SCOPE

The County of Orange (County) is seeking to enter into a contract with one or more competent professionals (each, an “Offeror” or “Consultant”), with demonstrable experience in and understanding of the U.S. Department of Housing and Urban Development (HUD) rules and regulations as they relate to the Community Development Block Grant (CDBG) program, HOME Investment Partnerships (HOME) program, including HOME-ARP (American Rescue Plan), Emergency Solutions Grant (ESG) program, Community Development Block Grant Disaster Recovery (CDBG-DR) program, Community Project Funding (CPF), and Neighborhood Stabilization Program (NSP), to provide technical assistance and guidance to the Orange County Office of Community Development (OCD), located in Goshen, New York, as more particularly described in the “Specifications” Section below.

SPECIFICATIONS

1. Introduction and Programs Description

The Orange County Office of Community Development (OCD) currently administers CDBG and HOME federal entitlement grants for Orange County, as an entitlement grantee, received directly from HUD. OCD at the present time does not directly administer the ESG grant. The County, however, may determine at a later date that it is in the best interest of the County to resume direct administration of the ESG program therefore Offeror’s knowledge of the ESG program is desired. In addition, the County received an NSP award in 2008 relating to the subprime mortgage and financial crisis of 2008 and a CDBG-DR award in 2012 relating to Hurricane Irene and Hurricane Sandy.

In 2021, the County received a HOME-ARP award. In 2023, the County received a CPF award. The County’s federally funded CDBG, HOME, ESG, HOME -ARP, CDBG-DR, CPF and NSP programs are hereinafter, collectively, referred to as the “federal programs”.

The HUD funded federal programs serve the municipalities that make up the CDBG Urban County Consortium and the HOME Consortium. Every municipality in Orange County currently participates in the CDBG Urban County Consortium, except for the Cities of Newburgh, Middletown, and Port Jervis, the Village of Kiryas Joel and the Town of Palm Tree. Members of the HOME Consortium include every municipality participating in the CDBG Urban County Consortium and the Cities of Newburgh, Middletown, and Port Jervis.

The County is annually awarded federal funding from the CDBG and HOME Entitlement Programs totaling approximately $2.7 million (CDBG $1.6 million; HOME $1.1 million). The CDBG and HOME funds are used primarily to provide subgrants to local municipal governments for improvements to public infrastructure, facilities, and services as well as funding to profit and not-for-profit developers of multi-unit rental housing and affordable homeownership projects.

HUD requires grantees to prepare Annual Action Plans outlining funded activities for each program year and Consolidated Annual Performance and Evaluation Report (CAPER) to report on accomplishments achieved in each program year. The County is required to develop the Annual Action Plan and CAPER in consultation with those intended as the primary beneficiaries of these HUD programs. The completed reports must comply with all applicable HUD regulations and be submitted within the timeframe set by HUD.

The Fair Housing Act (FHA), passed as part of the Civil Rights Act of 1968, prohibits housing discrimination based on race, color, religion, sex, disability, familial status or national origin. It also requires federal agencies and recipients of federal housing funds to affirmatively further fair housing. As part of demonstrating that an entitlement https://www.justice.gov/crt/fair-housing-act-1

PO Box 218, 255-275 Main Street Goshen, New York 10924 community is affirmatively furthering fair housing, the 2021 Affirmatively Furthering Fair Housing (AFFH) rule required grantees to prepare an Analysis of Impediments to Fair Housing Choice, or AI, which identifies any impediments to fair housing choice and what steps the entitlement community will take to affirmatively further fair housing. The County previously prepared an AI in Spring 2023. HUD recently terminated the 2021 AFFH rule which mandated the completion of complex jurisdictional and regional analysis by grantees. A grantee’s certification that it has affirmatively furthered fair housing in accordance with the Fair Housing Act is, at the present time, may be deemed sufficient. Offerors must be familiar with the AFFH rules and current requirements and be up to date on all relevant legislation and regulatory requirements.

A. Community Development Block Grant (CDBG) Program

Orange County has been awarded CDBG funds on an annual formula basis since the inception of CDBG program in 1974 to provide households with low and moderate income (LMI) with viable communities, including decent housing, a suitable living environment and expanded economic opportunities. HUD defines LMI as a household with income that is less than 80% of area median income. Eligible activities include community facilities and improvements, public infrastructure, and public services, with 20% of each funding year entitlement reserved for planning and administration.

