This acquisition is being conducted under FAR 13.5 Simplified Procedures for Certain Commercial Items.

Only FAR Part 13 procedures will be used to solicit and evaluate offerors. Per FAR 52.216-1, the

Government contemplates award of a firm fixed price contract resulting from this solicitation.

MSC Strategic Sealift Program Support Office, N103A, requests vessel(s) capable of meeting the transportation requirements described below. The paragraph numbers below apply to the box layout of references (a) and (b), which are incorporated herein by reference (available MSC web site at https://www.msc.navy/mil, under “Contracts,” then “Proforma” or upon request), and shall be the charter form of any contract resulting from this solicitation. By submission of a proposal, the offeror confirms agreement with all terms and conditions of this solicitation and the charter form, unless otherwise identified therein.

INSTRUCTIONS.

27a. Solicitation incorporates by reference FAR 52.212-1 and 52.212-4; 52.212-3 (Alt 1) and

52.212-5 are incorporated by full text.

A. PART I. SPECIALTIME BOXES:

1. Vessel Required:

a. General: This requirement is for one U.S. or foreign flag Tanker to be used during the underway phase of Exercise SEACAT 2021, 13 August 2021 to on or about 20 August

2021. The vessel will serve as a training platform to facilitate compliant boarding exercises in Southeast Asia:

On or about 13 August 2021, the vessel will depart Manila to conduct a simulated boarding in the vicinity of Manila in the South China Sea, then travel along the Western Philippine coast line on a southerly course and then to the

Eastern coast of Palawan via Mindoro Strait, and exit at the Balabac Strait to facilitate multiple boarding’s. From there the tanker will transit along the western coast of Borneo to facilitate boarding’s from Indonesia and Brunei from 16-20 August 2021. The vessel will terminate requirements in the vicinity of Brunei upon conclusion of final boardings on or about 20 August 2021.

Tanker: Manila Bay, Philippines or a designated anchorage in vicinity of

Manila and travel to Borneo or designated anchorage in the vicinity of Borneo.

On 13 Aug at 1200 hrs. (local) or upon completion of the vessel on-hire process by the

Military Sealift Command Far East Office, the Charterer will conduct a teleconference with Tanker Vessel and the exercise participants via CISCO WEBEX to introduce the participants and to go over the schedule of events.

During the duration of the exercise, the vessel will receive instructions to reach waypoints at set times via satellite phone, IRIDIUM preferred, and AIS Chat at various set points. All vessels will be equipped with a satellite phone if all other available communication methods fail. The vessel will have onboard as a member of the crew at least one proficient English speaker.

Security forces from partner nations participating in the exercise will simulate conducting compliant boarding at sea for training purposes in the Visit, Board, Search, & Seizure (VBSS) training scenario at designated locations during the transit, which will be provided to the ship’s Master. Due to constraints imposed by the novel

COVID-19 pandemic, all boarding events will be a hybrid model exercise. Every requirement will take place up to querying and directing the vessel to stop their engines except for physical boardings of the vessels in order to minimize the direct human contact.

Simulated boardings by these partner nation security forces will occur in operational areas off the coasts of Philippines, Brunei, Indonesia, and Eastern Malaysia. Exact operation areas will be identified prior to the start of the exercise and may be adjusted to obtain improved sea states or less maritime traffic.

b. The Government will consider vessels with the following specifics:

(1) Coastal or Medium Ranger Tanker (Oil/Product/Chemical)

LOA of 75M-200M

Beam between 15M - 33M

Minimum Speed of 12 Kts

Freeboard minimum of 3M and maximum of 7M

Means of VHF Voice Communications in addition to Voice Satellite

Communications (IRIDIUM phone preferred)

At least one member of the crew will be proficient in English

6. Terms & Conditions:

ADD: “Health and Safety Requirements:

a. Owner shall provide the MSC Area Commander with any report required under U.S.

Coast Guard Marine Safety Information Bulletin 02-20 (Change 3) (requiring hazardous conditions be reported), prior to entering the port.

b. Owner shall provide in its proposal its company’s health and safety plans for its crew, related to the novel coronavirus for this mission. The plan will become part of the contract.

c. With respect to Restriction of Movement (ROM) procedures/COVID testing provisions, this portion of the plan will be evaluated to ensure it meets or exceeds MSC QMS requirements and provisions as relates to routine crew rotations; the MSC QMS is available upon request. An unacceptable plan as relates to routine crew rotations will render an offer ineligible for award. Alternatively, in lieu of having their ROM procedures/COVID testing provisions evaluated as part of contract award, or meeting

MSC QMS requirements, an offeror may warrant that they will not conduct any routine crew changes during the course of the charter.

d. Any and all costs related to all crew changes/rotations shall be for the responsibility and account of the owner, who shall notify the Contracting Officer not later than two weeks prior to the crew change/rotation.

e. Owner is advised that due to the time-sensitive and critical nature of the mission, including environmental factors, the Excusable Delay provision shall not apply if delay was caused by a breach of Owner’s Health and Safety Plan cited above, or was otherwise reasonably preventable by following U.S. Coast Guard or Center for Disease Control

COVID-19 guidelines in publication at the time of breach.

f. The ship-owner agrees that crew and other embarked personnel may be ordered by the charterer to stay aboard the vessel during port visits under this charter as deemed necessary by the charterer or local government authorities. Further, the ship-owner agrees that the charterer may limit access to the vessel by any shore-side personnel upon the vessel’s port calls during this charter.”

AMEND: PART XI(A). FAR 52.212-2 EVALUATION -- COMMERCIAL ITEMS (tailored pursuant to FAR 12.302(a)) – SPOT CHARTER, page XI-2 – (e) Price. a. to read as follows:

The offeror’s price proposal will be evaluated based on the value of the charter hire rates offered for the entire charter period, cost of fuel, and any other costs set forth in the offer. For evaluation purposes, the period of performance will consist of the number of days specified in the individual solicitation. Fuel calculations will be based upon (a) 5 days underway laden at the speed specified in the individual solicitation (SPECIALTIME Boxes 68 and 70); (b) 2 days underway loitering as specified in the individual solicitation (SPECIALTIME Boxes 69 and 70);

and (c) 1 day in port idle (SPECIALTIME Box 71). This will represent the overall price to the

Government.

ADD PART XII(b)(4) FAR 52.204-26 Covered Telecommunications Equipment or Services-

Representation (OCT 2020)

Offerors shall use the guidelines set forth in Part X(a) for submission of offers; however, at a minimum, offers must contain the following:

Proposals must be submitted via e-mail in Adobe Acrobat (.pdf) format, and must be compatible with Adobe Acrobat Reader 8.0 or later version.

Proposals must contain either a verifiable electronic signature (e.g. PKI enable certificate), or a scanned image of the handwritten signature of the Offeror or Offeror's agent.

Offerors are advised that delays in the receipt of e-mail do occur, and the Offeror is solely responsible for timely receipt of offers by the Government regardless of any problems or delays related to computer hardware or software systems including, but not limited to, servers and firewalls. An E-mail proposal that resides on a Government server, but has not appeared in the designated E-mail inbox by the due date and time for proposal submission will be considered late.

Offerors are advised that the Government may be unable to receive other types of electronic files (e.g., .zip files) or files in excess of 20 megabytes.

Owner agrees that no routine crew changes will occur during the course of the charter and that all costs (e.g., transportation, Restriction of Movement, or other quarantine costs) associated with any non-routine crew changes shall be the responsibility of the Owner and not the Charterer.
