SECTION 1 – INTRODUCTION

The Department of the Interior (DOI) Interior Business Center (IBC) Acquisition Services Directorate (AQD) is issuing this Request for Quotation (RFQ) 140D0422Q0245on behalf of the Wildland Fire Information Technology (WFIT), Office of Wildland Fire (OWF). AQD is issuing this single-source RFQ to solicit Totara Learning Inc. for the Totara Learn Government Cloud Subscription and Licenses Software as a Service (SaaS).

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, "Streamlined Procedures for Evaluation and Solicitation for Commercial Items", as supplemented with additional information included in this notice.

This announcement constitutes the only solicitation; quotations are being requested, and a separate, written, solicitation document will not be issued.

This RFQ is conducted under the authority of FAR 13.5 Simplified Acquisitions for Certain Commercial Items with North American Industrial Classification System (NAICS) Code: 541511 – Custom Computer Programming Services. The Product or Service Code (PSC) is DA10 – IT and Telecom – Business Application/Application Development Support Services.

The Government anticipates awarding a Firm-Fixed-Price (FFP) Purchase Order, as a result of this RFQ.

SECTION 2 – PERFORMANCE WORK STATEMENT

1. PURPOSE

The purpose of the Wildland Fire Learning Management System (WFLMS) Totara Learn Government Cloud Subscriptions and Licenses Software as a Service (SaaS) PWS is to clearly define the needed business, technology, and subscription services required to maintain the Wildland Fire Learning Management System (WFLMS) for National Wildlfire Coordinating Group (NWCG) members and other designated wildland fire management organizations.

Since 2018, the WFLMS has been the solution to meet the needs of inter-agency wildland fire management education and training organizations. This PWS will clearly define the scope of effort, objectives, and all needed technical and business requirements for continuation of the WFLMS program and system.

2. BACKGROUND

Collaborating with inter-agency, state and other wildland fire community stakeholders, the WFLMS Program identified the requirement for an enterprise learning management system to enhance the nation’s wildland fire management education and training community’s ability to consolidate training nomination, registration, hosting of online content, training evaluation assessments and reporting metrics.

In November 2018, the WFLMS began operation using Totara Learn, an open-source solution hosted in the Amazon Web Services (AWS) Government Cloud. The WFLMS operated as a software as a service (SaaS) solution under a managed services solution.

Key features of WFLMS include but not limited to:

• Capable of accommodating individual wildland fire organization needs

• Central host for user training and reporting

• Easy-to-use and responsive interface

• Mobile friendly

• Extensive Administrator and Course Creator support and training

• Telephone and Online Help Desk

• Training courses and videos for all levels of users

Core WFLMS Services include but are not limited to:

• LMS operations and maintenance

• Hosting operations and maintenance

• Supply and maintain Totara Software Subscription

• Support Mandated Training

• Classroom Management

• External Training Management

• Creation of Mission-specific Online Courses

The WFLMS Program resides within Wildland Fire Information Technology (WFIT), Office of Wildland Fire, Office of the Secretary, Department of the Interior (DOI).

3. OBJECTIVE

The intent of this Performance Work Statement (PWS) is to provide Subscription Service, Professional Services, & Hosting Solutions to meet the inter-agency wildland fire management organizations’ requirement for operating and delivering a complete LMS solution. The system solution will support the complete LMS which includes a custom SF-182 solution.

The contract will be established as a Firm Fixed Price contract over a Three (3) year period to meet the inter-agency wildland fire management’s requirement for approximately 49,999 active users at multiple role levels. An active user is defined as a user who has accessed the WFLMS within the last twelve (12).

This contract will contain the following Three (3) Delivery Tasks supplied together in a single solution offering. The requirement of all three tasks offered together is derived from an ability to deliver and maintain continual operations with zero downtime or solution offering gaps and/or delays.

