Amendment 1: Question and Answer

Question 1:
The bid documents cite a small business size standard of 500 employees, but goes on to say: “The requirement is being competed as full and open competition.”
In the FAR 52.212-5 attachment, the following clauses are selected:
_X_ (13) 52.219-4, Notice of Price Evaluation Preference for HUBZone Small Business Concerns (Oct 2022) (if the offeror elects to waive the preference, it shall so indicate in its offer) ( 15 U.S.C. 657a).
_X_ (17) 52.219-8, Utilization of Small Business Concerns (Oct 2022) ( 15 U.S.C. 637(d)(2) and (3)).
_X_ (23) (i) 52.219-28, Post Award Small Business Program Representation
Can you please clarify?
Answer 1:
The requirement is being competed via full and open competition. The applicable NAICS code, 333998, has a small business size standard of 500 employees. The three clauses above are required for acquisitions conducted using full and open competition, when the total contract value exceeds the simplified acquisition threshold, and in contracts exceeding the micro-purchase threshold when the contract is for supplies to be delivered or services to be performed in the United States or its outlying areas, respectively.
