SECTION B: SUPPLIES OR SERVICES AND PRICES/COSTS

B.1 GENERAL

The commercial services being acquired shall be performed, respectively, in accordance with all sections of the contract.

B.2 ORDER TYPES

This requirement is for an Indefinite Delivery, Indefinite Quantity (IDIQ) Firm Fixed Price Commercial Items Services contract for Marbled Murrelet surveys in the Bureau of Land Management (BLM) Northwest Oregon District Area of Responsibility which includes the following field offices: Mary’s Peak, Tillamook, and Siuslaw. This IDIQ contract contains a one-year base period plus four (4) one-year option periods.

The minimum guarantee for this IDIQ contract is $10,000.00. The minimum guarantee may be satisfied by one (1) task order or the cumulative value of multiple task orders and/or modifications.

The contractor shall perform the effort required by this contract on a Firm Fixed Price (FFP) basis for Contract Line Item Numbers (CLIN) 0001-0005 (Base Period); 1001-1005 (Option Period 1); 2001-2005 (Option Period 2); 3001-3005 (Option Period 3); and 4001-4005 (Option Period 4). The BLM will only pay for actual work that has been completed and accepted by the COR.

IMPORTANT:

The Contracting Officer (CO) is the only person authorized to approve changes in any of the requirements of this contract and notwithstanding provisions contained elsewhere in this contract, the said authority remains solely with the CO. In the event the contractor affects any change at the direction of any person other than the CO, the change will be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in charges incurred as a result thereof.

SECTION C: DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1.0 GENERAL

C.1.1 Description of Work, Objectives, and Methods

A. The Contractor shall conduct surveys to locate Marbled Murrelets (Brachyramphus marmoratus) from survey stations within designated survey sites on Bureau of Land Management lands within the Northwest Oregon District (See Section J Attachment -1 Survey Vicinity Map). The objective is to document the occurrence or probable absence of the Marbled Murrelet in forest stands by conducting intensive surveys in accordance with a BLM approved protocol, which currently is the Pacific Seabird Group (PSG) Protocol, Methods for surveying Marbled Murrelet in forests: A revised protocol for land management and research, 6 January 2003, available at:

http://www.pacificseabirdgroup.org/publications/PSG_TechPub2_MAMU_ISP.pdf The implementation of any alternate or updated survey protocol must be approved of by the Contracting Officer’s Representative (COR).

B. The Contractor shall conduct and complete all station set-up, survey visits, and surveyor training/testing in accordance with the applicable protocol. Station set up will entail locating new stations in a survey area, or re-visiting stations established during previous surveys. Stations shall meet the standards in the approved protocol, independently and throughout the entire survey area. Each station shall be set, or re-set, once annually. All personnel, including without limitation, crew leaders and Marbled Murrelet surveyors, shall meet the minimum qualifications in order to perform work under this contract. The Contractor shall determine coordinate locations (Universal Transverse Mercator, Zone 10, NAD-1983) for each survey station using a Global Positioning System (GPS) device.

The Contractor shall collect, record, and report data, observed behaviors, and nesting activities on all audio and visual Marbled Murrelet detections.

C. The Contractor shall conduct all survey visits during the marbled murrelet Survey Season (between May 1 and August 5). The COR may approve an extension of the survey season at sites where murrelet presence has been documented. The Contractor shall be required to conduct surveys during and outside daylight hours, including hours before and after sunrise. Special conditions (described on pages 19 and 20 of the PSG 2003 protocol) may trigger the need for additional surveys beyond the number BLM anticipates at the initiation of the survey season, including without limitation, Marbled Murrelet presence or poor environmental conditions. Additional surveys (equivalent to approximately 10% above the minimum surveys anticipated at the initiation of the survey season) may be needed to accommodate situations such as adverse environmental conditions or increased survey load resulting from a Marbled Murrelet detection.

D. The Contractor shall collect data on station set-up, survey visits, and Marbled Murrelet detections and enter the information into the BLM’s Marbled Murrelet database, (Microsoft Access Application), unless an alternate database system is approved by the COR. The Contractor shall provide all original field data forms, a summary report, and database submission in accordance with Section C.5.6 and C.5.7.