• Task 1: Totara License Services: This task is to supply the License / Subscription services for the WFLMS LMS solution. These Licenses / Subscriptions provide the required system compliance for daily operational tasks, organizational initiatives, as well as NWCG training requirements in the WFLMS platform.

• Task 2: Totara Learn Government Cloud Platform License Operations and Maintenance

Support: This supplies the required professional services for Project Management Support, Subject Matter Expert (SME) Support, and Software Engineer Support to maintain and develop the WFLMS solution. Support for migration to Totara Learn Version 14 from Version 12. .

• Task 3: Totara Learn Government Cloud Platform Hosting Services and Support: This task is for Amazon Web Services (AWS) - AWS Government Cloud. Hosting Support includes on-going operations and maintenance, technical support and monitoring of the database, content and web servers, full load balancing, with auto backup of the production database data and network failover design.

4. SCOPE OF EFFORT

The contractor must provide Totara License Services, Totara Learn Government Cloud Platform License Operations and Maintenance Support, and Totara Learn Government Cloud Platform Hosting Services and Support to meet the requirements stated in this PWS. This includes all LMS application & hosting, configuration, testing, deployment, ongoing application or system patching, system security, and program support to the WFLMS Program.

The contractor’s solution must meet all Section 508 accessibility requirements and Federal security standards.

The contractor must demonstrate experience with Hosting in AWS and the technology to operate the open-source learning management systems Totara Learn and other Moodle-based LMS. The contractor must also demonstrate past successful implementation with enterprise contracts of at least 50,000 + users. The solution provided must include Totara Learn.

This contract is intended to satisfy the full range of related LMS subscription, hosting, configuration, and support services.

The contractor will supply a transition plan from beginning of Period of Performance out 15 days. The government requires that the vendor will collaborate with OWF’s current vendor to execute a successful and efficient transition of service. Key milestones for this transition are outlined below. Vendor will supply a transition schedule.

• Kick-off meeting and confirmation of Transition Schedule and Plan to include key stakeholders from all parties.

• Back up and document transitions for all systems, data, and content

a. File Directories (and content for lower tier systems). Production and Development.

b. Databases for all systems.

The Totara License Services, Totara Learn Government Cloud Platform License Operations and Maintenance Support, and Totara Learn Government Cloud Platform Hosting Services and Support solution requirements must include:

• Totara Learn, Version 12 with the AWS GovCloud (US) region solution.

• Upgrade path to Totara Learn, Version 14.

• Hosting with Amazon Web Services (AWS) - AWS GovCloud with full integrated support between LMS and hosting solution.

• Subscription services for Totara Learn, Version 12.

• Complete transitional plan from current vendor to Totara North America for solution.

• Training support for migration to Totara Learn, Version 14 from V12.

• Professional Service support for Ongoing maintenance and operations of LMS.

• Training content integration, support, and delivery.

• Implementation and support for the SF182.

• Supply WFLMS Program manager with Monthly, Quarterly, and Annual Hosting and LMS metrics.

• Support, alignment, and monthly engagement into the US Federal Users Group Totara Detailed requirements are defined in Section 5 of the PWS.

The contractor will work with WFLMS Program to develop training materials to Category Managers and Course Creators in wildland fire management organizations identified by the WFLMS Program. The contractor will work with WFLMS Program Staff to deliver virtual training sessions to Category Managers and Course Creators in wildland fire management organizations identified by the WFLMS Program.

5. Technical Requirements

5.1.1 Totara License Services

5.1.1.1 Supply WFLMS Program with the Annual Totara Subscription License in line with their

Production usage requirements. The vendor must have the ability to be able to provide WFLMS with Totara software subscription service and technical management needed to develop and deploy the LMS platform.

5.1.1.2 The Totara software subscription must include Totara Learn Version 12, and any upgrades to future versions.

5.1.1.3 Annual Totara Subscriptions for up to 49,999 users

5.1.1.4 These licenses must provide the required system compliance for daily operational tasks, WFLMS Program initiatives, as well as Federal training requirements in the WFLMS platform.

