Justification and Approval for Other Than Full and Open Competition “Sole Source Acquisition”

1. Agency/Contracting Activity: Defense Health Agency (DHA), Directorate of Procurement (DoP), Contract Operations Division – Falls Church (COD-FC).

Requiring Activity: Defense Health Agency (DHA), Strategic Management Directorate, Communications Division

2. Nature and or Description of Action being approved: This is a Justification and Approval (J&A) pursuant to Federal Acquisition Regulation (FAR) 6.302-1 “Only one responsible source and no other supplies or services will satisfy agency requirements”. This action’s intent is to award a sole source firm-fixed price contract to Booz Allan Hamilton (BHA) to support the existing level of effort under Bridge Task Order #HT9402-14-F-0009 for Marketing and Education Support Services (M&ESS). The existing contract has a total period of performance of September 2, 2014 and expires on February 29, 2016.

3. DESCRIPTION OF SUPPLIES/SERVICES: This award provides for the continuation of Marketing and Education Support Services provided by BAH in support of the DHA Communications Division’s TRICARE Marketing and Education Program. BAH assists the Communications Division in developing communications content, including all marketing, educational media, and beneficiary educational materials under NAICS Code 541820, Public Relations Consulting Services. The current task order HT9402-14-F-0009 is a Time and Materials contract. BAH has a clear understanding of the contract requirements because the requirements have been repetitively acquired and the risk to BAH is minimal. Therefore, the bridge contract will be awarded as a Firm Fixed Price contract. The period of performance is a 6 month base (March 1, 2016 to August 31, 2016) with an option to extend services for 6 months (estimated September 1, 2016 to February 28, 2017). FAR Clause 52.217-8 Option to Extend Services will be included in the proposed contract action. The first 6 month base period is estimated to be 000000000000 and total price including the FAR 52.217-8 Option to Extend Services is estimated to be 000000000000. DHA FY2016 O&M funds will be utilized for the base period of this bridge contract. A contract (and combine work from two other DoD contracts) is currently being planned for re-compete and is expected to be awarded no later than September 2016.

4. Statutory Authority Cited: 10 U.S.C. 2304(c)(1), FAR 6.302-1(a)(2)(iii)(B) - Only one responsible source and no other supplies or services will satisfy agency requirements. For DoD, NASA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency’s requirements.

There are other possible sources, however, due to time constraints competing this short term requirement among other possible sources would lead to substantial duplication of costs and unacceptable delays which would incur a break in service.

The incumbent, Booz Allan Hamilton (BAH), currently possesses the operational infrastructure and knowledge and is the only logical source to perform the continuation of Marketing and Education Support Services; to prevent disruption or unnecessary delays to crucial TRICARE mission support and prevent severe impact to TRICARE beneficiaries. Any other contractor awarded this effort would require transition-in and stand-up-time (to hire personnel, obtain CAC cards, etc.) in order to be prepared to satisfy the DHA requirements, which would result in a gap in services. Moreover, considering the short duration of this contract, the costs to the Government of gapping the services while competing the requirement and the cost of transitioning in a new contractor would far exceed any potential savings that could be gained by competing the requirement.

BAH has satisfactorily supported the DHA providing Marketing and Education Support Services for the TRICARE beneficiaries and the DHA Communications Division in the current contract mentioned above.

6. Efforts to Obtain Competition: Bids, proposals, or quotations have not been solicited as prescribed by FAR 5.207(c)(15). A direct award will be made to the incumbent Booz Allan Hamilton. Based on the expected short term of the bridge contract and the authority of FAR 6.302-1(a)(2)(iii), the Government can make an award to the incumbent in the case of follow-on contracts. Proposals will be solicited for the follow on contract action with an anticipated award date of

The proposed bridge contract action will be synopsized in accordance with FAR 5.207, noting that pursuant to FAR 5.102(e) the Government only needs to provide copies of a solicitation issued under other than full and open competition to firms requesting copies that were not initially solicited, but only after advising the requester of the determination to limit the solicitation to a specified firm or firms as authorized under FAR Part 6.3.

7. Actions to Increase Competition:

The current contract for these services will end February 29, 2016. A competitive acquisition which combines this current contract, with 2 similar contracts (DHA Falls Church contract HT0011-15-C-0006 and Army contract W81XWH-11-F-0291) is currently being worked within COD-FC for a full and open competitive award through GSA Professional Services Schedule.

8. Market Research: In accordance with DFARS PGI 206.302-1(d), a request for information (RFI-16-006) was posted to FBO on November 10, 2015 and closed on November 17, 2015. Thirty-one (31) vendors responded to the RFI. Although there are other sources available that can meet the Government’s statement of work, none would have the infrastructure or recently accrued expertise available to support a fully functional Marketing and Education Support

Services effort without significant lead time, greater incurred costs in the near time, duplication of efforts and substantial investments of time and resources by the Government.

9. Other Facts:

a. Historical data. The Defense Health Agency – Aurora, Colorado awarded Task Order

HT9402-14-F-0009 against GSA Contract GS23F0184N, to Booz Allan Hamilton (BAH), with an original period of performance of September 2, 2014 to February 28, 2015. The contract also included FAR Clause 52.217-8 Option to Extend Services. On February 23, 2015, the contract was extended utilizing the FAR 52.217-8 clause for an additional 6 month period of performance ending August 31, 2015.

b. Due to the DHA reorganization and its impact on defining requirements, the follow-on recompete acquisition couldn’t be completed prior to the task order end date of August 31, 2015.

Therefore, DHA Aurora awarded a 6 month bridge contract, via modification P00004 to existing Task Order HT9402-14-F-0009. This 6 month bridge was supported by a Limited Sources Justification in accordance with FAR Part 8.405-6 (Tracking #JA15-0161). P00004 extends the period of performance to February 29, 2016.

10. Interested Sources: RFI-16-006, posted to FBO on November 10, 2015 revealed the 31 following interested sources:

All though the RFI revealed interested sources, Booz Allan Hamilton is the incumbent and is the only interested source who can provide continuation of these services on a short-term basis without the Government incurring start-up delays or incurring additional expense.

11. Methods to overcome barriers: The agency is currently developing a new solicitation utilizing the GSA Schedules with full and open competition. The anticipated award date is