E. A list of Bureau-Sensitive Species and other wildlife species of local interest will be furnished by the Government. If the Contractor observes any of the species listed during the course of this work, the Contractor shall record this information and submit it to

BLM.

C.1.2 General Location and Description of Survey Areas

A. Marbled murrelet survey areas are on lands managed by the Northwest Oregon District BLM. Surveys will be conducted within the Mary’s Peak, Tillamook, or Siuslaw Field Office lands with specific maps of each survey area (as subdivided into survey sites) to be provided prior to start of field season.

B. Survey area boundaries will not be physically identified on the ground. Most boundaries will require interpretation of physical features on aerial photos, topographic maps, or as represented on digital mapping devices.

C. The Contracting Officer’s Representative (COR) may substitute survey stations from within the same travel vicinity during the survey season, as BLM planning objectives may change.

C.1.3 Travel and Access.

A. Most survey areas are accessible by roads passable with a 4-wheel drive vehicle (2-wheel drive for most sites). Survey Stations may be located along roads, established trails, or flagged paths that require overland hiking. Much of the terrain is steep, covered with dense vegetation, and can be difficult to walk through. Walk-in routes to station locations will generally be less than 0.5 miles, but some survey sites may require walk-ins of up to

1.0 mile (1-way) due to blocked roads or road-less areas. Temporary access problems (e.g., blocked road, inaccessible gate) may result in a hike-in of longer than 1.0 miles for which the Contractor may decline to complete the survey visit until access is restored or may request a reasonable price adjustment for hiking in to complete the survey.

B. The BLM does not guarantee nearby road access to all survey areas. Roads closed due to natural occurrences may not be reopened or maintained solely for the purposes of providing access for the Contractor. Some roads may be accessible only by foot because of vegetation or road closure.

C. Private Lands. Due to mixed land ownership, travel through private lands is typically needed to access BLM lands. As a result, access may be restricted through private lands and may include locked and unlocked gates, access agreements, and notification requirements. Private landowners may require any or all of the following: notification prior to crossing their lands, a gate key deposit, and/or an access agreement. The BLM will facilitate contact and discussions in advance between private landowners and the Contractor to secure and maintain access through private lands. Contractor is responsible for following all terms of the agreement.

D. Gates - Some areas and roads may be behind locked gates. Locked gates shall remain locked at all times other than when the Contractor is passing through them. Access is

ASSIST Acquisition # 47QFAA22K0006 granted only to complete tasks within the scope of this solicitation. One or more keys for accessing BLM controlled gates can be signed out to the Contractor. Any keys provided to Contractor shall be returned to the COR in a usable condition before final payment is made annually. The Contractor shall be charged $100.00 for each key lost or returned in an unusable condition.

E. Traveling on forest roads requires an awareness of potential hazards that may change during the survey season. It is the responsibility of the Contractor to determine local conditions affecting access to each survey site. Adverse weather, logging operations, and hauling traffic are likely to affect access during the course of the survey season.

C.2.0 DEFINITIONS

The definitions contained in the PSG Protocol dated 6 January 2003 at:

http://www.pacificseabirdgroup.org/publications/PSG_TechPub2_MAMU_ISP.pdf are incorporated by reference herein, and shall apply to the terms in this contract, whether such terms are capitalized or not. Certain terms from the PSG protocol are further defined below. If there is any conflict between a defined term in the PSG protocol and the definitions section below, the defined term in the definitions section below shall control.

Additional Surveys - An additional survey visit required because of a non-protocol survey

(definition below), to determine occupancy in a stand, or as needed to clarify site status.

Bureau Sensitive Species – Agency designated sensitive and special status species which, if heard or observed, will be recorded on Wildlife Observation Forms.

Database – A relational database compatible with BLM operating systems in which marbled murrelet survey and detection data shall be entered by the contractor. The BLM database provided under this contract requires Microsoft Access 2016 or newer.

Detection - Visual or audible recognition of one or more Marbled Murrelet or Sensitive Species. Further details pertaining to detections are included in the PSG protocol.

EPE – “Estimated Position Error” is an estimate (in meters) of the horizontal position error of a coordinate location obtained with a GPS unit.

FTP Site: A secure file transfer site, allowing the contractor and COR to exchange large file format information in real time. The COR will provide the contractor with access information to a BLM supported FTP site if needed for data file transfer.

