Consumer Product Safety Commission Statement of Work (SOW)

Milestone UltraWAVE 3 ECR Digestion System

SECTION I: Description of Services

The contractor must provide a new Milestone UltraWAVE 3 ECR Digestion System for the microwave preparation of samples for elemental analysis via Inductively coupled plasma -optical emission spectrometry (ICP-OES).

This new Milestone UltraWAVE 3 ECR Digestion System will be a replacement instrument for the current Milestone UltraWAVE 2 (Serial # 15060530) which has passed its “end of life”. The main purpose of this instrument is the microwave sample preparation of children’s products and toys for the determination of lead (Pb) content as well as additional heavy metals.

The acquisition will include delivery, unpacking, setup, installation, training and warranty.

SECTION II: Contract Type

This is a firm-fixed-price (FPP) acquisition.

SECTION III: Technique Requirements and Performance

Only new equipment shall be considered for this procurement (not used, refurbished, or previously used for demonstration). The Milestone UltraWAVE 3 system shall meet the following technical specifications:

• The unit must be a bench top system with a high-pressure single reaction chamber (SRC) in stainless-steel; chamber volume 990 ml with 950mL liner, larger or smaller microwave chambers are not accepted.

• The unit must approach a batch digestion, which allows to digest different sample matrices with the same digestion method at the same time simultaneously.

• The system must be capable to run any kind of acid chemistry, including aggressive mixtures, such as aqua regia and/ or large volumes of HCl, using loose-fitting caps to maintain the same pressure level in and outside the vials; sealed vials will not allow the pressure equilibrium and requires a cumbersome handling.

• The system must be capable to run any kind of acid chemistry, including aggressive mixtures, such as aqua regia and/ or large volumes of HCl without any need of daily cumbersome operation of cleaning and purging of the line.

• Microwave coupling directly into the single reaction chamber, high microwave power emission 1500W (max 4 min to 260°C). Higher power could lead to create hotspot.

• Noiseless and water-cooled magnetron to ensure more comfortable working conditions and higher microwave efficiency and power stability regardless the microwave program.

• Automated pre-pressurization of the chamber with inert gas (nitrogen or argon), fully controlled by the user interface, to prevent sample/reagents boiling and eliminate risk of cross contamination.

• Separated line for pre-pressurization (inlet) and venting (outlet) of the chamber made of corrosion resistant stainless steel to reduce potential contamination and ensure low blanks. Single high-pressure line led to contamination and high blanks.

• Single reaction chamber cooled by closed-loop water cooling system, connected with an external chiller, to ensure fast cooling, higher throughput, (keeping 40°C of the cooling jacket even at 280°C for long digestion times) and prevent overheating during the microwave program.

• The cooling system should have a minimum power of 1.000W to provide high cooling efficiency and fast cooling (270°C to 80°C in approximately 12 minutes).

• Working temperature up to 300°C and working pressure up to 199 bar. Lower working pressure and/or temperature will result in lower performances.

• Temperature and pressure must be control simultaneously in the reaction chamber and in all vials. SRC enables the same temperature and pressure to be achieved in all samples simultaneously.

• The temperature reading should be done by a contactless sensor capable to read through the PTFE-TFM liner. Contact sensor located outside the PTFE liner do not ensure the same level of accuracy and control.

• The system must have a quartz bottom above the PTFE-TFM liner to avoid acid diffusion.

• The system must have a 950 ml PTFE-TFM liner and be able to work with multiple vials simultaneously. Availability of racks with 7, 20, 27 and 40 positions.

• The system must be capable to work without rack or with any of the following racks without any modification or any additional sensor:

• All vials required only a loose-fitting cap. Shields, membrane, segments or other sealing mechanisms components are not accepted.

• The system must be able to digest different samples type and different acid mixtures simultaneously.

• The system must have a stirring mechanism to mix the sample/solution in the PTFE-TFM liner or in the vials using stirring bars (in the same cycle), ensuring same temperature and pressure in all vials.

• The dedicated terminal controls all the parameters: temperatures (T1: temperature of the sample/solutions in the main PTFE vessel, T2: temperature of the stainless-steel reactor), pressures, time and power. Online modifications can be done by the operator.

• The system must automatically vent the chamber after every digestion run. The operator can choose the releasing speed and the temperature of release, for example 8 bar/ min at 60°C.

• The system must perform an automatic flushing of the high-pressure lines with inert gas to remove any residue and avoid potential contamination after each run.

• Database with an extensive library of information, such as parts list, technical notes, user manuals, video tutorials, updated application notes, a complete library of relevant scientific articles, and an online help section

• Lightning notification of the reactor working compartment with color coding to indicate the status of the process (heating, cooling, stand-by, error messages)

• System must have an integrated touchpad with 10,1" display, 1280 RGB (H) X 800 (V) resolution. Multiple USB ports for connection with balance, printer, mouse, and keyboard.

• System must come with web-based application (Milestone Connect) integrated into the terminal and accessible from external devices (PC, tablets or smartphones) connected to the microwave unit. It includes a database with updated information (list of parts, technical notes, user manual, video tutorials, updated application notes, the complete library of available scientific articles) as well as a remote monitor of the microwave system.

