The National Cancer Institute (NCI), Center for Cancer Training (CCT) is planning to procure services to host the NCI Diversity Career Development Program to increase the diversity of the workforce.

This is a combined synopsis/solicitation for commercial items, prepared in accordance with format in FAR 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation and a separate written solicitation will not be issued. This solicitation: No. 75N91020R00054 includes all applicable provisions and clauses in effect through FAR FAC 2020-08 (AUG 2020) simplified procedures for commercial items.

The North American Industry Classification System (NAICS) code is 611430. The business size standard is $11 million and this is a Small Business Set-Aside.

Only one award will be made as a result of this solicitation. This will be awarded as a severable firm fixed price type contract.

Description of Requirement

1.0 TITLE

Procurement of services to host NCI Diversity Career Development Program (DCDP)

2.0 BACKGROUND

The recent Advisory Committee to the Director (12/12/14) recommended that there needs to be an increase in the number of underrepresented minorities at the NIH Intramural Research program (IRP). In order to retain the best and brightest scientists, NCI needs to invest in an effective and sustainable intervention program early in their career path.

Women, persons with disabilities, and underrepresented racial/ethnic groups exhibit low representation in STEM fields and their employment levels differs from their representation in the U.S. population. The creation of the NCI Diversity Career Development Program aligns with the NCI commitment to attract, hire and retain underrepresented scientists in order to generate a vibrant and diverse scientific community. This contributes to the understanding of the audience and the challenges in being a scientist searching for career development.

3.0 OBJECTIVE

The objective of the NCI Diversity Career Development Program is to increase the diversity of the workforce. This intramural effort will support and nurture talented individuals to succeed in their respective scientific careers. Three central objectives of the program can be summarized as follows:

Empower participants by building a strong sense of community, support and belonging
Cultivate leadership, management, relationship building and communication skills
Grow a sense of confidence and vision for themselves and their careers.

CONTRACT REQUIREMENTS/ AND PERSONNEL QUALIFICATIONS

Technical Requirements The Contractor shall perform the following tasks:

Run the coaching component of this program. This include developing materials, in the form of brochures, readings, power point presentations, etc., to support activities; and
Conduct half day workshops four (4) times a year onsite and provide four (4) workshop refreshers each consisting of 2-hour videoconference sessions (virtual chats) refreshers . These sessions will include discussion, coaching, accountability, and reinforcement of the key course skills so that participants will develop mastery tailored to the group demands and needs. The proposed group size would include up to thirteen (13) participants. The cost should include development of all course materials, coaching hours and travel expenses

Qualifications

The professional coach must

Be trained in life coaching, customized to the needs of a scientific population with at least 3 years of experience in coaching diverse populations;
Have a PhD with expertise in biomedical sciences;
Have at least 3 years of experience performing scientific research in an academic environment;
Have at least 3 years of experience coaching underrepresented minorities and;
Have at least 3 years of institutional knowledge of National Cancer Institute (NCI)
Be able to provide professional coaching tailored specifically to the needs of postdoctoral fellows from diverse backgrounds which includes but is not limited to the following topics:
Leadership skill building

Confidence Goal setting Confronting inner dialog Taking action Prioritizing Facing obstacles Difficult conversations

Communication and relationships
Realizing concrete results

Retention in the sciences Career building activities

5.0 TYPE OF ORDER

This will be issued as a severable Firm-Fixed Price Purchase Order.

6.0 PERIOD OF PERFORMANCE

The period of performance shall be for a one-year base period with four, 12-month option periods as follows:

Base Year: September 22, 2020 to September 21, 2021 Option Year 1: September 22, 2021 to September 21, 2022 Option Year 2: September 22, 2022 to September 21, 2023 Option Year 3: September 22, 2023 to September 21, 2024 Option Year 4: September 22, 2024 to September 21, 2025

7.0 PLACE OF PERFORMANCE

8.0 REPORT(S)/DELIVERABLES AND DELIVERY SCHEDULE

Metrics will be used to evaluate success of the effectiveness of the delivered technical requirements and will be based on Participant satisfaction, participation, and leadership of scheduled activities. A survey to participants will be administered at the end of the program to help with the evaluation and inform future Program content. It is expected that the surveys (e.g. Survey Monkey), will be developed, administered and analyzed by the Contractor in collaboration with the Technical Point of Contact for this requirement, and the Manager of the Course.

Deliverable Description Proposed Timeline Develop project work plan – the NCI meets face to face or virtually with Contractor (at the NCI Shady Grove campus) to discuss needs; Contractor reviews background material and resources. This should be conducted in a 2-3 hour meeting.

Weeks 1-2 Contractor prepares draft of first half of course materials Weeks 3-8 The NCI and Contractor finalize first half course materials; schedule first 4 hour workshop and first half of the 2 hour virtual chats; begin draft of second half of course materials.

Weeks 9-14 Contractor conducts two (2) half-day workshop at NCI Shady Grove or Bethesda campus with participants and three virtual chats; identifies specific needs to tailor individual’s progress.