Incomplete Survey - A single survey effort that fails to meet all constraints as outlined in the PSG protocol.

Nest Site - A site with an active nest or evidence of a nest, including eggs, eggshell fragments, or a downy chick.

Non-Protocol Survey - A survey visit that does not meet the daily time constraints in the PSG protocol (begins less than 45 minutes before sunrise and/or ends less than 75 minutes after sunrise) or is conducted during twelve (12) minutes or more of cumulative poor environmental conditions (defined below).

Non-Protocol Site - A survey site that does not meet the constraints outlined in “Protocol Site” below.

Normal BLM Office Hours - Monday through Friday, 8:00 a.m. to 4:30 p.m., excluding holidays.

Occupying Behavior- Marbled Murrelet detection that includes behavior attributed to nesting, such as sub-canopy flight and stationary calling. Further descriptions are available in the PSG Protocol.

Occupied Site – A site where Marbled Murrelet have been observed exhibiting behaviors that strongly indicate that the site has some importance for breeding, such as sub-canopy behaviors. Occupied sites include nest sites.

Platform - A relatively flat surface at least 4 inches (10 cm) in diameter and at least 33 feet (10 m) high in the live crown of a coniferous tree, containing mossy or detritus material suitable for creating a nest cup.

Poor Environmental Conditions - Conditions where a surveyor is unable to hear birds and subtle sounds greater than 200 meters away, and/or is unable to see 100 meters through the canopy opening. Examples are heavy fog, moderate to heavy rain, moderate to high winds, logging equipment, or vehicles. An accumulation (continuous or discontinuous) of twelve minutes or more of poor environmental conditions creates a non-protocol survey and the station will require an additional survey. Additional descriptions of poor environmental conditions can be found in the PSG survey protocol.

Potential Habitat - any younger forested area with a residual tree component, small patches of residual trees, or one or more platforms.

Presence - is a site of potential habitat where there has been a minimum of one visual or auditory Marbled Murrelet detection that does not include occupying behavior (definition below).

Protocol Site - A survey site that meets the number of survey visits, time of year, distribution of visits, and time of day constraints as outlined in the PSG 2003 protocol.

This consists of a minimum of 5 protocol surveys (definition below) for the season, and 9 protocol surveys if Marbled Murrelet presence occurs.

Protocol Survey - A survey that meets the daily time constraints per the PSG 2003 protocol and was conducted with fewer than twelve (12) minutes (cumulative) of poor environmental conditions.

Survey - A single visit to a station for the purposes of determining Marbled Murrelet occupancy, presence, or absence within the stand that meets the requirements of the PSG protocol.

Survey Area - The entire area that is subject to survey observation as described in the Northwest/Coastal Oregon Resource Management Plan. Large Survey Areas (greater than 150 acres) are broken down into smaller Survey Sites as described below.

Survey Season – May 1 through August 5, unless extended by COR for sites with presence detections.

Survey Site – The unit by which survey visits are designed and carried out, and the unit to which the requisite number of visits (5 minimum) applies.

Survey Station - The location where the observer stands when conducting a survey visit.

Stations ideally include a gap in the canopy and have a view of potential nesting platforms. Stations shall target gaps in the canopy and sight-lines of suitable nesting habitat. Descriptions for station set-up and layout are included in the PSG protocol.

C.3.0 CONTRACTOR-FURNISHED PROPERTY AND SERVICES

C.3.1 The Contractor shall furnish all labor, transportation, supervision, tools, equipment, and materials (except those designated as Government-furnished) to perform the work identified in these specifications.

C.3.2. Contractor-furnished items shall, at minimum include, but are not limited to:

A. Recorders - Digital voice recorders, capable of downloading recordings (mp3 format preferred) for file transfer, for each crew member (including batteries) B. Data Forms - Station, survey, and detection field data forms copied onto Rite-in-the-Rain paper (for use in the field), and standard bond paper (for use in the office). Digital copies of the data forms will be provided by the COR.

