
• Shock-sensitive chemicals classified as peroxides, nitro compounds, & picrates.
• Potentially explosive chemicals such as picric acid, perchloric acids, ethers, vinylidene, chloride, sodium azide, soda azide, potassium metal, cyclopentene, or cyclohexene.
• Water-reactive chemicals such as phosphorous pentoxide, alkali metals, halides of nonmetals, or inorganic Acids.
The following figures are estimated annual quantities based on historic shipments. Shipments are made at least twice every calendar quarter. The pricing must include all charges for the services stated in the proposal specification (transportation, etc.).
The total annual price shall provide the basis for ranking the total cost portion in Section G. Totals · indicated are only given as a guideline for preparing your proposal and should not be construed as representing dollars under the resulting contract. There will be no penalty for not attaining said amount.

7.1. USE OF PREMISES – Contractor shall limit use of premises to work in RML's hazardous waste accumulation area (aka RML Hazardous Waste Shed). Contractor shall not disturb portions of site beyond areas in which the work is indicated and confine operations to the areas immediately adjacent to the RML Hazardous Waste Building.
4. SECURITY – All contractors, suppliers and vendors are subject to search upon entering the RML facility. This includes vehicles, packages, boxes, etc. Upon issuance of this contract the following security procedures shall apply to the Contractor and all subcontractors:
1. Contractor personnel shall not enter the NIH Campus without appropriate badge.
2. Identification will be required for all personnel.
3. An RML visitor badge must be worn in plain view while on the RML grounds.
4. Visitors will be escorted while on site.
5. All vehicles must be met at the perimeter contractor gate by authorized
RML personnel and be escorted to the work site.
6. All storage units and the inside of vehicles are subject to inspection.
8. GLOSSARY
Commodity Pack: a container holding similar type materials such as paints, inks, pharmaceutical to be managed in a cubic yard box.
Container: any portable device in which a material is stored, transported, treated, disposed of, or otherwise handled.
EPA/State identification number: the number assigned by EPA or by an authorized State to each generator, transporter, and TSDF.
Fuel Blending: wastes that are blended with other waste or non-waste materials to produce a waste fuel that will meet specifications for a particular burner.
Generator: any person, by site, whose act or process produces dangerous waste or whose act first causes a dangerous waste to be subject to regulation.
Incinerator: an enclosed device using controlled flame combustion that neither meets the criteria for classification as a boiler nor is listed as an industrial furnace.
Incineration: units operated in accordance with the technical operating requirements of 40 CFR part 264 subpart 0 and part 265 subpart 0.
Lab pack: as describes by 49CFR.173.12, a "Lab Pack" refers to small quantities of laboratory waste or laboratory like waste, which are securely packed in an outer container and have a detailed chemical inventory.
Landfill: a disposal facility where waste is placed in or on land. Landfill ban restrictions apply.
Manifest: the shipping document EPA form no. 8700-22 and if necessary EPA form 8700-22A, originated and signed by the generator in accordance with the instructions included in the Appendix to 40 CFR part 262.
Neutralization: using the following chemical reagents or combination of reagents: (1) acids, (2) bases, or (3) water resulting in a pH greater than 2 but less than 12.5 as measured in the aqueous residuals.
Reclamation: the process to recover a usable product(s) or to regenerate the material(s).
Retort: roasting in a thermal processing unit capable of volatilizing mercury and subsequently condensing the volatilized mercury for recovery.
TSDF: a Treatment, Storage and/or Disposal Facility, a facility, including all contiguous land, and structures, other appurtenances, and improvements on the land, which is used for recycling, reusing, reclaiming, transferring, treating, storing and other waste management methods as described in this document.
Sludge: a waste that contains a solid or semi-solid phase that cannot be pumped from its original container through a mesh screen at a specific rate.
Transfer facility: any transportation related facility including loading docks, parking areas, storage areas and other similar areas where shipments of waste are held during the normal course of transportation.
Transportation: the movement of waste by air, rail, highway, or water.
Transporter: a person engaged in the off-site transportation of waste by air, rail, highway or water.
Treatment: any method, technique, or process, including neutralization, designed to change the physical, chemical, or biological character or composition of any waste so as to neutralize such waste, or so as to recover energy or material resources from the waste, or so as to render such waste non-hazardous or less hazardous; safer to transport, store or dispose of; or amenable for recovery, amenable for storage, or reduced in volume.
