NIEHS – RFQ 4607263 – Biological Safety Cabinets and Clean Benches Support

PART 1 – GENERAL INFORMATION

This is a Combined Synopsis/Solicitation for Commercial Items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice and in conjunction with FAR Part 13. This Request for Quotation (RFQ) announcement constitutes the only solicitation that will be issued; quotes are being requested and a written solicitation will not be issued.

This requirement is being solicited as a 100% Small Business Set-Aside and the Government contemplates a Firm-Fixed Price Purchase Order will result from this RFQ. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95.

The associated North American Industrial Classification System (NAICS) code for this procurement is 811219 “Other Electronic and Precision Equipment Repair and Maintenance”. Its associated Small Business Size Standard is $20.5 Million.

PART 2 – SUPPLIES OR SERVICES AND PRICES

Description of Supplies or Services

The National Institute of Environmental Health Sciences (NIEHS) requires a non-personal services contract for Biological Safety Cabinets Support to include certification, testing, decontamination, repairs, and parts. This acquisition is in support of NIEHS’ Health and Safety Branch (HSB) (see Attachment 1 for current BSC Inventory). Note, this inventory will change as equipment comes on line and older equipment is removed and taken out of service.

PART 3 – DESCRIPTION/SPECIFICATION

Statement of Work

1. Background

The National Institute of Environmental Health Sciences (NIEHS), located in the Research Triangle Park, North Carolina, is one (1) of the 27 Institutes and Centers composing the National Institutes of Health.

The NIEHS as its primary function: conducts, fosters and coordinates research on the biological effects of chemical substances and physical factors present in the environment. The Health and Safety Branch (HSB) which is part of the Office of Management (OM), is responsible for health and safety programs and protecting personal property at the NIEHS. Among those safety programs is biological safety which includes oversight and maintenance of biological safety cabinets and laminar flow clean benches.

2. Scope

The contractor shall provide services and repairs as described herein to ensure that optimum operation and efficiency of the equipment is maintained and that proper functioning of the equipment conforms to the Original Equipment Manufacturer (OEM) standard specifications. Services shall include labor, parts, materials, travel, personnel, and tools necessary to conduct certifications, testing, decontamination, and repairs in accordance with applicable standard or specifications for the equipment.

2.1 Services shall be performed on the identified equipment during normal working hours, unless otherwise specified. Normal working hours are 8:00am – 5:00pm Monday through Friday (Eastern Time), except national holidays. Arrangements must be made ahead of time for any work to be accomplished before or after normal working hours.

3. Performance Requirements

The Contractor shall provide the following services:

3.1 Certification and Testing of Biological Safety Cabinets (BSCs)

The Contractor shall complete certifications in accordance with the test procedures specified by the National Sanitation Foundation Standard Number 49 (NSF-49) for Class II (Laminar Flow) Biosafety Cabinetry (current edition). For any unit not covered by the NSF-49 standard, operational testing shall be in accordance with the manufacturers specifications. The BSS will set the schedule for certifications, testing, and regular maintenance.

3.2 Testing of Filters on Laminar Flow Clean Benches

The contractor shall provide annual testing of the filter in laminar flow clean benches. Annual checks of the filters of laminar flow clean benches shall consist of the filters being challenged with an appropriate aerosol. If the aerosol penetration exceeds the 0.01 percent or the manufacturers specifications and the filter cannot be repaired, then it will be replaced. The BSS will set the schedule for testing.

3.3 Decontamination of BSC by ClO2

The Contactor shall decontaminate biological safety cabinets that need any of the following: changing of filters, repair/maintenance of a unit, relocating a unit, or excessing a unit. Decontamination shall be accomplished using chlorine dioxide (ClO2) procedure as specified by National Sanitation Foundation Standard Number 49 (NSF-49) for Class II (Laminar Flow) Biosafety Cabinetry (current edition). The Contractor shall be responsible for posting a “DO NOT ENTER” sign on the laboratory door during the procedure and removal of the sign upon completion of the procedure. The Contractor shall be responsible for cleanup of any materials used in the decontamination process. The Contractor will be notified by the COR when cabinets require decontamination.

3.4 Emergency Response Calls and Repairs

The Contractor will be notified by the COR for emergency response and repair calls. The Contractor shall respond within three (3) business days after being notified by the COR or BSS of an emergency response call or repair. The Contractor shall perform all repairs as required to restore equipment to optimum operating performance and in accordance with the manufacturers specifications or NIEHS standards.

Repair requirements shall not be accumulated or backlogged. Each repair accomplished shall be a complete repair. Temporary repairs will not be allowed unless specifically approved by the COR in advance. Clear justification for temporary repairs must be provided in writing and accepted by the COR to obtain approval.

3.5 Replacement Parts and Supplies

Any repair parts or supplies required for the completion of repairs must receive approval by the COR.