C. Compass with azimuth settings and correct declination set. Correct declination available at NOAA’s National Geophysical Center: http://www.ngdc.noaa.gov/geomag-web/#declination

D. Clinometers or dendrometer (to estimate tree heights during station set-up).

E. Binoculars.

F. Digital time piece.

G. Head lamps and flashlights H. Machetes or appropriate brushing tools.

I. Flagging – Pink with black stripes to mark stations, white to mark trails and trailheads.

J. Reflective Tape - Weatherproof, self-adhesive highly-reflective tape to mark stations and/or trail-heads along roads.

K. Black grease pencils for writing on flagging.

L. GPS unit – A dedicated GP unit or sufficiently accurate mobile device that is capable of locating UTM coordinates within 20 meters or less, including when under heavy tree cover.

M. Computer hardware, and software capable of creating and editing Microsoft Office file types (2010 version or later), including Excel Spreadsheets and Access Databases.

N. Camera or mobile device sufficient to take photos to verify survey site visit.

C.3.3 Survey Crew Requirements A. The Contractor shall maintain an adequately skilled work force (as described below) to ensure timely completion of the work. Before or at the pre-work conference, the Contractor shall appoint a crew leader(s) and provide a specific work schedule to the

COR.

B. Only the Contractor/ Crew Leader(s) (or an alternate person previously designated by the Contractor) shall communicate with the CO or COR.

C. Crew Leader(s).

1). The crew leader shall have the qualifications and experience needed to conduct surveys and direct the crew in the following activities: (1) ensuring that all crew http://www.ngdc.noaa.gov/geomag-web/#declination http://www.ngdc.noaa.gov/geomag-web/#declination

ASSIST Acquisition # 47QFAA22K0006 members are properly trained and conduct a mid-season refresher training as outlined below; (2) scheduling station set-ups and ensuring they meet protocol specifications;

(3) scheduling surveys and ensuring they meet protocol; and (4) making daily inspections of the crew’s work (which includes, but is not limited to, checking for accurate mapping of station locations and accurate completion of all forms and data sheets required by the Government).

2). The crew leader shall also perform and/or oversee all data entry of survey forms into the BLM Marbled Murrelet database, including quality checking the accuracy of the entered data.

3). The crew leader shall be fluent in English in a way that insures good communication with the COR, Project Inspector, and the survey crew.

4). No more than eight (8) crew members are to be supervised by one crew lead.

D. Murrelet Surveyors – Individual surveyors are crew members that shall meet all PSG protocol qualifications and will be tasked with set-up and reset of survey stations, conducting murrelet surveys, and collecting required data.

C.3.4 Survey Crew Management

A. Key personnel (crew leader) assigned to this contract shall not be removed or replaced without prior approval of the CO. Ultimate approval/disapproval of replacement of key personnel is the responsibility of the CO.

B. The Contractor shall immediately notify the COR when key personnel are unavailable for work under this contract for a continuous period exceeding five field survey days. This pertains to weekdays and excludes weekends. In this event, the Contractor shall immediately replace such personnel with personnel of equal qualifications acceptable to the COR.

C. Training - Before the completion of the first survey, the Contractor shall provide written proof that the crew leaders and all crew members (murrelet surveyors) meet the training and qualifications outlined in PSG Protocol Appendix C. Written proof may consist of a statement from the training course evaluator or any other proof found acceptable to the

D. Hearing Tests - Crew leaders and crew members must also pass a hearing test (0-25 dB Hearing Limit in both ears) as defined in the PSG Protocol Appendix D. Before the completion of the first survey, the contractor must provide the COR with a certification that all crew members and crew leads have passed the hearing test prior to certifying the surveyor.

E. Refresher Surveys – The contractor shall ensure that all crew members complete an annual refresher survey by June 24th, at contractor expense. The refresher survey shall take place at a moderate or high use murrelet site chosen by the Contractor. The COR may recommend sites known to be active in the vicinity. The Contractor must inform the COR of the location and time chosen at least one week before the event occurs. The crew leader is responsible for evaluating crew members in a way that ensures all crew members are able to detect murrelets and distinguish them by sight and sound from other birds present. The COR may request to be present for the refresher survey.

C.4.0 GOVERNMENT PROVIDED ITEMS AND SERVICES.

C.4.1 The Government will provide the following:

A. Maps (paper or digital files) to perform the contract (Transportation Maps, Survey Site Maps, at variable scale). Any substitute maps created by the Contractor for field use shall be approved by the COR. Attachment -2 provides an example of a Survey Site map.

