Request for Quote Grass Hay Small Bales United States Department of Agriculture (USDA) Animal Plant Health Inspection Service (APHIS)
PART 1.0 – THE SCHEDULE OF ITEMS
The contractor shall submit a firm-fixed price quote to provide the required product in accordance with the solicitation. The contractor’s price shall be their fully burdened rate which includes all costs associated with this contract for providing the grass hay for the USDA, APHIS, located in Ames, IA.

SCHEDULE NOTES
1) Shipping and delivery is FOB destination; therefore, delivery of the grass hay must be included in the price for the line item as well as all overhead, taxes, material and any costs to deliver the hay to the USDA, APHIS, Ames facility indicated in the Statement of Work and Specifications.
2) The quantities as listed in the “Schedule of Items” are estimated requirements for this contract period. The Government estimates, but does not guarantee, the volume of purchases under this contract. The USDA, APHIS attempts to be as accurate as possible when providing estimated quantities, however, actual quantities required may vary from the quantities listed. Other than the minimum contract amount stated in AGAR clause 452.216-73 below, no guarantee is given as to the actual number of hay required during the term of this contract.
3) This Request for Quote for commercial items is being conducted in accordance with FAR Subpart 13.5 test program procedures for commercial items. Simplified acquisition procedures will be followed.
4) The contract clause 52.219-14 - Limitations on Subcontracting applies to this contract. This clause states the concern shall perform work for at least 50 percent of the cost of manufacturing the supplies, not including the cost of materials. If it is not clearly demonstrated in the contractors quote that they meet this regulation the contractor will be required to provide information demonstrating they can meet the requirements of this clause prior to contact award.
5) Contractors shall note the government intends to award an indefinite delivery indefinite quantity firm fixed price contract. Under a contract, the contractor is obligated to provide the hay requested in an order.
6) The government reserves the right to make a single award or multiple awards, whatever is determined to be most advantageous to the government. If multiple awards are established the delivery orders will be competed amongst the multiple awardees in accordance with FAR 16.505 and the award decision for the orders will based on price, availability to provide the hay to meet the government’s timeline and the Contractor’s past performance..
In order to be considered for this contract the Contractor must submit the following:
· A completed quote on company Letterhead, good for 90 days
· Completed Schedule of items
· Technical capability and past performance information as requested in the section below entitled “EVALUATION OF QUOTES”. It is the contractor’s responsibility to submit detailed and sufficient information in order for the government to conduct an evaluation of their quote.
· Completed provisions 52.225-2 Buy American Act Certificate, and 52.204-20 Predecessor of Offeror and 52.209-7 Information Regarding Responsibility Matters if not completed in the SAM registration.
· Paragraph (b) of the provision 52.212-3, Offeror Representations and Certifications-Commercial Items if you have completed the annual representations and certification electronically via the System for Award Management (SAM) Website located at https://www.sam.gov/portal. NOTE the provision 52.204-7 System for Award Management requiring vendors to be registered in SAM prior to submission of a quote.
Do NOT include a copy of the entire solicitation with your quote response.
It is the contractor’s responsibility to provide thorough and complete information in accordance with what is requested above. If the Contractor’s quote does not contain all of the items listed above, the quote may be considered incomplete for evaluation purposes and no further consideration will be given to the Contractor’s quote, thereby making the quote ineligible for award.
The quote shall be submitted electronically via email to Sarah Schauf at Sarah.c.schauf@usda.gov by 31 AUG 2020 1300 CST.
Questions shall be submitted in writing to the Contracting Officer at the above email address. Time to allow sufficient time for a response. Although the government will make every attempt possible to answer all questions received, there’s no guarantee questions received after the cutoff date will be answered.
EVALUATION OF QUOTES
The Government will award a contract in accordance with FAR part 13.106 resulting from this solicitation to the responsible contractor whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award will be made to the quote determined to be the best value. The USDA’S evaluation of contractor quotes will consider the contractors technical capability to meet the agency’s needs, the contractor’s demonstrated ability to provide the Grass Hay requested in the specifications and statement of work.
The USDA will also consider relevant past performance and prior experience which includes the contractor's experience of similar scope, magnitude, and complexity to the requirements described in the specifications and statement of work. Past performance will also measure the degree to which a contractor has satisfied customers in the past and complied with federal, state, and local laws and regulations.
In accordance with FAR 52.212-1 (b) (10) – regarding past performance, references are requested.
Since past performance will be considered the contractor shall submit references which includes a contract number, description/nature of the contract, name, telephone number and email address.
The Contractor shall list within the past 3 years current or prior federal contracts, total dollar amounts, contract name, agency, address, telephone number, email and a brief description of the project performed. If the contractor has no federal contracting experience, then he/shall send aforementioned references of contracts held in the following order: state, local, and private.