Prices are to be quoted “at cost” to NIEHS in advanced of purchase. The contractor shall use original equipment manufacturer parts (OEM) for repairs. Repair parts used by the Contractor shall be warranted for one year. Where possible, the Contractor shall submit warranty paperwork to cover the cost of failures/repairs for items under the manufacturer’s warranty. Prices are to be consistent with current published catalog pricing less any discounts routinely offered to the Government. NIEHS reserves the option to supply parts as required if the COR determines that alternate sources would be more economical or expedient.

Parts furnished and workmanship performed by the Contractor shall be of a high quality and acceptable to the Government. The Contractor shall immediately rectify unacceptable work at no cost to the Government.

3.6 Service Reports

The Contractor shall provide a report stating the summary of services (certification, tests, decontamination, repairs, etc.) and shall be submitted to the BSS or COR within five (5) business days of service for any equipment serviced. The report shall be in a standard written format for each piece of equipment with that equipment identified by manufacturer’s model and serial number along with the NIEHS room location and date of service. Reports shall include a listing of any repair parts used during the service. Additionally, the report shall identify the printed name of the technician making the repair, the start date and time of the repair, the completion date and time of repair, the signature of the Contractor's service technician who made the repair, and the signature of the BSS or COR verifying that the equipment is repaired and operational.

4. General Work Performance and Requirements

The Contractor shall clean the area of work of any contract effort. This clean up shall include disposal of empty containers, packing materials and debris. Components and hardware shall be removed or otherwise disposed of. Spills shall be removed and the surfaces cleaned. The Contractor shall not create or allow existing any safety or fire hazard. Non-burnable material must be removed from the Institute by the Contractor. The COR may instruct disposal of the metal parts and components or other items as required. The Contractor shall comply with hazardous waste disposal requirements. The areas shall be left in clean and orderly condition, free of any foreign material generated by the service or repair activities upon completion of each service. Used filters will be removed from their housings, placed in boxes or PVC bags, and delivered to the NIEHS construction dumpster (usually located on E loading dock) or other location designated by the BSS. Any worn or replaced parts shall be disposed of per the instructions of the BSS using NIEHS on site recycling to the extent possible.

4.1 Services not covered by this contract shall not be performed without first obtaining permission of the Contracting Officer. Charges resulting from additional work performed without prior approval will not be honored. Any variation of work time shall be requested to and approved by the Contracting Officer’s Representative in advance. Before work is started, the Contractor shall confer with the COR to arrange a work schedule satisfactory to both the Contractor and the Government.

The Contractor shall comply with NIH and NIEHS regulations incorporated herein governing the occupied premises and shall perform the Contract in such a manner as not to interrupt or interfere with the conduct of Government business. The Contractor shall adhere to parking rules and regulations governing the use of the premises.

4.2 Personnel

Contractors shall be equipped with the necessary tools, equipment, and Personal Protective Equipment (PPE) to perform the work safely, effectively, and timely. Tools, equipment, and PPE shall comply with the requirements of OSHA Standard 29 CFR 1910, Subpart I, and NFPA 70E. For decontamination procedures, all personnel within the room where the decontamination is taking place shall wear appropriate respiratory protection.

4.2.1 Qualifications

The Contractor shall provide sufficient numbers of qualified personnel necessary for the performance of the tasks to be performed within the scope of work of this contract. Personnel shall be certified as part of the NSF/ANSI 49: Biosafety Cabinetry Certification Accreditation Program. Personnel must have successfully completed both written and practical examinations demonstrating the ability to perform the tests listed in annex F of NSF 49. A copy of their current certificates shall be provided to the BSS. All certificates must remain current for the duration of the contract. Copies of current certificates must be included with response to this RFQ.

The technical personnel proposed to perform on this contract shall be trained and experienced with demonstrated ability to certify, service and maintain the types of biological safety cabinets and laminar flow clean benches listed in Attachment 1 and the preparation of resulting certification, maintenance, and service reports.

4.3 Sign In and Sign Out

The Contractor shall require assigned personnel to sign in on arrival at NIEHS and sign out when departing NIEHS. Personnel shall sign in and out personally. The location for signing in and out is in Building 101, The Rall Building, the first floor of Module B, South Campus. Parking for the Contractor's personnel shall be in accordance with the NIEHS policies, unless instructed otherwise by the COR.

4.4 Identification Badges

Each Contractor working at NIEHS shall wear an easily readable identification badge, prominently displayed, which shall include the person's name and the Contractor's name. Initially, contractor will be signed in and escorted by ARS personnel. If the same or routine contractor technician is to be used, then required paperwork can be submitted to NIEHS security so that background information can be checked. If approved, a contractor badge will be issued to allow unescorted entry by technician.

4.5 List of Contacts

The Contractor shall provide the COR, at the time of contract award, pertinent contact information to call for required services and repairs. This information shall be updated as necessary by the Contractor so as to be current and accurate at all times.

