NSWCCD Sole Source/Brand Name Justification SAT rev 1 Effective September 2020

USE OF OTHER THAN FULL AND OPEN COMPETITION LESS THAN

SIMPLIFIED ACQUISITION THRESHOLD MEMO

FROM:

CODE: 655

SUBJECT: Sole Source/Brand Name Justification / Limited Source Justification for Use of Other than Full &

Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.

II. DESCRIPTION OF ITEM OR SERVICE

The contractor will provide shipboard manufacturing and installation support of the 57mm Composite Impact Protection System (CIPS) for the forward 02 level of the USS TULSA (LCS-16). This tasking requires experience and knowledge of the vacuum assisted resin transfer molding (VARTM) process, execution of the NSWCCD developed aluminum surface preparation process, and the ability to perform both processes pier side and shipboard as defined in the Owners’ Manual for LCS-2 Class Composite Impact Protection System, Maintenance and Repair Manual (GFI item 6.1 in the Performance Work Statement).

In addition to the installation defined by the Owners’ Manual, the contractor will be responsible for material ordering and logistics, supporting Regional Maintenance and Modernization Coordination Office (RMMCO) approval to perform the installation (DoD Instruction TS9090-310G), and installation must be completed prior the end of the LCS-16 USS TULSA Drydock Selected Restricted Availability (DSRA) at Vigor Industrial 5555 N Channel Ave Portland, Oregon, 97217.

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

A. BRAND NAME:

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).

3. Other Reasons:

B. SOLE SOURCE (select all that apply)

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

3. Other Reasons: R&P Technologies LLC is uniquely qualified and the only known source with the technical knowledge, experience and capability to perform the VARTM process remotely in a shipboard environment and at a large scale as required on LCS-16 USS TULSA without causing unacceptable delays to the DSRA schedule.

R&P has gained extensive knowledge and experience as the contractor currently performing the VARTM process shipboard on DDG-1000. Should the Government use a different contractor for the required services, additional time and work would be needed for technical review of contractor certifications and proof of production capability Objective Quality Evidence (OQE) along with additional time and training for the new contractor to obtain the level of knowledge and familiarity with installation of the CIPS. This additional work would result in a 1-2 month delay in project initiation resulting in DSRA schedule milestones for installation approval being missed and the high risk of not performing the installation on LCS-16. Missing the FY23 installation delays installation of the CIPS to FY26, incurring aluminum repair costs of up to $ per year. In addition to missed milestones, there would be an estimated re-work costs to the Government for the vetting of the new contractor plus the time and training on the installation of the CIPS.