B. Digital copies (PDF file format) of the Oregon BLM Marbled Murrelet survey form.

C. Digital copies (PDF file format) of the Wildlife Observation Form and a list of special status wildlife species to report.

D. BLM Marbled Murrelet Database Application for use with Microsoft Access 2010 or newer software. At the discretion of the government, an alternate database may be substituted.

E. Spatial data files (Shapefiles, GPX, KML format) relevant to completing survey visits

(e.g., Survey Site polygons, Survey Station points) will be made available upon request

F. Keys to BLM gates. A refundable deposit may be required for gate keys, or final payment of end-of-season invoice may be withheld until keys are returned.

G. Access and instructions to a secure BLM FTP site for transferring large data files.

C.4.2 All Government furnished property will remain property of the Government.

C.4.3 Contractor shall be liable for all loss or damage of Government-furnished property until completion and final acceptance of work required under this contract. All items will be available from the COR at their BLM office location during normal BLM business hours (generally 8AM to 4:30PM Pacific Standard Time. Notify the COR two business days prior to picking up supplies.

C.5.0 SPECIFIC TASKS

C.5.1 Work Schedule

A. The Contractor shall obtain approval for sequence of work from the COR prior to beginning work. Certain survey areas or portions of survey areas may be designated by the COR as higher priority. At pre-work meeting when the BLM reviews the list of Survey Sites that require visits, the COR may choose to prioritize that survey start first at some sites rather than others because the BLM requires to have those sites complete the seasonal surveys as soon as possible

B. A minimum of 25 percent of survey stations, by survey area, shall be set up and approved by the COR by May 1 (if a task order includes this item). The rest of the stations must be submitted at least 2 weeks prior to the scheduled survey, allowing time for the COR to review and approve them (with changes as the COR may require) prior to the survey date.

C. All stations and the order in which the stations are surveyed shall be approved by the

D. The Contractor may request to substitute survey stations as BLM’s planning objectives change. However, the Contractor shall obtain approval from the COR prior to making any substitutions.

C.5.2 Survey Schedule

A. Before the start of the survey season, the contractor shall provide the COR with a survey schedule for all survey sites for at least the first month of the survey season. The survey schedule shall comply with the PSG protocol for daily timing and spacing requirements.

B. All survey sites will receive a first survey within three weeks of the beginning of the survey season, unless an alternate starting schedule is approved by the COR.

C. At least 2 of the 5 minimum visits (using a 5-visit stopping rule) shall occur after 30 June but before July 18, unless an alternate schedule is approved by the COR, with an effort to avoid clustering these two visits in the first week of July.

D. Every Monday during the survey season, the Contractor shall provide a summary of daily activities from the previous week and scanned copies of completed data forms from the previous week as described in Section C.5.6. Documents shall be submitted to the COR via FTP file upload, unless other arrangements have been approved of by the COR.

E. Each Monday, one full week prior to planned survey work, Contractor shall provide the COR with a schedule of the murrelet surveys planned for the following week (if not previously provided). For example, surveys scheduled for the week of June 13th –17th, 2022 would be due to the COR by Monday, June 6th, 2022). Changes to the survey schedule will be reported to the COR a minimum of 24 hours before the change is to occur.

F. If new survey stations are necessary, then Station Information Forms will be completed (see Section C.5.6, and Attachment-4) and a map of the station with its trail shall be e-mailed to BLM one week prior to that station being surveyed (e.g., form for stations to be surveyed on a Monday will be received by close of business the prior Monday). This will allow BLM personnel adequate time to inspect the station and contract personnel adequate time to move the station should the station not pass inspection.

C.5.3 Survey Protocol

A. Survey sites and stations shall be set up and surveyed for Marbled Murrelet in strict compliance with the techniques detailed in the PSG Protocol. The Government may choose to set up and reset some or all of the survey stations used during the survey season.

B. Each Survey Site shall be surveyed according to the PSG 2003 protocol, which requires a minimum of five (5) surveys per year. If Marbled Murrelet are detected at a site, surveys will increase to nine (9) for the survey season. In the case of an occupying detection, the

COR will notify the Contractor about sites or portions of sites that no longer require surveys. The BLM’s new occupied site delineation direction differs from the PSG direction and may require continued surveys in portions of a survey site after an occupying detection. The COR may also request additional surveys to clarify earlier detections and the COR may extend the survey season beyond August 5th in order to complete all 9 surveys at sites with detections.