The Contracting Officer’s Representative (COR) will perform inspection and acceptance of equipment, installation, and services to be provided.

PART 6 – DELIVERIES OR PERFORMANCE

Place of Performance:

All cabinets and clean benches are located on the main campus of NIEHS, 111 T. W. Alexander Drive, Research Triangle Park, NC 27709, services will be performed at this location.

Period of Performance

The period of performance is for 12-month base period, (September 23, 2017 – September 22, 2018) with four (4) 12- month option periods.

PART 7 – CONTRACT ADMINISTRATION DATA

The following personnel will represent the Government for the purpose of this contract:

1. The COR is responsible for: (1) monitoring the Contractor's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the Statement of Work and any other technical performance requirements;

(3) performing technical evaluation as required; (4) performing technical inspections and acceptances required by this contract; and (5) assisting in the resolution of technical problems encountered during performance.

The Contracting Officer is the only person with authority to act as agent of the Government under this contract. Only the Contracting Officer has authority to: (1) direct or negotiate any changes in the RFQ;

(2) modify or extend the period of performance; (3) change the delivery schedule; (4) authorize reimbursement to the Contractor any costs incurred during the performance of this contract; or (5) otherwise change any terms and conditions of this contract.

The Contractor shall follow the attached instructions and submission procedures specified below to meet the requirements of a "proper invoice" pursuant to FAR Subpart 32.9, Prompt Payment.

1. Payment requests shall be submitted to the offices identified below. Do not submit supporting documentation (e.g., receipts, time sheets, vendor invoices, etc.) with your payment request unless specified elsewhere in the contract or requested by the Contracting Officer.

a. The original invoice shall be submitted to the following designated billing office:

The Contractor shall submit an electronic copy of the payment request to the approving official instead of a paper copy. The payment request shall be transmitted as an attachment via e-mail to the address listed above in one of the following formats: MSWord, MS Excel, or Adobe Portable Document Format (PDF). Only one payment request shall be submitted per e-mail and the subject line of the e-mail shall include the Contractor's name, contract number, and unique invoice number.

Note: The original payment request must still be submitted in hard copy and mailed to the designated billing office to meet the requirements of a "proper invoice."

2. In addition to the requirements specified in FAR 32.905 for a proper invoice, the Contractor shall include the following information on the face page of all payment requests:

a. Name of the Office of Acquisitions. The Office of Acquisitions for this contract is

NIEHS.

b. Central Point of Distribution. For the purpose of this contract, the Central Point of Distribution is NIEHS_OA_Invoices-BranchC@mail.nih.gov.

c. Federal Taxpayer Identification Number (TIN). If the Contractor does not have a valid TIN, it shall identify the Vendor Identification Number (VIN) on the payment request. The VIN is the number that appears after the Contractor's name on the face page of the contract.

[Note: A VIN is assigned to new contracts awarded on or after June 4, 2007, and any existing contract modified to include the VIN number.] If the Contractor has neither a TIN, DUNS, or VIN, contact the Contracting Officer.

d. DUNS or DUNS+4 Number. The DUNS number must identify the Contractor's name and address exactly as stated in the contract and as registered in the Central Contractor Registration (CCR) database. If the Contractor does not have a valid DUNS number, it shall identify the Vendor Identification Number (VIN) on the payment request. The VIN is the number that appears after the Contractor's name on the face page of the contract. e. Invoice Matching Option. This contract requires a three-way match.

f. Unique Invoice Number. Each payment request must be identified by a unique invoice number, which can only be used one time regardless of the number of contracts or orders held by an organization.

Addenda to 52.212-4

1. Stop Work Order, FAR 52.242-12 (Aug 1989)

(a) The Contracting Officer may, at any time, by written order to the Contractor, require the Contractor to stop all, or any part, of the work called for by this contract for a period of 90 days after the order is delivered to the Contractor, and for any further period to which the parties may agree. The order shall be specifically identified as a stop-work order issued under this clause. Upon receipt of the order, the Contractor shall immediately comply with its terms and take all reasonable steps to minimize the incurrence of costs allocable to the work covered by the order during the period of work stoppage. Within a period of 90 days after a stop-work is delivered to the Contractor, or within any extension of that period to which the parties shall have agreed, the Contracting Officer shall either --

(1) Cancel the stop-work order; or

(2) Terminate the work covered by the order as provided in the Default, or the Termination for Convenience of the Government, clause of this contract.

(b) If a stop-work order issued under this clause is canceled or the period of the order or any extension thereof expires, the Contractor shall resume work. (d) If a stop-work order is not canceled and the work covered by the order is terminated for default, the Contracting Officer shall allow, by equitable adjustment or otherwise, reasonable costs resulting from the stop-work order.

Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.

As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

52.219-8, Utilization of Small Business Concerns (Oct 2014) (15 U.S.C. 637(d) (2) and (3)), in all subcontracts that offer further subcontracting opportunities.