5.1.1.5 Licenses must meet the Totara subscription service product agreements requirement: (see the agreement at https://www.totaralms.com/subagreement.pdf).

5.1.1.6 Annual Totara Subscriptions must be managed annually for WFLMS Program, including the renewal process, additional Annual Totara Subscriptions needs by the government, and complete operation in the support LMS solution.

5.1.2 Totara Learn Government Cloud Platform License Operations and Maintenance Support

5.1.2.1 The vendor of professional services will supply a complete solution for all Operations and Maintenance as defined below in each support area. To include but not limited to the following areas and items:

5.1.2.1.1 Project Management Support

5.1.2.1.2 Subject Matter Expert (SME) Support

5.1.2.1.3 Software Engineer Support

5.1.2.1.4 Initial WFLMS LMS (Totara v12) build, configuration, testing and release to all environments in the AWS GovCloud (US) region hosting solution.

5.1.2.1.5 Complete transitional tasks from previous vendor for solution release and go live.

5.1.2.1.6 Complete management of the AWS GovCloud (US) region for the LMS solution.

5.1.2.1.7 Security support services for the AWS GovCloud (US) region & Totara LMS solution in alignment with the DOI, Federal Information Security Management Act (FISMA), and National Institute of Standards and Technology (NIST) standards and requirements.

5.1.2.1.8 Change management and configuration support for LMS and hosting solutions.

5.1.2.1.9 Management and alignment to the either Application lifecycle management (ALM) or

Software Development Life Cycle (SDLC).

5.1.2.1.10 Implementation and support for the SF182 solution.

5.1.2.1.11 Support of administration of role access management for all users level roles.

5.1.2.1.12 Support design, development and implement customizations with reporting and new modules from Totara Learn.

5.1.2.1.13 Supply secure Intrusion Detection & Continues monitoring solutions with AWS and LMS.

5.1.2.2 Project Management Support

5.1.2.2.1 The vendor will supply Project management support for the duration of the project including:

5.1.2.2.1.1.1 Status meeting support and status reports.

5.1.2.2.1.1.2 WFLMS Lead Meeting support

5.1.2.2.1.1.3 Managing project schedules, tasks, quality, and budgets for all operations and maintenance (O&M) tasks and special projects like Version 14 upgrade.

5.1.2.2.1.1.4 Communicating and coordinating with WFLMS Stakeholders at all levels.

5.1.2.2.1.1.5 Supporting Communications with WFLMS System Administrators

5.1.2.2.1.1.6 Coordinating with DOI Contracting Officers, including project finances, proposals, estimates, and compliance issues on a regular bases.

5.1.2.2.1.1.7 Assisting WFLMS Program in Department costing and resource estimates for identified projects.

5.1.2.2.1.1.8 Assisting WFLMS Program Management in devising and implementing technical and business process solutions.

5.1.2.2.1.1.9 Supporting LMS and Standard Operating Procedures (SOP) Documentation

5.1.2.2.1.1.10 Supporting LMS complete configuration and complete testing for O&M and upgrades.

5.1.2.2.1.1.12 Future system or component integration capability with WFLMS, Totara Learn, Version 14. WFLMS’ s platform is Totara Learn version 12. Totara Learn is an open-source solution.

**** WFLMS Program will ensure key personnel including Sponsors, Team WFLMS and key Subject Matter Experts will be available to support this project as required.

5.1.2.3 Totara Subject Matter Expert (SME) Support

5.1.2.3.1 The vendor will supply SME support for the duration of the project including:

5.1.2.3.1.1 Provide Totara application expertise to the

project team 5.1.2.3.1.2 Serve as the Totara point of contact for WFLMS Program

5.1.2.3.1.3 Training content integration, support, and

delivery.