C. All Station Information forms shall be completed digitally (scanned forms) and submitted via email one week prior, in the format required and provided by BLM. Survey and Detection Forms may be completed by hand.

C.5.4 Station Set-up and Station Reset

A. Prior to initiating surveys at a survey site, some or all of the survey stations may need to be set-up as new stations or be reset (previously used survey stations). Any newly established stations will utilize station numbering system provided by the COR to prevent duplicate station numbers.

B. The entire survey site shall be “covered” as defined in the PSG protocol. Government provided maps will include previous survey station locations that shall be checked in the field by the contractor to ensure topography or vegetation does not interfere with full visual and audio coverage of all potential habitats. The highest quality habitat within each site shall have the highest priority for a station set-up.

C. To help in observing occupied behaviors, any newly established stations shall be set within the stand unless otherwise approved by the COR. Stations shall be in drainages, rather than on ridge-tops, whenever possible. This may require surveying stations during dry periods to reduce the interference from stream noise. The Contractor shall be required to set-up these stations in areas with good visibility of the sky (i.e., canopy openings) and away from high noise sources, as outlined in the PSG protocol.

D. Trails to all new or reset stations shall be well flagged by the contractor using a color approved by COR. Trails shall be cleared using an appropriate hand tool to ensure that surveyors and project inspectors can safely and easily find stations in the dark. This requires 3 to 4 feet of flagging placed at intervals as little as 5 feet apart, especially in areas of heavy brush. Flagging shall be placed on live trees or branches above the reach of browsing animals (deer, elk, and cows) whenever available.

E. All stations shall be flagged in two visible locations. The color of station flagging will be solid white paired with pink and black candy stripe, unless another flagging pattern is approved by the COR. Trailheads shall be marked with 2 white flags. Flags at trailheads and at stations shall have the station number (i.e. #32.03) legibly written on them with a black grease pencil

F. When a trail services more than one station, all trail junctions shall be double flagged in a minimum of two visible locations at the junction. The complete station number shall be written on those four flags and the direction to the stations (i.e. flag #1& #2 might read "left to Stn 07.01 & Stn 07.02" and flag #3 & #4 might read "right to Stn 07.03").

G. To improve locating trailheads at night, they shall be marked with a minimum of 3 inches of weatherproof, self-adhesive reflective tape in two locations visible when driving on the road.

H. All newly established stations or reset stations shall be mapped and GPS’d to within 20 meters of actual. In areas of heavy canopy cover, averaging the position shall be necessary and several attempts may be required, including returning on a different day.

Coordinate locations shall be reported in UTM coordinates (UTM Zone 10, NAD 1983).

I. Information for all newly established or reset stations shall be recorded on the government provided Station Information Form (see Section C.5.6, Attachment-4), and submitted to the COR via email at least 7 days prior to scheduling a survey visit to allow for government inspection and approval.

C.5.5 Survey Visits

A. Surveys are required to begin 45 minutes before sunrise and continue until 75 minutes after sunrise. Staying at the survey station beyond 75 minutes may be appropriate if murrelet activity continues. The surveyor is required to be at the station prior to survey start time. The nearest town for calculating sunrise and start times shall be furnished by the COR, prior to the start of the survey season. Reliable sources for sunrise times include: http://aa.usno.navy.mil/data/index.php or NOAA Solar Calculator).

B. At each Survey Site, intensive surveys shall be conducted by listening for vocalizations and visual observation of marbled murrelets. All surveys will be conducted from a standing position only, unless safety dictates otherwise (e.g., if the station requires standing on a log to achieve the best visibility, sitting would be acceptable). At no time is lying down acceptable during the official survey period.

C. The date and surveyor’s initials shall be marked on station flagging when the station is surveyed. A black grease pencil shall be used to mark the flagging.

D. Surveys shall be conducted during weather conditions meeting protocol standards. An accumulation of twelve (12) minutes or more of poor environmental conditions create a non-protocol survey and an additional survey is required. Since establishing murrelet occupancy under these conditions is still possible, surveys are to be completed for the minimum time as outlined in the protocol (except when conditions are extremely hazardous, i.e., high winds). For example, when conditions are poor and the minimum time is met but an additional survey is required, the BLM will pay for 2 visits.