SECTION IV: Requirements

All equipment must be delivered and installed on site by the contractor and proof of operability must be demonstrated.

The contractor shall perform the following:

a. The contractor shall include an estimate of delivery cost in response to request.

b. The following deliverable items for this contract shall be performed or delivered in accordance with the following schedule:

B. Training:

a. Training of staff with the UltraWAVE 3 system will include instrument operation and routine maintenance and will be provided after the installation.

C. Warranty, maintenance, and repair:

a. Minimum 1-year warranty covering all parts, labor, and travel (but not consumables) is required for the UltraWAVE 3system and its associated equipment/accessories.

b. Contractor must provide on-site repair of instrument within 72 hours.

SECTION V: Government Furnished Property

The following will be provided by the government:

• Laboratory space for required equipment.

• Proper ventilation for required equipment.

• Required electrical power outlets.

• Required gas(es).

• Any other consumables required per site planning guide.

SECTION VI: Withholding of Contract Payment:

Notwithstanding any other payment provision of this contract, failure of the Contractor to perform or deliver required work, supplies, services, or failure to complete the percentage of work claimed, will result in the withholding of payments under this contract unless such failure arises out of causes beyond the control, and without the fault or negligence of, the Contractor.

The Government must promptly notify the Contractor of its intention to withhold payment of any invoice or voucher submitted.

PRODUCT TESTING LABORATORY SITE, ROCKVILLE, MARYLAND

Delivery Address:

The Consumer Product Safety Commission (CPSC) Laboratory facility is located in Rockville, MD. Deliveries are to be made to the loading dock area which is accessible from the parking area entrance on Research Place on the east side of the building. Do not enter the parking area from Research Court on the North side of the facility as there may not be sufficient room to maneuver and back up to the loading dock area on the east side of the building.

Deliveries may not be left outside the building or loading dock, unless specifically directed by appropriate CPSC staff. All deliveries shall be considered "inside deliveries" in accordance with the instructions below. When scheduling deliveries, the purchase order number shall always be referenced and all packages shall clearly display the Purchase Order Number on the outside of the cartons and/or packages and include the packing slip.

2. DELIVERY INSTRUCTIONS FOR LARGE OR HEAVY ITEMS:

Large or heavy items must be delivered directly to the loading dock. If delivery cannot be made to the loading dock directly or via the leveling device and requires off-loading the item from the delivery vehicle to the ground, then deliveries of such large or heavy items should be scheduled 24 hours in advance and should be made between 9:00 a.m. and 3:00 p.m. on Monday through Friday (except holidays). Contact information is the same as above to arrange for CPSC lift truck operators or other lifting and handling support needs for the delivery.

B. BILLING INSTRUCTIONS

Pursuant to the Prompt Payment Act (P.L. 97-177) and the Prompt Payment Act Amendments of 1988 (P.L. 100-496) all Federal agencies are required to pay their bills on time, pay interest penalties when payments are made late, and to take discounts only when payments are made within the discount period. To assure compliance with the Act, vouchers and/or invoices shall be submitted through the Invoice Processing Platform (IPP).

ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS

Invoice Processing Platform (IPP) is a secure web-based electronic invoicing and payment information service available to all Federal agencies and their supplier by the U.S. Treasury's Bureau of Fiscal Service. IPP allows Federal agencies and their suppliers to exchange electronic purchase orders, blanket POs, invoices, and payment information in one easy to access web portal. This service is free of charge to government agencies and their suppliers, including services and support.

(a) Definitions. As used in this clause-

(1)”Payment request” means a bill, voucher, invoice, or request for contract financing payment with associated supporting documentation. The payment request must comply with the requirements identified in FAR 32.905(b), “Payment documentation and process” and the applicable Payment clause included in this contract.

(b) The Contractor shall submit payment requests electronically using the Invoice Processing Platform (IPP). Information regarding IPP is available on the Internet at www.ipp.gov. Assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@stls.frb.org or phone (866)973-3131.

OVERPAYMENTS

Accounts Receivable Conversion of Check Payments to EFT: If the Contractor sends the Government a check to remedy duplicate contract financing or an overpayment by the government, it will be converted into an electronic funds transfer (EFT). This means the Government will copy the check and use the account information on it to electronically debit the Contractor’s account for the amount of the check. The debit from the Contractor’s account will usually occur within 24 hours and will be shown on the regular account statement.

The Contractor will not receive the original check back. The Government will destroy the Contractor’s original check, but will keep a copy of it. If the EFT cannot be processed for technical reasons, the Contractor authorizes the Government to process the copy in place of the original check.

C. INSPECTION & ACCEPTANCE PERIOD

Unless otherwise stated in the Statement of Work or Description, the Commission will ordinarily inspect all materials/services within seven (7) business days after the date of receipt. The CPSC representative responsible for inspecting the materials/services will transmit disapproval, if appropriate, to the contractor and the Contracting Officer. If other inspection information is provided in the Statement of Work or Description, it is controlling.

D. NO AUTOMATIC RENEWALS

If any license or service tied to periodic payment is provided under this agreement (e.g., annual software maintenance or annual lease term), such license or service shall not renew automatically upon expiration of its current term without prior express consent by an authorized Government representative.