The Government does not assume the duty to search for information to cure the problems it finds in the information provided by the Contractor. The burden of providing thorough and complete technical capability and past performance information remains with the Contractor.
PART 2.0 – SPECIFICATIONS
Grass hay must be Grade No.2 or upper Grade No. 3, according to standards of the Hay Market Task Force of America Forage and Grassland Council. Relative Feed Value Index (RFV) should be 70-100; Crude Protein should be 7-14% on dry matter basis; Acid Detergent Fiber (ADF) should be less than 49% on a dry matter basis; and Neutral Detergent Fiber (NDF) should be less than 65% on a dry matter basis.
The hay must be from year 2020 or 2021 crop, and meet the specifications listed below. The composition of the hay is to be of no more than 50% composition of any one type of the following grasses: Orchard Grass, Brome (Smooth or Meadow), Timothy, Limestone Little Bluestem, Western Wheatgrass, Big Bluestem, Switchgrass, Prairie Cordgrass, Indian Grass, and side-oats grama. Hay must be greater than fifty per cent (50%) leaves and green; contain less than 2% foreign material; be free of mold, musty odor, dust, etc. No hay will be accepted that has been rained on, is moldy, weathered, weedy, wet, shows signs of insect damage or shows poor construction. This includes hay that shows signs of storage in direct contact with floor such as dirt, gravel, discoloration, moisture damage, and/or mold. All hay is to be harvested from fields that are not grazed and should be from fields located on one farm or close proximity. All hay delivered must be of consistent composition from first to last load.
The hay shall be satisfactorily baled with rot-proof twine. Bales that are ragged, bales shorter than 36" or longer than 48", and bales having wires or twine of unequal tension, which makes it difficult to handle, will not be acceptable. ROUND BALES WILL NOT BE ACCEPTABLE. Bales should weigh between 55 and 75 pounds each. Hay shall not contain injurious foreign material.
DELIVERIES
Delivery shall be direct from fields or barns via clean vehicles not used for transportation of livestock. Shipment by rail is not acceptable. Deliveries shall be made to: USDA, ARS, MWA, NADC, 1920 Dayton Avenue, Building 13, Ames, Iowa 50010. Deliveries shall be made during normal business hours of 7:30 a.m. through 2:00 p.m. (CST) Monday through Friday, excluding Federal holidays. The Contractor shall make deliveries within five (5) working days after receipt of a telephone or written order from an authorized Government employee. Partial deliveries of a minimum quantity may be requested.
It will be requested that contractor call 515-337-7248 prior to delivery.
It is required by the ICC that both the empty and loaded weight must be obtained from the same weighing station. The Contractor shall provide the Government with a certified copy of the loaded weight ticket at the time of each delivery, which must be obtained at an Official Weighing Station with the firm’s name inscribed on the weigh ticket.
A DELIVERY TICKET must accompany the weigh ticket also, allowing for a signature of a person making the delivery and a signature of government personnel receiving the hay. The delivery ticket must list the number of bales per load.
The Contractor shall be responsible for unloading and stacking the hay in an area designated by the Government. Preferred: If the bales are banded in bundles of not less than 16 bales/bundle and not more than 21 bales/bundle, the government will mechanically unload and stack the hay in the designated storage area at no expense to the contractor.
STORAGE
The successful quoter shall store the hay at no additional cost to the Government until such time as all deliveries have been made and the contract has been completed.
INSPECTION
The Government reserves the right to inspect the premises and origin of hay before, and at any time after the contract is consummated to assure that the hay is not being contaminated with dangerous pathogens. The Government reserves the right to make inspection of fields, barns where the hay is being stored, and the bales to determine quality and freedom from animal contaminations and also to assure that the quoter’s operations will meet conditions required.
Final inspection will be made at time of delivery to the National Animal Disease Center, and the hay must meet specifications & requirements as specified herein or it will not be accepted. It will be required that the hay not be unloaded until inspected and approved by Government personnel. After delivery, each load of hay will have a sample sent for forage analysis at the government’s expense. Based on the results of this testing, if the load does not meet the minimum specifications, it will be subject to rejection.
2.2 Contract Type and Term
The government will award a firm fixed price indefinite delivery indefinite quantity commercial supply contract for the grass hay.
The anticipated period of performance for this contract is for one year from date of award.
2.3 Government Furnished Products and Equipment
There is no government furnished equipment for this contract.
2.4 Government Roles and Responsibility
Only the Contracting Officer has the authority to modify the contract specifications, terms and conditions.
