Combined Synopsis/Solicitation:

This is a combined synopsis/solicitation for commercial items in accordance with Federal

Acquisition Regulation (FAR) part 12.6 – Streamlined Procedures for Evaluation and

Solicitation for Commercial Items as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Solicitation Number is

75F40121Q00089 is issued as a Request for Quote (RFQ) in accordance with FAR Part

12.

This solicitation incorporates all mandatory commercial item provisions and clauses that are in effect through Federal Acquisition Circular (FAC) 221-05, effective March 10, 2021.

The North American Industry Classification System (NAICS) Code is 432490 - Other

Professional Equipment and Supplies Merchant Wholesalers. The Small Business Size

Standard is 150 employees. This requirement is solicited as a Total Small Business Set-

Aside.

It is responsibility of the Offeror to be familiar with the applicable clauses and provisions of this solicitation. The clauses and provisions may be accessed in full text at www.acquisition.gov .

The Government anticipates awarding one (1) firm fixed price purchase order resulting from this solicitation.

Background

During 2020, the FDA mycotoxin analysis program standardization and harmonization committee implemented a new analytical approach to monitor mycotoxins in human and animal food. Mycotoxin analysis is concerned with determination of potentially harmful mold-growth products in a wide variety of food products. The analytical method involves concurrent analysis of twelve mold-growth products. One of the new analytical criteria for this analysis requires all FDA laboratories performing this analysis to have the same or comparable model of liquid chromatographic/tandem mass spectrometer

(LCMS). This requirement is CRITICAL since LCMS having different internal technological characteristics and structures that produce significantly different results.

Objectives

PNL desires to use the requested liquid chromatograph equipment to interface with an existing Sciex QTRAP 4500 mass spectrometric system for use in the FDA mycotoxin monitoring program. This purchase will effectively double the laboratory’s capacity to analyze mycotoxin samples using the prescribed FDA Chemical Analytical Method C-

003.01.

Scope

The Pacific Northwest Laboratory expects to utilize the requested equipment to bring an existing Sciex QTRAP 4500mass spectrometric system to analyze human and animal food using FDA Chemical Analytical Method C-003.01.

Tasks

Minimum Technical Specifications

Critical performance specifications include components that meet or exceed the specifications and capabilities of the Sciex Exion LC AD system.

Critical Requirements

• Ultra High-Performance Liquid Chromatography (UHPLC) system must interface and communicate with each individual module and with the government owned

Sciex 4500 QTRAP mass spectrometer. The UHPLC system must include the following modules:

Controller module

▪ Communicate and interface with all modules within the UHPLC system

▪ Communicate and interface with Sciex 4500 QTRAP mass spectrometer

▪ Communicate and interface with Sciex OS and Analyst software

Degasser module

▪ Capable of degassing up to 5 lines

• Includes no computer or printer as the interface control of this UHPLC system will be through the government owned Sciex 4500 QTRAP mass spectrometer’s computer and its installed Sciex OS and Analyst software.

• Includes instrument set up, installation, and connection to government owned

Sciex 4500 QTRAP mass spectrometer is required.

Trade and Service Specifications

1. The instruments must be a newly manufactured unit, not used and refurbished or previously used for demonstration.

2. Delivered Place Unloaded (DPU) to include inside delivery and clean-up of area after installation.

3. The entire system must be warranted for parts and labor for 12 months from the date of formal government acceptance. The vendor must also be capable of servicing the instrument through the covered warranty period. The system must include at least a one (1) year warranty and shall include at a minimum: coverage on all non-consumable items and parts supplied including base instrument, factory-certified replacement parts, engineer labor and travel costs. Any equipment repair, and maintenance work shall be performed by an OEM-trained engineer. This factory-trained engineer shall have (verified by the OEM) the following: 1) access to OEM factory telephone support; 2) access to the most current OEM factory training for both hardware and software components; and 3) access to all current OEM factory parts, not build-to-order parts. The OEM-trained service engineer shall not use salvaged parts from other instruments for performing maintenance and repairs. All parts used in PM and repairs must be guaranteed, factory-tested, OEM quality parts.

4. Instrument operators shall have access to a technical representative call center at no additional charge, for technical assistance and troubleshooting, which is staffed by senior engineers to provide a high level of expertise for troubleshooting the instrument.

5. Preventative maintenance (PM) visit shall be included for the base contract year.

This visit shall be inclusive of all parts, labors, travel, consumables, and supplies which are necessary to complete the OEM’s suggested PM protocol. Service engineers which perform this service shall trained by the OEM.

6. Sufficient familiarization training for 3-5 users per delivery onsite location will be provided at time of installation or shortly thereafter (within 30 days), such that operators may independently operate the instrument and with increased familiarity and proficiency. The training shall include manuals and any consumables to be used during training.

7. The Contractor shall provide installation qualification with an employee who can provide proof of installation qualification/Operation qualification (IQ/OQ) certification.

Records and Reports

The Contractor shall, commensurate with the completion of each service call

(inclusive of warranty service), provide the end-user of the equipment with a copy of a field service report/ticket identifying the equipment name, manufacturer, model number, and serial number of the equipment being serviced/repaired and detailing the reason for the service call, a detailed description of the work performed, the test instruments or other equipment used to affect the repair or otherwise perform the service, the name(s) and contact information of the technician who performed the repair/service, and for information purposes, the on-site hours expended and parts/components replaced. In addition, the

Contractor shall provide monthly reports to the FDA PROJECT OFFICER and

Contract Specialist, not later that the 5th work day following the end of each month, summarizing all maintenance and repair activities (including warranty work) for the previous month (during months that work is performed).

