SUBJECT: Request for Quote (RFQ_FDA_1239695_R) for UHPLC Instrument with Diode Array Detector (DAD).
This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in FAR 12.6 as supplemented with FAR 13 and additional information included in this notice. The incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2021-05.
THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION AND A SEPARATE SOLICITATION
WILL NOT BE ISSUED.
The solicitation number for this acquisition is RFQ_FDA_1239695_R and is being issued as a Request for Quote (RFQ). The NAICS Code for this solicitation: 325120. The Small Business Size Standard is 1,000 employees. The requirement will be awarded as Firm-Fixed Price and 100% small business set-aside. The Government reserves the right to award without discussions if the Contracting Officer determines that the initial offer is providing the Best Value and discussions are not necessary.
The U. S Food & Drug Administration (FDA), Office of Acquisitions and Grant Services (OAGS) is procuring one (1) each UHPLC Instrument with Diode Array Detector (DAD).

Background:
The U.S. Food and Drug Administration (FDA), Office of Testing and Research (OTR), Division of Pharmaceutical Analysis (DPA) requires a new UHPLC (Ultra High-Performance Liquid Chromatography) instrument with a Diode Array Detector (DAD) to replace the current HPLC connected to the Thermo-Scientific Orbitrap QExactive™ mass spectrometer. The current HPLC, the Thermo-Scientific Accela HPLC, is obsolete and is no longer supported by the manufacturer.
The replacement UHPLC should be compatible with the current Xcalibur operating software and QExactive™ mass spectrometer. This instrument shall be brand name or equal to Thermo- Scientific Vanquish Flex UHPLC System. The UHPLC should therefore be ready to use and fully compatible with the existing MS system software and hardware right out of the box. This will prevent any problems with the functionality of the replacement UHPLC within the Thermo- Scientific QExactive™ mass spectrometer system.
The Thermo-Scientific QExactive™ mass spectrometer system is mainly used to support testing and research work related to or in support of the Method Verification Program (MVP), Advance Manufacturing and Analysis of Nitrosamine contaminated drugs.
1) Technical Requirements:
The Offeror shall indicate if the minimum salient characteristics have been met to be considered responsive for this requirement. This requirement shall cover the delivery, installation, and training on a new UHPLC system with DAD (Diode Array Detector). Operation of the instrument and performance qualification demonstration shall be inclusive of the installation completion.
A) UHPLC Instrument
a) Shall be brand name or equal to Thermo-Scientific Vanquish Flex UHPLC System [catalog # VF-S01-A-02 (Vanquish System Base), catalog # VF-P20-A (Quaternary Pump F), catalog # VF-A10-A-02 (Split Sampler FT) and catalog # VF-D11-A-01 (Diode Array Detector FG)].
b) Shall have maximum backpressure capability of up to 1034 bars.
c) Shall have maximum flow rate of up to 8 mL/min, in 1 µL/min increments.
d) Shall have maximum column temperature of up to 80 °C or higher.
e) Shall have Built-in solvent degassing, 4 channels
f) Shall be fully compatible with the current Xcalibur operating software and Thermo-
Scientific QExactive™ mass spectrometer.
B) Diode Array Detector (DAD)
a) The Diode Array Detector shall be compatible with brand name or equal Thermo- Scientific Vanquish UHPLC instrument and Xcalibur operating software.
b) The Diode Array Detector shall have a wavelength accuracy of ± 1 nm and a settable slit width (wide, narrow). Wavelength repeatability shall be ± 0.1 nm.
c) The Diode Array Detector shall have a wavelength range of 190 – 800 nm.
The Diode Array Detector shall have a drift of less than 1 mAU/hour at 254 nm and noise of less than ± 6 µAU at 254 nm (standard flow cell, bandwidth: 4 nm, slit width: wide, time constant: 2 sec.).
d) The Diode Array Detector shall have a data collection rate of up to 200 Hz or higher.
C) Trade and Service Specifications
a) The instrument shall be a newly manufactured unit, not used and refurbished or previously used for demonstration. The life cycle of this instrument is intended to be about ten years at full performance.
b) The entire system shall be warranted for parts and labor for 12 months from the date of installation.
D) Tasks Performed by Offeror
a) Delivery of system meeting technical requirements above (90 Days After Award).
b) Installation of system as stand-alone, followed by Installation and Operation
Qualifications and On-site Training for minimum of 3 people (90 Days After Delivery).
2) Other Requirements:
A) Site Preparation Information: Offerors shall include in their quote any, and all site-preparation information required for proper system operation and maintenance, including physical space, ventilation, and IT/network requirements.
B) End-User Training
a. All costs associated with the training, including any reagents or consumables shall be included in the quote. The Original Equipment Manufacturer (OEM), or a manufacturer trained and certified individual, shall provide training covering (at a minimum) system operation, routine maintenance of the system, and utilization of the system with custom workflows or programs.
Training will be scheduled with the Technical Point of Contact (TPOC) and may not occur on the day of system installation, weekends, or Federal holidays.
Training is estimated to be 1-2 days in duration.
3) Delivery Requirements The Contractor shall deliver (s) in this purchase order as follows:
A) The quantities ordered within 90 days of order award.
B) All deliverables required under this order shall be packaged, marked and shipped in accordance with Government specifications.
C) At a minimum, all deliverables shall be marked with the order number and contractor’s name. The Contractor shall guarantee that all required materials shall be delivered in immediate new, usable and acceptable condition.
D) Contractor shall contact TPOC to schedule the delivery. Delivery hours are 10:00 am
– 4:00 pm, Monday – Friday, excluding Federal holidays and weekends. Installation shall be performed by a currently trained technician, certified by the manufacturer.
E) The installation date would be scheduled ahead of time due to COVID-19 constraints
The offeror will be responsible for shipment, installation and setup of the instrument at the US Food and Drug Administration (FDA) facility address listed below:
All installation costs including: required installation kits and standards shall be included in the quote. The complete installation should be scheduled within thirty (30) days of delivery of all necessary components. The offeror shall provide any predefined specifications or requirements for the installation as part of the quote information.