Weeks 15-28 The NCI and Contractor review and edit the draft for second half of course; finalize second half of course materials; Contractor conducts one half-day workshop and three virtual chats at NCI Shady Grove campus.

Weeks 29-32 The NCI Technical Point of Contact and participants evaluate Contractor and program; by survey described above. Contractor prepares a report delivered electronically on participant’s growth and projected future needs. A Survey is also prepared and administered.

Weeks 32-45 The NCI Technical Point of Contact and Contractor discuss program revision using report information and participant’s evaluation survey results. This discussion will occur virtually.

9.0 PAYMENT

Payment shall be made upon receipt and acceptance of all deliverables. Payment authorization requires submission and approval of invoices to the COR and NIH OFM, in accordance with the payment provisions listed below:

The following clause is applicable to all Purchase Orders, Task or Delivery Orders, and Blanket Purchase Agreement (BPA) Calls: PROMPT PAYMENT (JAN 2017) FAR 52.232-25. Highlights of this clause and NIH implementation requirements follow:

INVOICE REQUIREMENTS

An invoice is the Contractor's bill or written request for payment under the contract for supplies delivered or services performed. A proper invoice is an "Original" which must include the items listed in subdivisions 1 through 12, below, in addition to the requirements of FAR 32.9. If the invoice does not comply with these requirements, the Contractor will be notified of the defect within 7 days after the date the designated billing office received the invoice (3 days for meat, meat food products, or fish, and 5 days for perishable agricultural commodities, dairy products, edible fats or oils) with a statement of the reasons why it is not a proper invoice. (See exceptions under II., below.) Untimely notification will be taken into account in the computation of any interest penalty owed the Contractor.

Vendor/Contractor: Name, Address, Point of Contact for the invoice (Name, title, telephone number, e-mail and mailing address of point of contact).

Remit-to address (Name and complete mailing address to send payment).

Remittance name must match exactly with name on original order/contract. If the Remittance name differs from the Legal Business Name, then both names must appear on the invoice.

Invoice date.

Unique invoice #s for all invoices per vendor regardless of site.

NBS document number formats must be included for awards created in the NBS: Contract Number; Purchase Order Number; Task or Delivery Order Number and Source Award Number (e.g., Indefinite Delivery Contract number; General Services Administration number); or, BPA Call Number and BPA Parent Award Number.

Data Universal Numbering System (DUNS) or DUNS + 4 as registered in the Central Contractor Registration (CCR).

Federal Taxpayer Identification Number (TIN). In those exceptional cases where a contractor does not have a DUNS number or TIN, a Vendor Identification Number (VIN) must be referenced on the invoice. The VIN is the number that appears after the contractor’s name on the face page of the award document.

Identify that payment is to be made using a three-way match.

Description of supplies/services that match the description on the award, by line billed.* Freight or delivery charge must be billed as shown on the award. If it is included in the item price do not bill it separately. If identified in the award as a separate line item, it must be billed separately.

Quantity, Unit of Measure, Unit Price, Extended Price of supplies delivered or services performed, as applicable, and that match the line items specified in the award.*

* NOTE: If your invoice must differ from the line items on the award, please contact the Contracting Officer before submitting the invoice. A modification to the order or contract may be needed before the invoice can be submitted and paid.

Shipping costs will be reimbursed only if authorized by the Contract/Purchase Order. If authorized, shipping costs must be itemized. Where shipping costs exceed $100, the invoice must be supported by a bill of lading or a paid carrier's receipt.

Effective April 1, 2020, all NIH contractors/vendors invoices should be sent electronically via email to the NIH Office of Financial Management (OFM) and the NIH Contracting Officer (CO) using the electronic submission instructions outlined below.

This section shall remain in effect until the Government formally notifies the Contractor of a return to mail-in invoice procedures.

II. ELECTRONIC INVOICING INSTRUCTIONS

To All National Institutes of Health (NIH) Contractors/Vendors:

This notification is effective on Wednesday April 1, 2020.

The current national emergency and the need to protect Federal and Contractor staff has resulted in a change to NIH’s invoice submission process. Effective Wednesday, April 1, 2020, all NIH contractors/vendors invoices should be sent electronically via email to the NIH Office of Financial Management (OFM) and the NIH Contracting Officer (CO) using the below electronic submission instructions.

On March 30, 2020, Governor Hogan issued a stay-at-home order for the state of Maryland where residents should not leave their homes unless it is for an essential purpose. Stay-at-home orders were also issued by the state of Virginia and the District of Columbia. Therefore, any mailed contractor/vendor invoices will be processed by NIH; however, significant delays are expected due to staff teleworking and complying with the stay-at-home orders. It is important that NIH contractors/vendors follow the below procedures in order to ensure smooth processing of invoices and timely payment.

Contractor/Vendor Electronic Invoice Submission to the Office of Financial Management (OFM):

Send the invoice to the NIH centralized invoice email box: invoicing@nih.gov Follow the below format in the email subject line, which is a must (Note: The keywords and separating bars in bold must be present to identify the information.)