The Contractor shall provide the Contracting Officer’s Representative (COR), Office of

Regulatory Support (ORS) Subject Matter Expert (SME), and the Division of Field

Administration (DFA) administrative staff with at least one (1) week’s written notice prior to delivery. Contractor shall coordinate with Delivery Order Technical Point of

Contact when scheduling delivery date. When vendor representatives/shipping company arrive on site to deliver the items, they will need to provide valid U.S. photo identification to check-in with the on-site Security Guards to enter the premises.

Delivery shall occur (Monday – Friday) between the times of 8:00 AM – 4:00 PM, excluding Federal holidays or Federal Closures. If vendor representatives arrive on site to deliver / install equipment, they will need to provide proper U.S. photo identification to check-in with the Federal Protective Service (FPS) Security

Guards in order to enter the building. The vendor representatives will receive an “Escort

Required” temporary badge, which must always be worn in the building and will remain escorted by lab personnel during their visit. If vendors need to enter the laboratory, safety glasses must be worn. When their work is complete, the vendor representatives will provide the lab personnel a work order or service receipt detailing the requirements of the visit. The vendor representatives will check-out with the same FPS Security Guards, turning in their temporary badge. Tobacco, of any form, and e-cigarettes are not permitted on Federal Property, in Federal Buildings or parking lots.

Government-Furnished Property, Material, Equipment, or Information (GFP, GFM, GFE, or GFI)

The Government will not provide any equipment to the Contractor.

Security

No confidential, sensitive or PII information are generated by this equipment. No confidential, sensitive or PII information are generated or stored on the scientific computer.

This component contains no Information Technology hardware or software. It will connect to an existing system that meets all government security requirements.

Travel

Contractor shall be responsible for all travel necessary to complete the requirements of this award.

Special Material Requirements

There are no special material requirements associated with this purchase.

Other Unique Requirements

Beyond the instrument’s characteristics, there are no additional unique requirements associated with this purchase.

Period of Performance

The Period of Performance begins the date of contract award execution and continues for one year (or longer depending on how long the OEM offered warranty period is) from the date of formal government acceptance.

The following addenda is applicable:

Paragraph (b)(4) Technical capability will be determined by review of information submitted by the offeror which must provide sufficient technical information for the Government to conclusively determine that the offered meets or exceeds the technical requirements identified above. In addition to identifying manufacturer, make, and model of offered products it is incumbent of offerors that they unequivocally demonstrate that offered products meet the requirements herein through the submission of technical specifications, descriptive material, scientific literature, brochures, scientific publications where proposed solution has been used for same or similar purposes, and other information which demonstrates the capability of the offered instrument. Offerors shall address the technical requirements identified above, as well as detailed information on the items in the solicitation.

52.212-2 Evaluation – Commercial Items (Oct 2014)

The Government will award a contract resulting from this solicitation to the lowest priced technically acceptable responsible offeror. Offerors will be evaluated on their ability to meet the requirements herein. The lowest priced offer will be evaluated first. If the lowest priced offeror is not technically acceptable, then the next lowest priced offer will be evaluated and so on until a technically acceptable offer is determined.

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management

(SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v)) of this provision.

(a) Definitions. As used in this provision—

"Covered telecommunications equipment or services" has the meaning provided in the clause

52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance

Services or Equipment.

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13

CFR part 127. It automatically qualifies as a women-owned small business eligible under the

WOSB Program.

Forced or indentured child labor means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following:

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

Reasonable inquiry has the meaning provided in the clause 52.204-25, Prohibition on

Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets

Service-disabled veteran-owned small business concern—

Small business concern—

Subsidiary means an entity in which more than 50 percent of the entity is owned—

Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term "successor" does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

Veteran-owned small business concern means a small business concern—

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38

U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.

In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples. (A) The taxpayer has received a statutory notice of deficiency, under

I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency.

This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax

Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C.

§6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).

(i) Certification Regarding Knowledge of Child Labor for Listed End Products (Executive

Order 13126). [The Contracting Officer must list in paragraph (i)(1) any end products being acquired under this solicitation that are included in the List of Products Requiring Contractor

(iii) Each service employee who will perform the services under the contract will spend only a small portion of his or her time (a monthly average of less than 20 percent of the available hours on an annualized basis, or less than 20 percent of available hours during the contract period if the contract period is less than a month) servicing the Government contract;

(iv) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract is the same as that used for these employees and equivalent employees servicing commercial customers.

(3) If paragraph (k)(1) or (k)(2) of this clause applies–

(i) If the offeror does not certify to the conditions in paragraph (k)(1) or (k)(2) and the

Contracting Officer did not attach a Service Contract Labor Standards wage determination to the solicitation, the offeror shall notify the Contracting Officer as soon as possible; and

(ii) The Contracting Officer may not make an award to the offeror if the offeror fails to execute the certification in paragraph (k)(1) or (k)(2) of this clause or to contact the Contracting

Officer as required in paragraph (k)(3)(i) of this clause.

(l) Taxpayer Identification Number (TIN) ( 26 U.S.C. 6109, 31 U.S.C. 7701). (Not applicable if the offeror is required to provide this information to the SAM to be eligible for award.)
