AMENDMENT 0001, QUESTIONS AND ANSWERS (Q & A’S)

To Solicitation RFP 14-05 QUESTIONS & ANSWERS (Q&A's) 5 Year Online Legal

Research Database Services for OGC and OCR Offices

Please acknowledge receipt of the Amendment via email so that the Contracting Officer knows the paperwork was delivered and received. In accordance with the Standard Form 30 (SF30), Amendment of Solicitation the Contractor is required to sign the SF30 document and return 1 copy to the issuing office at the time proposals are due.

Q1: Who is the incumbent contractor currently providing online legal research database services?

A1: There is no incumbent contractor.

Q2: What is the period of performance and total current contract value?

A2: N/A (See answer to Question 1).

Q3: Section C.2 of the Statement of Work (SOW) notes “treatises” in the examples of required databases. Please elaborate on the specific practice areas of law for which the NEA needs treatises.

A3: Examples would include: Employment Law, Contract/Government Contract Law, Intellectual

Property Law, etc.

Q4: Section C.2 of the SOW also names “court docket information” in the examples of required databases. Please clarify this requirement:

a. Does the NEA require access to court documents, such as briefs, pleadings, motions, and jury instructions?

b. Knowing that the NEA needs access to court docket information, would abstract docket information (i.e., initial filing information such as party name, filing number, filing date, and/or case type) sufficiently satisfy the NEA’s requirement?

c. Does the NEA require a docket and document research tool that enables its users to search and access full-text court dockets and documents?

A4:

a. Access may be needed on a case by case basis upon Agency determination. As such, we would require that bidding parties are in a position and have the capability to provide access to this information upon request.

b. It may but again, this will need to be determined on a case by case basis.

c. If the NEA determines that it will need access to court docket information on a specific matter, it will also make the determination on whether it will need document research tools as mentioned in this question.

Q5: Does the NEA currently use the Public Access to Court Electronic Records (PACER) system?

If so, what is the NEA’s approximate monthly usage of PACER?

A5: The NEA does not currently use the PACER system.

Q6: Section C. Description/Specifications/Statement of Work (page 5). The Scope of Work

(C.2) indicates that offerors will provide NEA with an online legal research database for the OGC and OCR offices.

(A) How many NEA users will be accessing the online legal research database at each office?

(B) How many of the NEA users are attorneys?

A6:

(A) Approximately 4-6 users

(B) Approximately 5

Q7: Section L. Submission of Offers (page 12). The solicitation indicates that “the written proposal should be no more than 13 pages” in length.

(A) Will you please identify what counts against this page limit? For example, if a proposal contains a cover page and/or table of contents, do these pages count against the limit?

(B) If an offeror includes attachments with their proposal, such as subscriber agreements and pricing schedules, would these pages count against the page limit?

(C) If pages such as cover pages, tables of content, and necessary attachments (e.g., subscriber agreements) count against the page limit, would NEA consider eliminating the page limit altogether? If not, would NEA consider increasing the page limit to no more than 25 pages to allow offeror’s sufficient pages to respond with a comprehensive proposal? Please advise.

A7:

(A) A Cover Page and Table of Contents will count against the page limitation specified.

(B) Reasonably sized attachments (no more than 3 pages each) will not count against the page limitation specified.

(C) The NEA will not consider modifying the page limitation. Please see answers "A" and "B" above for guidance on items that will and will not count against the page limit.