5.1.2.3.1.4 Support the ongoing configuration of the Totara application

5.1.2.3.1.5 Manage issue creation, tracking and status within the Totara Partner site for

WFLMS Program

5.1.2.3.1.6 Provide insight and recommendations on new Totara releases 5.1.2.3.1.7 Manage the approach and execution of any development efforts 5.1.2.3.1.8 Support of the following Team WFLMS activities:

5.1.2.4.1.1 Providing technical direction, consultation, and recommendations

5.1.2.4.1.2 Troubleshooting high level issues

5.1.2.4.1.3 Installing upgrades, patches, and new modules

5.1.2.4.1.4 Implementation and support for the SF-182 solution

5.1.2.4.1.5 Designing, developing and implementing customizations and reporting

5.1.2.4.1.6 Supporting the transfer of data between environments

5.1.2.4.1.7 Developing/Updating interfaces as needed

5.1.2.4.1.8 Installing, configuring and troubleshooting any Moodle Plug-Ins requested by

WFLMS Program

**** WFLMS Program will ensure vendor will have access to WFLMS and other required systems as needed to provide support under this contract.

5.1.3 Totara Learn Government Cloud Platform Hosting Services and Support: Amazon Web Services (AWS) - AWS GovCloud

5.1.3.1 Supply WFLMS with a complete managed AWS hosting services in a world-class redundant peering environment for Internet connectivity, allowing unprecedented fault tolerance

5.1.3.2 Supply transition and O&M hosting services with Amazon Web Services (AWS) - AWS

GovCloud (US) region directly aligned to the O&M of the WFLMS Totara LMS solution

5.1.3.3 The supplied Hosting Services will include on-going operations and maintenance, technical support and monitoring of the database, content and web servers, full load balancing, with auto backup of the production database data and network failover design. In addition, hosting services will include immediate identification of an outage within 20 minutes, and a quick response to correct the problem. Production environments maintained by vendor include will be Service Level Agreement compliant maintaining a 99.5% uptime. In the event of a Production environment outage, the vendor will provide an outage report with a detailed description of the event and the corrective action taken to restore services

5.1.3.4 Supply WFLMS Program with monitoring of the bandwidth utilization and make timely recommendations.

5.1.3.5 Supply government with monitoring alerts and taking simple corrective action (i.e. – restarting the application or web server, rebooting the machine, changing server or firewall configurations, etc.)

5.1.3.6 Hosting services include:

5.1.3.6.1 24 x 7 monitored networks

5.1.3.6.2 24 x 7 performance monitoring

5.1.3.6.3 Performance guarantees for server response

5.1.3.6.4 Load balancing and architecture to handle redundancy and heavy traffic

5.1.3.6.5 Backups of the database system are to be managed by vendor to ensure data integrity.

The use of industry best practices will be utilized to maintain the backup data. This includes, at minimum, daily incremental backups, and weekly full backups

5.1.3.7 Alternate storage site. Establishes an alternate storage site including necessary agreements to permit the storage and retrieval of information system backup information;

and ensures that the alternate storage site provides information security safeguards equivalent to that of the primary site.

5.1.3.8 180 day max off-site retention available

5.1.3.9 Reacting to monitoring alerts and taking corrective action (i.e. – restarting the application or web server, rebooting the machine, changing server or firewall configurations, etc.) – This does not include editing any code or any type of professional services

5.1.3.10 Restarting services or processes

5.1.3.13 Cloud Partnership: Vendor will currently have or be able to setup presences in the AWS GovCloud (US) region.

5.1.3.14 The vendor with AWS Cloud will provide a broad set of infrastructure services, such as computing power, storage options, networking and databases, delivered as a utility: on- demand, available in seconds, with pay-as-you-go pricing.

5.1.3.15 The vendor will partner with the AWS GovCloud (US) solution to supply an isolated AWS region designed to allow U.S. government agencies and customers to move sensitive workloads into the cloud by addressing their specific regulatory and compliance requirements. The AWS GovCloud (US) Region adheres to U.S.