2.5 Ordering and Delivery Orders
Funding for the supplies under this contract will be obligated via delivery orders and sent via email to the Contractor. Funding will be provided as a fixed price for the supplies identified in the Schedule of Items.
Supplies can also be ordered via a purchase card by any USDA, APHIS warranted card holder.
The contractor must contact the contracting officer for approval before they allow a USDA warranted card holder to purchase products under this contract.
2.6 Invoices and Payment Information
The USDA, APHIS uses the Invoice Processing Platform (IPP) for electronic submission and tracking of invoices and payment information to its suppliers of goods and services. Invoices shall be submitted electronically to the IPP invoicing system. The contractor must enroll at https://ipp.gov
Invoices must be prepared in accordance with the clause at FAR 52.212-4 (g). Invoices must be supported with the proper documentation which includes the contractor name and contact information, contract number, delivery order number, delivery dates, quantities, and pricing in accordance with the contract schedule of items and delivery order.
Contractors must submit invoices and attach, as applicable, all supporting documentation as required. If the required supporting documentation is not provided the invoice will be rejected. IPP will issue a notification to contractor that they must submit supporting documentation and resubmit the invoice.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)

52.216-18 Ordering (Oct 1995)
(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from date of award through end of last option period exercised.
(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c) If mailed, a delivery order or task order is considered “issued” when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule.
52.216-19 Order Limitations (Oct 1995)
(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $1,000.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.
(b) Maximum order. The Contractor is not obligated to honor --
(1) Any order for a single item in excess of 225 bales;
(2) Any order for a combination of items in excess of 225 bales; or
(3) A series of orders from the same ordering office within 30 days that together call for quantities exceeding the limitation in subparagraph (b)(1) or (2) of this section.
(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.
(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 10 days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
52.216-22 Indefinite Quantity (Oct 1995)
(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.
(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum."
(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.
(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after January 7, 2023.
452.216-73 Minimum and Maximum Contract Amounts (Feb 1988) During the period specified in FAR clause 52.216-18, ORDERING, the Government shall place orders totaling a minimum of $1000.00 but not in excess of 225 bales.

52.204-20 Predecessor of Offeror (Jul 2016)
(a) Definitions. As used in this provision– “Commercial and Government Entity (CAGE) code” means–
(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity; or
(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.
“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.
“Successor” means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name. 52.209-7 Information Regarding Responsibility Matters ( Jul 2013)
(a) Definitions. As used in this provision— “Administrative proceeding” means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.
“Federal contracts and grants with total value greater than $10,000,000” means—
(1) The total value of all current, active contracts and grants, including all priced options; and
(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).
“Principal” means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).
(b) The offeror [ ] has [ ] does not have current active Federal contracts and grants with total value greater than $10,000,000.
(c) If the offeror checked “has” in paragraph (b) of this provision, the offeror represents, by submission of this offer, that the information it has entered in the Federal Awardee Performance and Integrity Information System (FAPIIS) is current, accurate, and complete as of the date of submission of this offer with regard to the following information:
(1) Whether the offeror, and/or any of its principals, has or has not, within the last five years, in connection with the award to or performance by the offeror of a Federal contract or grant, been the subject of a proceeding, at the Federal or State level that resulted in any of the following dispositions:
(i) In a criminal proceeding, a conviction.
(ii) In a civil proceeding, a finding of fault and liability that results in the payment of a monetary fine, penalty, reimbursement, restitution, or damages of $5,000 or more.
(iii) In an administrative proceeding, a finding of fault and liability that results in—
(A) The payment of a monetary fine or penalty of $5,000 or more; or

(d) The offeror shall post the information in paragraphs (c)(1)(i) through (c)(1)(iv) of this provision in FAPIIS as required through maintaining an active registration in the System for Award Management database via https://www.acquisition.gov (see 52.204-7).
52.212-3 Offeror Representations And Certifications - Commercial Items (Oct 2018) The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u)) of this provision.
(a) Definitions. As used in this provision— “Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
“Inverted domestic corporation”, means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
“Sensitive technology”—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
“Service-disabled veteran-owned small business concern”—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
“Small disadvantaged business concern”, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that—
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by—
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
“Subsidiary” means an entity in which more than 50 percent of the entity is owned—
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
“Veteran-owned small business concern” means a small business concern—
(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
“Successor” means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.
“Women-owned business concern” means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.
“Women-owned small business concern” means a small business concern—
(1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and
(2) Whose management and daily business operations are controlled by one or more women.
“Women-owned small business (WOSB) concern eligible under the WOSB Program” (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
(b)(1) Annual Representations and Certifications. Any changes provided by the Offeror in paragraph (b)(2) of this provision do not automatically change the representations and certifications in SAM.
