Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.

II. DESCRIPTION OF ITEM OR SERVICE

The Carderock Division Naval Surface Warfare Center Code 80IT intend to purchase the following:

ShipConstructor 2025 Suite Ultimate Edition, Qty of 4; ShipConstructor 2025 Suite Ultimate Edition, Qty of 4;

EnterprisePlatform 2025 ShipConstructor, Qty of 4, ShipConstructor 2025 Suite Ultimate Edition (Qty1); ShipConstructor 2025 Suite Ultimate Edition(Qty1); EnterprisePlatform 2025 ShipConstructor (Qty1); ShipConstructor 2025 Suite Ultimate Edition(Qty1); ShipConstructor 2025 Suite Ultimate Editio(Qty1);; EnterprisePlatform 2025 ShipConstructor(Qty1);

Software is only available through Ship Constructor USA Inc. DBA SSI. Refer to attached SSJ memo from SSI.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer

(OEM), or there is only one authorized distributor or technical representative for the OEM.

3. Other Reasons: For reasons of software and data compatibility, ShipConstructor software must be procured to perform the ship modelling, design, and fabrication efforts. Code 80 and Code 60 engineers and scientists receive ship and boat data which were modelled using ShipConstructor software. The ShipConstructor files are provided by the Fleet, NAVSEA, and U.S. Navy engineers and scientists. In addition, major marine and naval architecture firms including Ingalls, Gibbs &

Cox, Austal, Huntington Ingalls, Fincantieri and Halter Marine use this software now to model the latest ship designs. For reasons of compatibility, Carderock workforce must use the ShipConstructor software. If Carderock workforce used ship modelling and design software other than ShipConstructor, it would take several months to create ship models from scratch and as a result, stringent U.S. Navy ship design and acquisition schedules would be severely delayed. Any delays in the ShipConstructor software procurement would result in a significant delay in the multi-organizational operations. This software procurement supports the following: 4 for Code 83, 1 for Code 82, and 2 for Code 65. Failure to procure the software by the required timeline will severely impact U.S.

Navy ship design and acquisition schedules.