International Traffic in Arms Regulations (ITAR) requirements. The AWS GovCloud (US) Region supports the management of regulated data by offering the following features:

5.1.3.15.1 Restricting physical and logical administrative access to U.S. citizens only.

5.1.3.15.2 Providing FIPS 140-2 endpoints.

5.1.4.2 Backups are not to exceed 1.2TB per month.

5.1.4.3 WFLMS Program Security will continue to maintain ownership of the Authority to Operate process and documentation. The vendor will function in a consultative role to provide environment or process specific information.

5.1.4.4 Production environment sizing is intended to support standard WFLMS Program Production usage. Any overages above the standard level will be invoiced monthly for the overage amount.

6. SECURITY AND 508 REQUIREMENTS

The contractor’s solution must:

1. Meet application, hosting, architectural, planning, and other security requirements necessary to achieve FISMA Assessment &Authorization (A&A). As needed, the contractor must provide support for current Authority to Operate (ATO) documentation, issued at the minimum of FISMA-Moderate level, by a U.S. Federal agency and/or the FedRAMP program

2. Comply IaaS and SaaS requirements including regulations pertaining to the United States Government Configuration Baseline (USGCB) or formerly known as Federal Desktop Core Configuration (FDCC), and Security Content Automation Protocol (SCAP)

3. Comply with Section 508 accessibility requirements

4. Be kept current with the most recent vendor product version. The contractor must submit a project plan for all new versions

5. Must have secure, FedRAMP SaaS Security, support and operations model available, with FedRAMP + DISA Impact Level 4 SaaS accreditation

6. Be an extremely scalable model to support the entire organization

7. Have no failed implementations

7. PERIOD OF PERFORMANCE

The period of performance shall include one (1) base year and two (2) option years, if exercised, and is anticipated as follows:

a. Base Period - (Time of award) – thru 12 Months (Not to Exceed)

b. Option Periods -

8. INTELLECTUAL PROPERTY

The COR shall ensure that all Contractor personnel take the required DOI Program Security Awareness and Rules of Behavior Training in accordance with Intent to Award Sole Source Negotiation Local Clause

– Intellectual Property.

9. CONTRACTOR PERSONNEL

9.1.1 Qualified Personnel

The contractor shall provide qualified personnel to perform all requirements specified in this PWS. Prior to assignment to the contract, the contractor shall submit a current résumé for all management and other key personnel if different from those personnel identified in the proposal. Contractor employees shall possess the education, experience, and skills necessary to complete the requirements. Any replacement of key personnel shall be subject to the Contracting Officer’s approval.

9.1.2 Place of Performance

Work will be performed at the Contractor location. It is anticipated most of the work will be performed virtually. The Contractor must comply with the DOI IT Security policy.

9.1.3 Travel

The Government anticipates little to no travel on the part of the Contractor during the performance of this contract. If travel is required, the travel will be paid for by the Federal Government.

9.1.4 Core Hours of Operation

Work performed on the Contractor’s premise shall be provided on a similar schedule of hours of operations unless otherwise specified in the Contractor’s Project Plan (approved by the COR).

10. RELEASE OF INFORMATION

No WFLMS Program data shall be divulged to any unauthorized person, for any purpose. Therefore, the Contractor shall clear with the Contracting Officer in writing any public release of any information.

Information includes news stories, articles, sales and marketing information, advertisements, etc. All requests for public release of information shall be submitted via email to the Contracting Officer.

The Contracting Officer shall submit the Contractor’s Request For Press Release to the Office of Communications (OC) for approval. The Contractor shall not release any information to the public without written approval received from the Contracting Officer.

Contracting Officer’s Representative (COR) The COR is the technical representative to the CO for all tasks issued under this contract. The COR’s main responsibility is the coordination of tasks issued under the contract. The COR is the CO’s coordinating point of contact for the entire contract and ensures a reasonable level of coordination of available Government and Contractor resources.