E. All survey visit data and detection information shall be recorded on the government provided Marbled Murrelet Forest Survey Form (see Section C.5.6, and Attachment-3), unless other arrangements are authorized by the COR. A Survey Site map (see example Attachment-2) can be used to map any marbled murrelet detections.

F. The Contractor will ensure that surveyors follow best practices for documenting that each survey visit is conducted at the correct surveyor station location and at the correct time in accordance with the PSG protocol. The Contractor shall include at a minimum:

1). Capture a GPS location (UTM coordinates with mobile device, or dedicated GPS unit) to document time and location at arrival and departure from the correct survey station.

2). Retain and submit (C.5.2 Weekly Submission) digital voice recording (MP3 audio file) of each survey effort (with date, time, weather, murrelet detection notes, notable bird songs, etc).

3). Capture a time-stamped digital image (cell phone sufficient) of surveyor’s initialed flagging at survey station immediately after flagging is initialed.

G. The marbled murrelet is listed by the U.S. Fish and Wildlife Service as a “threatened species.” The contractor shall not divulge (and shall take all reasonable steps to ensure that no employee or subcontractor divulges) information on specific marbled murrelet sites or locations to any person, other than the duly authorized representative of the BLM.

C.5.6 Reports

A. Murrelet Detection Notification – During the survey season, the Contractor shall notify the COR of any visual or auditory Marbled Murrelet detections within 24 hours. The notification shall consist of an email. The following information needs to be transmitted to the COR:

1). Date.

2). Initial Detection Time.

3). Name of Observer.

4). Station Identification number.

5). Total number of detections and Behaviors observed.

6). Location of behaviors, relative to the survey station.

B. Daily Log – A daily activity log of all station set-ups and all surveys shall be maintained by the Contractor. This log shall include date, station numbers, station UTMs (station coordinates), the name of persons setting up or surveying, a description of that day’s weather, notes about all visibility and hearing problems at the station, notes about the quality of the habitat, any Marbled Murrelet detection(s) seen or heard, whether the survey met protocol, and any other information that may be of significance.

C. Weekly reporting package will contain any station information forms, survey forms, survey detection maps, daily activity summary, and survey schedule updates.

Supplementary survey documentation products, as described in Section C.5.5.F, will be provided with the weekly reporting package, unless the COR approves an alternate submission plan.

D. Survey Station Form – For each station set-up or reset, a Station Information - Data Entry Form (Attachment-4) shall be completed electronically and delivered or emailed to the COR. The form shall include clear and accurate directions and mileages to the station trail head and a topographic map of the station’s location. In addition, each station’s coordinate location (UTMs), slope position, station placement, distance to edge, estimated canopy cover, and canopy height shall be included on the form.

E. Marbled Murrelet Survey Form (Oregon) – For each protocol and non-protocol survey, a Marbled Murrelet Survey Form (Attachment-3) shall be completed. This is a standard

ASSIST Acquisition # 47QFAA22K0006 from used across the state of Oregon. For all survey visits with Marbled Murrelet detections, the Survey Form shall include a map of detections. Directions for completing the map are found in Appendix G of the PSG protocol under “Mapping Marbled Murrelet Detections.”

F. Wildlife Observation Form – All BLM Bureau Sensitive Species (list provided at pre-work meeting) shall be recorded on Wildlife Observation Forms (Attachment-5).

Additionally, if a bald eagle, golden eagle, peregrine falcon, northern goshawk, northern spotted owl, hybrid spotted-barred owl, or great gray owl is detected the COR shall be notified (by phone message or email) within 24 hours of the detection; detection of other Bureau Sensitive Species shall be reported to the COR during the weekly data submissions.

C.5.7 Reporting Requirements

A. Weekly reporting package will be provided to the COR as described in C.5.2 and C.5.6.C. All data forms provided to the government shall be reviewed and initialed by the Contractor before submission to ensure that they are accurate, complete, and legible. The package of information to be reported can be delivered by BLM File Transfer service or alternate delivery plan approved by the COR. (Example via email (up to 25MB) or cloud access).