To continue participation in this program, the County contractually agrees with HUD to implement the Housing and Community Development Act of 1974 and related CDBG program regulations contained in 24 CFR 570 as well as all cross-cutting regulations. The program is authorized under Title 1 of the Housing and Community Development Act of 1974, Public Law 93-383, as amended 42 U.S.C.-530.1 et seq. HUD provides guidance on the CDBG Program through CPD Notices and Policy Memoranda, all of which can be found at https://www.hudexchange.info/programs/cdbg/cdbg-laws-and-regulations/.

B. Home Investment Partnerships (HOME) Program

Since 1992, HOME funds have been allocated annually to Orange County from HUD on a formula basis. The HOME statute is contained in Title II of the Cranston-Gonzalez National Affordable Housing Act. HUD provides guidance on the HOME program through HOME CPD Notices, HOME Policy Memos, HOME fires, and HOME FACTS all of which can be found at https://www.hudexchange.info/programs/home/home-laws-and-regulations/. HUD published a Final Rule in the Federal Register on July 24, 2013 (24 CFR Part 92) to amend the HOME Program regulations (2023 HOME Final Rule).

HOME Program provides formula grants to fund a wide range of activities including building, buying, and/or rehabilitating affordable housing for rent or homeownership to people with low incomes. HOME funds are typically used in partnerships with private developers, local nonprofit groups, and community housing development organizations (CHDOs), to finance a variety of affordable housing production activities. According to HOME regulations, at least 15% of each Program Year funding must be set aside for projects owned, sponsored and/or developed by Community Housing Development Organizations (CHDOs) and 10% is reserved for administration and planning.

HUD published the new HOME Final Rule on January 6, 2025 (HOME Final Rule), with an original effective date of February 5, 2025, but the implementation was delayed to April 20, 2025. Further delays have been implemented for specific provisions which are now scheduled to become effective on October 30, 2025. The HOME Final Rule makes several significant changes to the implementation of the HOME program and represents the first major regulatory update since the 2013 HOME Final Rule. The HOME Final Rule revises the HOME program regulations to http://portal.hud.gov/hudportal/HUD/program_offices/comm_planning/communitydevelopment/rulesandregs/laws/sec5301 https://www.hudexchange.info/programs/cdbg/cdbg-laws-and-regulations/ https://www.hudexchange.info/programs/home/home-cpd-notices https://www.hudexchange.info/programs/home/home-policy-memos https://www.hudexchange.info/programs/home/homefires https://www.hudexchange.info/programs/home/home-facts

PO Box 218, 255-275 Main Street Goshen, New York 10924 update, simplify, or streamline requirements, better align the program with other Federal housing programs, and implement recent amendments to the HOME program statute. The HOME Final Rule also includes minor revisions to the regulations for CDBG and Section 8 Housing Choice Voucher programs consistent with the changes to the HOME program. Major provisions include tenancy addenda that create tenant protections for residents of HOME-assisted rental housing and recipients of HOME tenant-based rental assistance, changes to maximum per-unit subsidy limits, changes to periods of affordability, updated guidance and policy changes for HUD-assisted homebuyer housing, and several provisions intended to streamline participation in the HOME program (24 CFR Parts 91, 92, 570, and 982).

C. Emergency Solutions Grants (ESG) Program

ESG funds may be used for five program components: street outreach, emergency shelter, homelessness prevention, rapid re-housing assistance, and HMIS; as well as administrative activities (up to 7.5% of a recipient’s allocation can be used for administrative activities). All applicable ESG laws, rules and notices can be found at https://www.hudexchange.info/programs/esg/esg-law-regulations-and-notices/#laws and 24 CFR 576. The County did not receive its FY-2025 allocation of the ESG funds but may consider administering the ESG program in the future within the time frame relevant hereto.

HUD made certain rule changes and announcements affecting the CDBG and ESG programs in 2025.

In April 2025, HUD announced an interim final rule revising the regulations for the Fair Housing Act, which affects the administration of the ESG program.