This contract will have a COR designated to provide technical guidance for that task. The COR represents the CO for technical matters pertaining to the task. The general responsibilities and authorities of the COR include:

- Giving technical directions to the Contractor which provide the necessary technical details to complete the task requirements;

- Providing information to the Contractor which assists in the interpretation of the technical portions of the work description; and

- Reviewing and recommending approval by the CO of all work products/deliverables.

Administration Duties of COR/COR

The COR has the authority to provide “technical direction” to the Contractor during the performance of work under contract for their individual projects. Technical direction generally requires monitoring the Contractor’s work closely and continually as it progresses to ensure that the task requirements are being met. While progress monitoring does not mean taking charge and conducting the Contractor’s effort, or in any way supervising Contractor employees, it does, however, mean that the COR will:

- Keep well informed of the Contractor’s performance and activities;

- Use technical expertise to identify the Contractor’s actions, or failure to act, that clearly affect the quality of the work under way and the end results or deliverables;

- Notify the Contractor of apparent deficiencies; and

- Determine the appropriate action in discussion with the CO and Contractor to correct deficiencies.

Communication

- The terms and conditions of this contract shall govern the administration and management of the work products and deliverables. The lines of communication and authorities between Government and Contractor personnel under this contract are as follows:

- Communications related to contract management issues shall take place between the CO, COR, COR, and the Contractor Representative.

- For issues related to task management and technical matters, communication may occur between the CO and/or COR, COR and the Contractor’s Site Management or Task Leader.

- The Contractor’s resource personnel shall communicate to Government personnel through its Task Leader, and the Government’s resource personnel shall communicate to the Contractor resource personnel through the COR.

General Standards

The Contractor is responsible for obtaining and maintaining all the documentation necessary for performance under this contract. The Contractor shall make any specific documentation requests, including applicable standards, known to the COR on an as-needed basis and in accordance with the governing contract. Applicable standards under which specific work shall be accomplished include but are not limited to those specified in WFLMS Program service center agency IT manuals and policy, those specified in applicable WFLMS Program departmental regulation, and service center agency Configuration Management Standards and Practices. Upon Contractor’s request and at its sole discretion, the Government may deem it beneficial to provide such documentation electronically to the Contractor if documentation is readily available in electronic format and requires no additional production or handling cost to the Government.

12. GOVERNMENT QUALITY ASSURANCE

(a) Contractor Performance

Contractor performance will be monitored to determine if it meets the contract requirements through periodic inspection of the output and customer complaints.

(b) Performance Evaluation

Performance of a service will be evaluated to determine whether it meets the performance requirements of the contract. When the performance requirement is not met, as defined herein, the contracting officer will issue a Contract Discrepancy Report (CDR) to the contractor. Upon evaluation of the contractor’s response to a CDR for tasks monitored by random sampling or verification of customer complaints, the contractor’s payment for the month in which the performance in question occurred will be calculated with an appropriate deduction. The contractor shall respond to the CDR and return it to the contracting officer within seven calendar days of receipt. The contractor will be required to reperform all deficient work if reasonably practicable. If the contractor fails to reperform the required work, deductions from amounts due under the contract may be made.

(c) INSPECTION AND ACCEPTANCE CRITERIA

Inspection and acceptance will be at destination in accordance with FAR 52.212-4(a).

14. KEY DELIVERABLES

The project plan and transition plan from beginning of Period of Performance out 15 days will be discussed during the kick-off meeting. The project plan and transition plan is due within 1 week after award. WFLMS Program staff will review the plan and provide feedback. Contractor will incorporate feedback from that review. The contractor will deliver the final project plan and transition plan to WFLMS program staff. The COR will approve the final project plan and transition plan.

3 Totara Subscription evidence

Supply the government with Totara Subscription Evidence annually.

4 AWS Hosting Partnership Supply the government with AWS hosting partnership annually.

5 Regular Meetings The contractor will host weekly meetings with the WFLMS Program Staff and other WFLMS Program personnel if determined. During these meetings, the contractor will provide updates to WFLMS Program Staff on its progress. These meetings will also both the contractor and WFLMS Program Staff to discuss challenges and come up with solutions to resolve these challenges.

