Compact Excavator
(i) This is a combined synopsis/solicitation for commercial products and/or commercial services prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.
(ii) The combined synopsis/solicitation number is 1240BD25Q0043 and is issued as a Request for Quotation (RFQ) to establish a Firm-Fixed-Price contract.
(iii) The combined synopsis/solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2025-04, effective 06/11/2025.
(iv) This procurement is a Total Small Business Set-Aside. In accordance with FAR Clause 52.219-6, Notice of Total Small Business Set-Aside.
Offers are solicited only from small business concerns. Offers received from concerns that are not small business concerns shall be considered nonresponsive and will be rejected.

Description of Requirement: This is a purchase order (PO) for the procurement of a “Brand Name or Equal” Kubota U17 Compact Excavator, Engine Model No. Kubota D902-E4. The salient physical, functional, and performance characteristics are provided on Attachment 1 of this solicitation.

ADDENDUM to FAR 52.212-1(b), Submission of Offers:
(12) Offerors must have an active entity registration in the System for Award Management (https://www.sam.gov/SAM/) in order to submit an offer.
(13) Offerors shall ensure that all representations and certifications are up-to-date in SAM.gov at time of offer submission. A completed copy of the representations and certifications at FAR 52.212-3 shall be submitted with the offer.
(14) Offers submitted in response to this solicitation shall include the following:

b. Clearly identify the item by-
(i) Brand name, if any; and
(ii) Make or model number;
c. Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and
d. Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications.
(ii) FACTOR 2 – DESCRIPTION OF SERVICE & REPAIR CAPABILITIES
To be considered a “Best Value” offeror, your company is required to clearly describe in writing how your company is positioned to provide annual service and future potential repairs at or near the “Delivery Location” cited above. It is vital that your company is capable of complying with the manufacturer’s recommended maintenance schedule as required by the Operator’s Manual and associated warranty maintenance mandates. Include the name and address of nearest approved warranty/maintenance shop to Entiat, WA in your offer.
(iii) FACTOR 3 – PAST PERFORMANCE INFORMATION (Non-Submittal Requirement)
Your company is not required to submit anything for this evaluation criterion. The CO will review your company’s procurement history via the System for Award Management (SAM) and the Contractor Performance Assessment Reporting System (CPARS) repository. A risk assessment will be performed during this review. Examples of items that demonstrate high risk for the government include felony convictions, debt subject to offset, contracts terminated for default, etc.
(iv) FACTOR 4 – PRICE. Offerors shall complete and submit the Schedule of Items (Page 3).
A company that offers the best price, while complying with the “Brand Name or Equal” requirements, will be considered the “Best Value” for the USDA Forest Service.
(15) Amendments, if any, to the solicitation will be posted in www.sam.gov under this solicitation number.

(16) Offers shall be submitted electronically via email to brian.johnson3@usda.gov no later than the date/time provided on the Standard Form 1449, Block 8. Offerors shall ensure offers are delivered into this inbox by the due date and time. Be aware that large attachments may increase the time required to deliver an email.

ADDENDUM to FAR 52.212-1(f), Late Submissions, Modifications, Revisions, and Withdrawals of Offers:
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition.

52.212-2 Evaluation—Commercial Products and Commercial Services (NOV 2021)
(a) The Government will award a Firm-Fixed Price contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(c) BASIS FOR CONTRACT AWARD
(i) The source selection will be conducted in accordance with Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Products and Commercial Services. Award will be made to the offeror who is deemed responsible in accordance with the FAR, whose offer conforms to the solicitation requirements, and whose offer, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, is the most advantageous to the Government.
(ii) The government reserves the right to conduct a price realism analysis at any point during the evaluation process. The Government will evaluate prices for reasonableness using adequate competition and price analysis techniques.
(iii) The Government intends to award a Firm-Fixed-Price (FFP) purchase order as a result of this solicitation.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller
General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(a) If an item in this solicitation is identified as "brand name or equal," the purchase description reflects the characteristics and level of quality that will satisfy the Government’s needs. The salient physical, functional, or performance characteristics that "equal" products must meet are specified in the solicitation [Refer to Attachment 1].
(b) To be considered for award, offers of "equal" products, including "equal" products of the brand name manufacturer, must-
(1) Meet the salient physical, functional, or performance characteristic specified in this solicitation;
(2) Clearly identify the item by-
(i)Brand name, if any; and (ii)Make or model number;
(3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and
(4) Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications.
(c) The Contracting Officer will evaluate "equal" products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer.