B. All original hard copy data forms and maps shall be reproducible on a black and white copy machine. Use black or blue pen only. Digitally stored survey forms and field maps are also acceptable in Adobe PDF format, or an alternate format approved by the COR.

C. Annual Summary Report -- By August 26 a draft of the Annual Summary Report in digital format (MS Word or Adobe PDF format) shall be provided to the COR for review and approval. By September 14, the final version of the Summary Report shall be submitted to the COR. The COR will respond to any remaining documentation deficiencies within 10 days of receiving the final summary report. This report shall include, at a minimum:

1). A cover page with Project Title, Contract Number, Contractor’s Contact Information, and primary author’s name.

2). A brief synopsis of methods used to complete the tasks required by this contract.

This shall include any modifications to methods that may have been approved by the COR.

3). Table of all surveyor’s names, their initials (as used on data forms), date of most recent certification training completed, and date of refresher survey.

4). A narrative description for each survey site to include the number of stations surveyed, survey dates and results, any issues encountered during surveys, and the most significant behavior observed.

5). A map of each murrelet survey site to include each survey station used during the season.

6). Table of all murrelet surveys completed, a determination of which surveys met protocol, and their results (may utilize murrelet database report feature).

D. Data Submission Package – by August 26, the Contractor shall have provided the COR with the final Data Submission Package. This package shall include:

1). A digital version of the Government provided Marbled Murrelet Database into which the Contractor has completed 100% of data entry for Station Information and Marbled Murrelet Forest Survey information that was collected during the survey season.

2). Original copies of all Station Information forms that were completed during the survey season.

3). Original copies and one set of photocopies (or scanned PDF images) of all Marbled Murrelet Forest Survey Forms that were completed during the survey season.

4). Original copies and one set of photocopies (or scanned PDF images) of all murrelet detection maps that accompany the Marbled Murrelet Forest Survey Forms.

5). Original copies of any Special Status Species Observation forms that were completed during the survey season

6). A full set of all survey documentation products as described in Section C.5.5.F.

SECTION E: INSPECTION AND ACCEPTANCE

E.1 PLACE OF INSPECTION AND ACCEPTANCE

The Contracting Officer’s Representative (COR) will inspect and accept all work performance, reports, and other deliverables under this contract.

E.1.1 All work is subject to inspections by the Government. Inspections are for the sole benefit of the Government and shall not release the Contractor of the responsibility of providing quality control measures to assure that their work strictly complies with all specifications set forth within the contract.

E.2 ACCEPTANCE-WORK QUALITY

E.2.1 Unsatisfactory Work Quality

A. Incomplete, illegible, contradictory, or otherwise unsatisfactory documentation shall be returned to the Contractor for rework. All data forms in the rework packet shall be proof-read for errors, initialed, and dated that they have been re-checked, and have all corrections marked in the margin. The entire data forms rework packet shall be returned to the COR within two (2) business days of receipt for re-inspection.

B. If station inspection reveals the need for relocating a station (e.g., inadequate canopy opening, on a road, or located outside of the survey site without prior approval, or poor placement that will unnecessarily require the need for additional stations), the COR will notify the Contractor immediately by phone or in writing. The station shall be relocated within two (2) business days to allow for immediate re-inspection, the Contractor shall notify the COR and furnish a corrected station data form with UTMs. The Government will not pay for the initial reset.

C. If the survey coverage of the Survey Area is found not to be in accordance with these specifications, the Contractor may be required to survey additional stations during subsequent visits in order to bring the overall survey effort into compliance at no additional costs to the Government.

D. Any sub-standard services that require Contractor re-work will be performed at no cost to the government. When the defects in services cannot be corrected by re-performance, the government may:

1). Require the Contractor to take necessary action to ensure that future performance conforms to all contract requirements; and

SECTION F: DELIVERIES OR PERFORMANCE

F.1 PERIOD OF PERFORMANCE (POP)

The POP for this contract shall be for a one-year base period and four additional one-year option periods. The clause at FAR 52.217-8 Option to Extend Services (Nov 1999) will be incorporated into this contract (see Section I) for an additional possible extension of up to six months. The contract is not anticipated to exceed 5 years and under no conditions will it exceed 5 ½ years.