6 Usability-Acceptance Testing (UAT) Scripts and Plan to Conduct UAT

The contractor will develop UAT Scripts and a plan to conduct UAT with selected participants and Mission Area, Agency and Staff Office process managers, and WFLMS Program Staff.

The plans must include a UAT scripts for participants and process managers. WFLMS Program staff will review UAT scripts and provide feedback. The contractor will incorporate all feedback and provide the final UAT scripts to the WFLMS Program Staff for review and approval. The COR will approve the final UAT scripts.

7 Training Materials to be used to deliver virtual training sessions

The contractor will develop training materials to be used to train Category Managers and Course Creators. WFLMS Program staff will review all training materials and provide feedback. The contractor will incorporate the feedback before delivering the final training materials. The contractor should incorporate change management practices into the training materials.

8 Custom Modules Custom Modules documentation, any government owned code when applicable.

9 Virtual Training Sessions The contractor will deliver two (2) virtual training sessions to Category Managers and Course Creators. The contractor will work with the COR to determine appropriate dates and times for these sessions. Both sessions will use WFLMS Program’s web conferencing platform, ZoomGov. Both sessions will be recorded.

10 Security Posture Confirmation

The contractor will provide a Security Posture Confirmation in writing to the WFLMS Program Staff.

11 Competency Assessment Solution

The contractor will ensure the solution meets all requirements stated in this PWS. The contractor will ensure the solution considers all the feedback from UAT before WFLMS Program Staff to reviews and approve the solution.

12 O&M Deliverables Monthly / Quarterly / Annually

O&M Monthly / Quarterly / Annually deliverables include: LMS Metrics, AWS Metrics, and Special Projects Metrics

15. CONTRACT DISCREPANCY REPORT (CDR)

A CDR will be initiated by the COR if, at any time during the performance period specified in the PRS, the results of the WFLMS Program’s surveillance show the number of observations of unacceptable performance during the period exceeds the threshold specified in the PRS, and the COR determines that the unacceptable performance was not caused by the Government. Instructions for completing the CDR are as follows:

a. The COR completes Blocks l through 6 and sends the form to the CO. Block 6 must include the PRS number corresponding to the discrepancy, the threshold of that PRS item, the number of discrepancies documented, and the SOO paragraph reference describing the Government’s expectations for that PRS item.

b. The CO evaluates the CDR, and if appropriate, signs it and sends it to the Contractor with a cover letter requesting a response within a specified number of days.

c. The Contractor must complete Blocks 7 through 10 and return the CDR to the CO within the specified time period on the cover letter.

d. Upon receipt of the Contractor’s response, the CO, in consultation with the COR, will evaluate the Contractor’s response and take appropriate action. The CO will document the evaluation in Block 11 and action taken in Block 12.

e. In most cases, the preferred action is re-performance by the Contractor at no additional cost to the Government. If deduction from payment is the appropriate action, the COR and CO will calculate the payment deduction based on the performance period in which the

140D0422Q0245 17 | P a g e discrepancy occurred. The deduction is taken from the Contractor’s payment as close as possible to the month in which the discrepancy occurred, but not necessarily the same month. The Government should not withhold payment of an invoice while calculating the deduction.

f. The COR will complete Blocks 13a and 13b. The CO signs the CDR in Block 13c.

These signatures indicate concurrence with the actions taken.

g. In the event the CO determines that issuance of a CDR is not appropriate; the CO shall document the contract file indicating why such action is not appropriate.

SECTION 3 – GENERAL PURCHASE ORDER TERMS AND CONDITIONS

3.1 Delivery Location

All deliveries are via electronic means. The Contractor shall make software identified herein available to DOI for the entire period of performance. Software activation information shall be coordinated with the Technical Point of Contact (POC), identified below, and provided no later than the first day of each performance period.