4) Period of Performance:
The Contractor shall deliver the equipment within 90 days of award, installation shall be conducted within 90 days after delivery.
5) Place of Performance:
The equipment shall be shipped and installed at the shipping address outlined above.
6) Inspection and Acceptance:
The Technical Point of Contact (TPOC), shall perform inspection and acceptance within 30 days after installation completion.

7) GOVERNMENT HOLIDAYS
a. The Government hereby provides notification that Government personnel observe the listed days as holidays:
(1) New Year's Day (6) Labor Day
(2) Martin Luther King's Birthday (7) Columbus Day
(3) President’s Day (8) Veterans' Day
(4) Memorial Day (9) Thanksgiving Day
(5) Independence Day (10) Christmas Day
b. In addition to the days designated as holidays, the Government observes the following days:
(1) Any other day designated by Federal Statute
(2) Any other day designated by Executive Order
(3) Any other day designated by the President’s Proclamation
c. When any such day falls on a Saturday, the following Monday is observed. Except for designated around-the-clock or emergency operations, Vendor personnel will not be able to perform on-site under this contract with FDA on holidays set forth above. The Vendor will not charge any holiday as direct charge to the award.
d. It is understood and agreed between the Government and the Vendor that observance of such days by Government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation except as set forth within the award.
e. Nothing in this clause abrogates the rights and responsibilities of the parties relating to stop work provisions as cited in other sections of this contract.
8) FDA Invoice Submission Instructions.

*** Acceptable methods of delivery include: E-mail (preferred) and Standard Mail. Provide a copy marked courtesy to the Technical Point of Contact (TPOC).
B. Invoices submitted under this contract must comply with the requirements set forth in FAR Clauses 52.232-25 (Prompt Payment) and 52.232-33 (Payment by Electronic Funds Transfer
- System for Award Management) and/or other applicable FAR clauses specified herein. To constitute a proper invoice, the invoice must be submitted on company letterhead and include each of the following:
(i) Name and address of the vendor;
(ii) Invoice date and invoice number;
(iii) Contract/Order number (including a reference to any base award for Indefinite- Delivery/Indefinite-Quantity Contracts or Blanket Purchase Agreements);
(iv) Description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed, including:
(a) period of performance for which costs are claimed;
(b) itemized travel costs, including origin and destination;
(c) any other supporting information necessary to clarify questionable expenditures;
(d) the contractor shall include the award item number for each description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed;
(v) Shipping number and date of shipment, including the bill of lading number and weight of shipment if shipped on government bill of lading;
(vi) Terms of any discount for prompt payment offered (Prompt Payment terms other than NET 30);
(vii) Name and address of official to whom payment is to be sent (must be the same as that in the purchase order/award, or in a proper notice of assignment);
(viii) Name, title, and phone number of person to notify in event of defective invoice;
(ix) Taxpayer Identification Number (TIN);
(x) banking routing transit number of the financial institution receiving payment for Electronic funds transfer (EFT);
(xi) Name and telephone number of the FDA TPOC, as referenced on the award;
(xii) For all Inspections, Time-and-Materials and Labor-Hour Awards, Contractor is required to attach an invoice log addendum to each invoice which shall include, at a minimum, the following information for contract administration and reconciliation purposes:
(a) list of all invoices submitted to date under the subject award, including the following:
(1) invoice number, amount, & date submitted
(2) corresponding payment amount & date received
(b) total amount of all payments received to date under the subject contract or order
(c) and, for definitized contracts or orders only, total estimated amounts yet to be invoiced for the current, active period of performance;
(xiii) Any other information or documentation required by the award.
C. An electronic invoice is acceptable if submitted in Adobe Acrobat (PDF) format. All items listed in (i) through (xiii) of this clause must be included in the electronic invoice. Electronic invoices must be on company letterhead and must contain no ink changes and be legible for printing.
D. The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months.
The Contracting Officer may exercise the option by written notice to the Contractor anytime before the contract expires.

The Offeror shall submit a fixed price, including details of all costs supporting the price for the requested items/services.
The Offeror shall complete the pricing chart below. Pricing shall include all applicable fees including shipping, warranty and handling. Any charges presented after contract award shall not be acceptable.

a) The Vendor’s quotation shall include: All items requested or none.
b) Vendors are required to fill in the above pricing table
c) Vendor shall show any pricing related to labor hours, materials associated with providing design, delivery and installation (as applicable).
d) Vendors shall not include in their quote the not-to-exceed $1,000 allowance for each
POP, to capture contingencies of overage of ice delivery due to delivery variance in poundage, size and amounts
e) Vendors shall submit a complete schedule of prices and a single summary total amount shall be furnished for the entire requirement.
f) The Offeror’s current address, DUNS shall be included in the quote.
g) The quotation shall contain sufficient information to allow the Government to perform a basic analysis of the proposed price of the work.