D. Community Development Block Grant – Disaster Recovery (CDBG-DR) Program

In response to extraordinary impacts from disasters, U.S. Congress has from time-to-time appropriated additional funding for the CDBG program. Unlike other recovery assistance programs, CDBG-DR assistance is not permanently authorized. In response to Presidentially declared disasters, Congress may appropriate additional funding for the CDBG program as Disaster Recovery grants to rebuild the affected areas and provide crucial seed money to start the recovery process. CDBG-DR assistance may fund a broad range of recovery activities to help communities and neighborhoods that otherwise might not recover due to limited resources, subject to availability of supplemental appropriations. CDBG-DR appropriation statutes typically grant the Secretary of HUD the authority to waive statutes or regulations administered by HUD, except for requirements related to fair housing, nondiscrimination, labor standards, and the environment. Statutory requirements of CDBG-DR appropriations, recovery needs of grantees, and waivers granted by HUD may change from one disaster to the next. CDBG-DR grants are subject to Title I of the HCD Act, (42 U.S.C. § 5301 et seq.) which governs all CDBG programs; CDBG regulations at 24 CFR Part 570, unless modified by waivers; The Federal Register Notice allocating funds to that grantee and any subsequent Notice providing additional waivers and alternative requirements; 2 CFR Part 200, which provides the Federal government’s guidance on administrative requirements, cost principles, and audit requirements; Section 312 of the Stafford Act (42 U.S.C. 5121 et seq.), which can be found at https://www.hudexchange.info/programs/cdbg-dr/

HUD made certain rule changes and announcements affecting the CDBG and ESG programs in 2025. Key updates include the CDBG-DR Universal Notice, issued in January 2025 and updated in March 2025 to align with Administration Executive Orders. HUD also released revisions to its Fair Housing Act regulations in April 2025, impacting CDBG and ESG rules.

E. Neighborhood Stabilization (NSP) Program

NSP, as a component of the CDBG Program, provides emergency assistance to state and local governments to acquire and redevelop foreclosed properties that might otherwise become sources of abandonment and blight within their communities. NSP provides grants to purchase foreclosed or abandoned homes and to rehabilitate, resell, or redevelop these homes in order to stabilize neighborhoods and stem the decline of house values of neighboring homes. The program is authorized under Title III of the Housing and Economic Recovery Act of 2008.

The Housing and Economic Recovery Act of 2008 provided a first round of formula funding to States and units of General local government and is referred to herein as NSP-1. The American Recovery and Reinvestment Act provided a second round of funds in 2009 awarded by competition and is referred to herein as NSP-2. The third round of funding, NSP-3, was provided in 2010 as part of the Dodd-Frank Wall Street Reform Act and was allocated by formula. The CDBG regulatory structure is the platform used to implement NSP. The regulations created by the Office of the Assistant Secretary of Community Planning and Development that pertain to Community Development programs are contained within 24 CFR part 570 – Community Development Block Grants. NSP is governed by CDBG regulations except where specifically waived.

F. Community Project Funding (CPF) Program

CPF grants provide investment in a wide variety of projects such as housing, homelessness prevention, workforce training, public facilities, parks, resilience planning and other critical infrastructure and services.

The County received $4,000,000 of CPF funds from HUD for the demolition and construction of the Newburgh Landing Pier; 20% will be used for administration. Orange County anticipates entering into a $3,200,000 subrecipient agreement with the City of Newburgh to demolish the existing pier, construct a new landing platform, and build an extended fixed pier for large commercial boats with spud barge for small commercial boats, and a floating dock for smaller recreational vessels.

G. HOME- ARP Program

Notice CPD-21-10: Requirements for the Use of Funds in the HOME-ARP Program establishes requirements for funds appropriated under Section 3205 of the American Rescue Plan Act of 2021 (P.L. 117-2) for HOME to provide homelessness assistance and supportive services.

Orange County was awarded $4,253,870 in HOME-ARP funds from HUD which will be used to address the County's homeless assistance needs by creating affordable housing units, increasing developer capacity, and providing supportive services. The County has reserved 15% of the HOME-ARP funds for eligible administrative expenses related to this specific grant award.

2. Scope of Services
