SUBJECT:Sole Source Justification for Use of Other than Full & Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.

II. DESCRIPTION OF ITEM OR SERVICE (include manufacture/sole source name and address) This contract is for the Magnetic Materials Laboratory, University of Colorado, Denver for a one-year period from September 30, 2024-September 29, 2025, to provide critical measurements of magneto-elastic and magneto- thermal hysteretic properties of Navy steels. Accurate measurements are needed so that physics-based magneto- elastic models can be developed and implemented in a computational framework, MAGSTROM. This framework is critically required to support analysis, design, and threat assessments through the development of computer models related to underwater electromagnetic (UEM) signatures of naval ships and submarines.

☒ 3. Other Reasons:

Measuring the magneto-elastic and stress-induced magnetization properties of Navy Steels is critically important as it dictates the Navy’s ability to confidently predict the magnetic signature of Navy vessels in general and submarines in particular. The Navy is currently being required to develop tools and data products for the rapid analysis, design, and threat assessments related to underwater electromagnetic (UEM) signatures of naval ships and submarines. Without this Magnetic Materials Laboratory facility, the Navy will lose the ability to affordably and rapidly design new magnetic signature mitigation systems that will be effective for countering current and future threats. Thus, the Navy will be forced to slow down the design of the next generation of advanced submarines and surface ships.

The Magnetic Materials Laboratory at the University of Colorado, Denver built under the Defense University Research Instrumentation Program (DURIP) program is unique in the nation for its capabilities for the detailed, controlled, and precise measurements of these properties. It was specifically built to make measurements of Navy steels to characterize specific properties of interest to the US Navy. As such, there are no other similar facilities that can meet all our needs because the Navy’s interests are very specific to steel types and ranges of submerged pressure and applied magnetic fields that are unique to the Navy.

Professor is an internationally recognized expert in the fields of magneto-elastic and stress- induced magnetization properties of Navy Steels with unique capabilities of incorporating the measurements into practical computational models. Taken together, funding the Magnetic Materials Laboratory is critical for providing the necessary knowledge in the field of stress-induced magnetization to the Navy. The vendor, . and the Magnetic Materials Laboratory, possess unique capabilities and skills that are critically required by the Navy. As a result, if we were to work with a theoretical new vendor, this new vendor will have to undergo new specialized training and measurement and modeling abilities that this vendor does not possess at the current time. Thus, inevitably, there would be at least an estimated month delay in the Navy receiving the required data products, measurements, and models along with an estimated $ in additional expenses for labor costs to support this training for a new vendor.