Vendor: name of the contractor/vendor|PO: Contract Number/Task Order Number|Invoice:9999999 Ensure that the body of the email and attached invoice must both include the contractor/vendor’s correspondence email address in the below format (bolded information must be present to identify information):

Follow the system size limits that apply to the email and each invoice: individual email attachments cannot exceed 5 megabytes each; and the email plus all attachments cannot exceed a total of 30 megabytes.
Clearly identify a valid and complete contract number on each invoice
Clearly identify a valid and complete order number on each invoice
Clearly identify an accurate DUNS number on each invoice
Not include confidential information such as Social Security Numbers (do not include TIN if it is a Social Security Number)
Send one (1) invoice per email

The date/time that a valid invoice is submitted electronically to the email box (invoicing@nih.gov) will be the same date/time logged as that the invoice is received by NIH.

Please do not hand-deliver invoices to any NIH office. Please follow the above electronic submission instructions until further notice. In addition, please note that your contract or order will not be modified to reflect the above changes to the invoicing instructions. Failure to follow the above electronic submission instructions may result in invoice processing delays.

Inquiries regarding the status of invoices such as receipt of invoices, due date, or payment of invoices should be directed to the OFM Commercial Accounts Branch, Customer Service Office at 301-496-6088. The office is open Monday-Friday from 8:30 am to 4:30 pm (eastern prevailing time). The Customer Service Office is closed daily between 12:00 pm to 1:00 pm (eastern prevailing time).

III. INVOICE PAYMENT

Except as indicated in paragraph B., below, the due date for making invoice payments by the designated payment office shall be the later of the following two events:

1. The 30th day after the designated billing office has received a proper invoice.

2. The 30th day after Government acceptance of supplies delivered or services performed.

B. The due date for making invoice payments for meat and meat food products, perishable agricultural commodities, dairy products, and edible fats or oils, shall be in accordance with the Prompt Payment Act, as amended.

IV. INTEREST PENALTIES

A. An interest penalty shall be paid automatically, if payment is not made by the due date and the conditions listed below are met, if applicable.

1. A proper invoice was received by the designated billing office.

2. A receiving report or other Government documentation authorizing payment was processed and there was no disagreement over quantity, quality, or contractor compliance with a term or condition.

3. In the case of a final invoice for any balance of funds due the contractor for supplies delivered or services performed, the amount was not subject to further settlement actions between the Government and the Contractor.

Determination of interest and penalties due will be made in accordance with the provisions of the Prompt Payment Act, as amended, the Contract Disputes Act, and regulations issued by the Office of Management and Budget.

V. PROVIDING ACCELERATED PAYMENT TO SMALL BUSINESS

SUBCONTRACTORS, FAR 52.232-40 (DEC 2013)

Upon receipt of accelerated payments from the Government, the Contractor shall make accelerated payments to its small business subcontractors under this contract, to the maximum extent practicable and prior to when such payment is otherwise required under the applicable contract or subcontract, after receipt of a proper invoice and all other required documentation from the small business subcontractor.

The acceleration of payments under this clause does not provide any new rights under the prompt Payment Act.

Include the substance of this clause, include this paragraph c, in all subcontracts with small business concerns, including subcontracts with small business concerns for the acquisition of commercial items.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

FAR 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

FAR 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 15 days of contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 months.

52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment.

As prescribed in 4.2105(a), insert the following provision:

Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (Aug 2020) The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.

(a) Definitions. As used in this provision— Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to— (i)Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or (ii)Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to— (i)Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or (ii)Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(d) Representation. The Offeror represents that— (1)It □ will, □ will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds “will” in paragraph (d)(1) of this section; and (2)After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that— It □ does, □ does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds “does” in paragraph (d)(2) of this section.

(e) Disclosures.

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded “will” in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:

(i)For covered equipment— (A)The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B)A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and (C)Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii)For covered services— (A)If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or (B)If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded “does” in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

6.0 GENERAL SUBMISSION INSTRUCTIONS

The purchase order will be awarded to the vendor with Lowest Price Technically Acceptable (LPTA) quote. The technical evaluation will be a determination based on information furnished by the vendor in the quote. The Government is not responsible for locating or securing any information which is not identified in the quote. The Government reserves the right to make an award without discussions.

Your quote must stipulate that it is predicated upon all the terms and conditions of this RFQ and signed by an official authorized to bind your organization. In addition, it must contain a statement to the effect that it is firm for a period of at least 60 days from the date of receipt thereof by the Government.

This RFQ does not commit the Government to pay any of the costs associated with the preparation and submission of your quote. In addition, the Contracting Officer is the only individual authorized to legally commit the Government to the expenditure of public funds in connection with this requirement. By submitting a quote in response to this solicitation, it is understood that your quote shall become a part of the official contract file.

Furthermore, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options shall not obligate the Government to exercise the option(s). As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the quoter’s final option period price to the quoter’s total price. Thus, the quoter’s total price for the purpose of evaluation will include the base period, option period 1, option period 2, option period 3, option period 4, and 1/2 of option period 4.
