NSWCCD Sole Source/Brand Name Justification SAT rev 1 Effective September 2020

USE OF OTHER THAN FULL AND OPEN COMPETITION LESS THAN

SIMPLIFIED ACQUISITION THRESHOLD MEMO

FROM:

CODE: 665

SUBJECT: Sole Source/Brand Name Justification / Justification for Use of Other than Full & Open

Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.

II. DESCRIPTION OF ITEM OR SERVICE (include manufacture/sole source name and address)

Request a follow-on effort with The University of Virginia’s Center for Applied Biomechanics (UVA CAB) to conduct additional reviews of 20 Time Histories and an option for 8 more reviews to assess and define the Range of Occupant Kinematics from Prescribed Deck Motion and the Risk of Blunt Impact Injury from Predicted Occupant Kinematics. UVA CAB is to deliver two separate reports to discuss each topic. The estimated value of this requirement is

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

UVA CAB was awarded a similar effort under N0016722P0053 that met the specific requirements for determining . The requested effort is a follow-on requirement to assess additional data. Consistency in the assessing the data is vital to NSWCCD in defining the range of occupant kinematics and risks.

B. SOLE SOURCE (select all that apply)

3. Other Reasons:

• UVA CAB specializes in impact biomechanics for injury prevention. UVA CAB has worked with other defense agencies, such as Naval Air Systems Command (NAVAIR) and the Army Research Laboratory (ARL), in order to increase survivability. The information produced by the UVA CAB will used to write

NSWCCD Sole Source/Brand Name Justification SAT rev 1 Effective September 2020

• The University of Virginia’s Center for Applied Biomechanics (UVA CAB) is the only lab/private business that specializes in impact biomechanics for injury prevention for automobiles.

• The COLUMBIA (CLB) and Personnel Injury Assessments’ main focus will be on impact biomechanics and how to prevent it.

• A number knowledge that UVA CAB has will be directly applicable

An award to any company/laboratory other than UVA CAB would result in (a) substantial duplication of costs to the US Navy which would not be recovered through competition, (b) UVA CAB’s previous DoD experience would be pertinent to this effort and another company/laboratory’s experience would not be directly comparable, and (c) unacceptable delays in the completion of material selection efforts in support of the Office of Naval Research (ONR) and other NAVSEA program offices as previously stated.
