USE OF OTHER THAN FULL AND OPEN COMPETITION LESS THAN SIMPLIFIED ACQUISITION THRESHOLD MEMO
FROM:
CODE:
SUBJECT: Sole Source/Brand Name Justification / Limited Source Justification for Use of Other than Full & Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)
I. BACKGROUND
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.
II. DESCRIPTION OF ITEM OR SERVICE (include manufacture/sole source name and address)
NSWCCD Code is requesting the purchase of a state-of-the-art motion capture system. This system includes 16 motion tracking cameras and the associated hardware (e.g., network card, markers, calibration equipment) and software needed to run the system. Due to existing hardware and software at Carderock and the required system capabilities, the suggested manufacturer for this system is:
MANUFACTURER: NaturalPoint, Inc.
ADDRESS: 3658 SW Deschutes St, Corvalis, OR 97333
PHONE: 541-257-2336
POC: Brent Mason
The estimated price for this purchase is $ . The required delivery date is due to FY22 expiring funds ( ).
III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION
· A. BRAND NAME:
Item required must be a brand name product, or feature of a product, particular to one manufacturer.
· 1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

· 2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).
· 3. Other Reasons:
☒ B. SOLE SOURCE (select all that apply)
· 1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.
☒ 2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
Code is running the Unmanned Aerial Systems (UAS) Lab under the overarching unmanned systems development at Carderock. With unmanned systems being a critical strategic pillar, this motion capture system is a key component to opening up avenues of research and revenue streams for the center. It enables detailed tracking and, ultimately, development of control system architecture and teaming between different unmanned agents (aerial, surface, and underwater).
Carderock currently has existing hardware (cameras) and software that are only compatible with other Natural Point components. While it is true that this system is the only available system that meets the technical requirements, it is also the only system that has products that can interface with current motion capture capabilities at Carderock. Interfacing with existing equipment is critical to developing a large-scale robust motion capture capability at Carderock.
A search for other motion capture systems was done via reviewing technical literature, by web search, and in consultation with scientists and engineers in Code . While other systems do exist, they do not meet the technical requirements for the motion capture in large-scale facilities with the resolution we need and are not compatible with existing components at Carderock.
Therefore, in accordance with FAR 13.106-1(b)(1)(i) the contracting officer has determined that the circumstances of this contract action deem only one source reasonably available.
☒ 3. Other Reasons: The system must be compatible to existing system currently by the Code .
