Requisition Number: Version 1.0 Page 1 of 7
FEDERAL BUREAU OF INVESTIGATION
FINANCE DIVISION | PROCUREMENT
SECTION
JUSTIFICATION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH
41 USC 3304 (a)(1)
Requisition Number:
Date: June 2, 2016 Estimated Contract Dollar Value:
1. Identification of the agency and contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation (FBI), Science and Technology Contracting Unit (STCU) has prepared this “brand name” justification for other than full and open competition for Milestone XProtect Licenses’ on behalf of the Video Surveillance Unit (VSU), Operational Technology Division (OTD).
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
The type of action being approved is a “brand name” justification that will result in a firm fixed price contract for the procurement of upgraded Milestone XProtect Corporate Licenses’ along with on-site training sessions in support of Video Evidence Collection to meet new field requirements.
3. A description of the “brand name” supplies or services required to meet the agency’s needs.
VSU currently has Milestone XProtect Enterprise software installed onto standalone recorder platforms in a rack configuration and is used on a case by case basis.
. The VSU is taking the necessary steps to expand the FBI’s video collections capabilities by designing an enterprise level system that will greatly increase the efficiency of video collection and dissemination throughout the FBI.
Centralized analytic, monitoring and recording capabilities are paramount to providing actionable data across the Enterprise entities where timely responses are inherent to successful joint operations.
Requisition Number: Version 1.0 Page 2 of 7
The Milestone XProtect Enterprise software currently in use by the field is deficient in respect to a true enterprise component and does not meet the requirements identified by the VSU for its Enterprise Initiative. The VSU has tested Milestone’s true enterprise level software suite named XProtect Corporate. The evaluation of Milestone XProtect Corporate by the VSU has proven that it provides all the necessary features required by the enterprise solution under development.
VSU own the license for the Milestone XProtect Enterprise 8.5 and 5378 Device License Keys (DLK). What will be expiring in January of 2017 is the Product Maintenance Agreement (PMA) for the licenses. This means that VSU will lose support of these licenses unless a new PMA is purchased. This procurement of Corporate is basically an upgrade with discounted pricing for the core software and all associated licensing/support. The discount is based on the fact the VSU already owns Enterprise with support and the 5378 DLKs.
Upgrading from Milestone XProtect Enterprise to Milestone XProtect Corporate will not only increase the FBI’s ability to collect evidentiary video but it will also allow for a straightforward transition at the end user level minimizing the time and cost it would take learning a system that is unfamiliar. The VSU’s move from Enterprise to Corporate will also generate a $1M cost savings to the FBI due to the Trade-In Pricing provided by Milestone Systems.
This procurement will upgrade VSU’s capability to collect evidentiary video at an estimated total cost of This will allow VSU to accomplish its mission to capture and collect Internet Protocol video
. It is the responsibility of VSU’s Recorder Program to identify and provide the technology needed to record this data for the purpose of video evidence collection. Providing the end users with the necessary operational guidance related to the VSU issued technology is also a responsibility of the VSU’s Recorder Program. Milestone XProtect Corporate is the most feature rich Milestone Video Management Software (VMS) version available. Milestone XProtect Corporate supporting options that will enhance the FBI video evidentiary collections with extended capabilities include: Failover, Alerting, Scheduling, Federated System and Edge Recording. The enhanced capabilities will allow the FBI to improve recording system capabilities, without a forklift training requirement that would be required with a change of Management system platforms to garner like capabilities.
A description of required functionality:
Failover capabilities: Utilizing Milestone XProtect Corporate on a failover Recording Server online to pick up recording needs if a server were to fail with Hardware/Software issues. Once the primary server returns to operation, any outage recordings maintained on the failover server will be migrated to the Primary, resulting is less management time to collect recordings and evidence submission.
Alerting: XProtect Corporate provides enhanced alerting capabilities for any system issues or anomalies allowing for notification much earlier in an outage condition.
Requisition Number: Version 1.0 Page 3 of 7
Scheduling: XProtect Corporate provides an enhanced ability to schedule recordings based on calendar functions versus on/off, on motion and manual limitations currently utilized.
Federated System: XProtect Corporate provides the ability to have multiple independent stand alone systems connected to have a full picture of the Recording Enterprise and ongoing activity.
Edge Recording: Milestone XProtect Corporate is the only version of Milestone to support edge recording from the aspect of camera supported integration and will enhance the edge capabilities of any 3rd party edge system.

4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 USC 3304 (a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
In accordance with FAR 6.301-1(c)(1)(B) – use of “brand name” descriptions for this acquisition is essential to the Governments requirement, thereby precluding consideration of a product manufactured by another company.
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
Over the last 8 years, the VSU has deployed and supported the use of Milestone XProtect software by Technically Trained Agents (TTA) and Case Agents. The TTA Operations and Development Unit (TODU) have incorporated training of the Milestone VMS into their curriculum. Electronic Surveillance (ELSUR) policies have been developed to ensure that proper procedures are in place for the archival and dissemination of data collected by the Milestone VMS. At this time it is one of the core products distributed by OTD to all the FBIs investigative offices for video evidentiary collection supporting criminal, counterintelligence and counterterrorism cases.
The upgrade from Milestone XProtect Enterprise to the more feature rich Milestone XProtect Corporate will not only increase the FBI’s ability to collect evidentiary video but it will also allow for a straightforward transition at the end user level minimizing the time and cost it would take learning a new and unfamiliar system. The VSU’s upgrade from Enterprise to Corporate will also generate a $1M cost savings to the FBI due to the Trade-In Pricing provided by Milestone. For this reason the VSU believes it is imperative that the Milestone XProtect Corporate software be the only VMS solution considered for this procurement.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
The Request for Quotation (RFQ) and this approved J&A will be posted to FedBizOps (FBO), as required by Subpart 5.102(a)(6) and SubPart 6.305(c).
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
It is the determination by the Contracting Officer that the anticipated price to the government will be deemed fair and reasonable since the requirement will be posted to FBO for competition.
The vendors listed in paragraph eight (8) will be notified that the RFQ has been posted to FBO so they may provide a quote.
8. A description of the market research conducted and the results.
As a part of this requisition for the purchase of Milestone XProtect Corporate, market research was performed by VSU personnel. VSU consulted several sources to poll the market for the product that meets the FBI's requirements and also to identify the best value for the Government.
Below are the vendors contacted by VSU. All are able to meet the requirement needs of VSU:
1) Milestone Systems, Inc.
2) App-Techs Corporation
3) SigNet Technologies, Inc.

4) Securityhunter, Inc.
9. Any other facts supporting the use of other than full and open competition.
VSU originally purchased Milestone XProtect Enterprise back in 2007 with no training as part of the purchase. VSU personnel were provided about a week long training session at one of Milestones offices somewhere on the West Coast but that training was at a reseller level. The training that VSU is looking to purchase now is more in-depth and much more technical. It has cost VSU a lot of man hours and internal collaboration with TODU to provide tailored training to the end users in the field. It has taken several years of work to get it where it is today. VSU wants to avoid turning back the clock and starting over. The training VSU is looking to purchase is meant to get all VSU/TODU personnel up to speed in order to efficiently provide the necessary support to the field in the near future.
Historically, VSU has purchased a new PMA and new DLKs when needed. There have been quite a number of purchases for PMA renewals and DLKs in the past totaling approximately
10. A listing of any sources that expressed a written interest in the acquisition.
Per paragraph eight (8) above, four (4) vendors were contacted by VSU and provided estimated pricing.
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
The requirement will be posted unrestricted on FBO to allow for competition to the maximum extent practicable.
