USE OF OTHER THAN FULL AND OPEN COMPETITION LESS THAN SIMPLIFIED ACQUISITION THRESHOLD MEMO
FROM:
CODE:
SUBJECT: Sole Source Justification for Use of Other than Full & Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)
I. BACKGROUND
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.
II. DESCRIPTION OF ITEM OR SERVICE
This contract is for services from Computational Mechanics International Inc. for software maintenance to three
(3) BEASY Corrosion & CP + ICCP Controller Sim (bundle) and three (3) BEASY GiD Interface (USB license). The estimated value of the contract is $ for a one-year period from August 1, 2023 – July 31, 2024. Estimated total for base year renewal and 2 option renewal years is $ . Delivery is required by 7/31/2023, which is when the present license expires; the software will not work after that date.
This software is required to support analysis, design, and threat assessments through the development of computer models related to underwater electromagnetic (UEM) signatures of naval ships and submarines.

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION
· A. BRAND NAME:
Item required must be a brand name product, or feature of a product, particular to one manufacturer.
· 1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.
· 2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).

☒ B. SOLE SOURCE (select all that apply)
· 1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.
☒ 2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
Computational Mechanics International Inc.’s BEASY software is Boundary Element Method (BEM) software package that is specifically suited for analysis of static electric fields. Prediction of corrosion related electric fields is essential to the mission of preventing vessel corrosion. BEASY is used for analysis and prediction of this phenomenon and aids in the development of systems to counteract corrosion.
BEASY is a tool C uses to address static electric problems. These problems include evaluating existing and future ICCP (Impressed Current Cathodic Protection) systems on Navy platforms or showing the effect of exposed, corroded metal. After a model(s) are developed and necessary boundary conditions are applied, the users in C import a meshed model into BEASY wherein the software predicts specific data. When simulations are complete, users evaluate the results from BEASY by comparing them to measured data or other BEASY simulations with different boundary conditions.
Computational Mechanics International, Inc.’s BEASY software is the only known boundary element software which provides an output which interfaces with AutoCAD software.
Per confirmation from Computational Mechanics International, BEASY and supporting modules does not have authorized resellers. Therefore, in accordance with FAR 13.106(b)(1)(i) the contracting officer has determined that the circumstances of this contract action deem only one source reasonably available.
· 3. Other Reasons: Over the five past years Code has built its knowledge of the BEASY software, streamlined the process for creating BEASY models, and now has multiple models developed over several years that will only execute on the BEASY platform. The three personnel utilizing this software would need approximately one (1) year each to learn new software to perform BEASY analysis at a cost of $ plus the cost of the software. Code has also made extensive modifications/additions to our in-house software, so that it interfaces well with the BEASY software. One example is the AutoCad software which accepts and interfaces with BEASY outputs. Modifying Code ’s internal code would take approximately one (1) year at cost of $300,000 plus the cost of the loss of the effort to modify the original in house software.
In addition, the BEASY software has been extensively verified with a series of 20 week-long tests (at approximately $ per test) performed jointly by NSWC and the Naval Research Laboratory (NRL) at the NRL’s Electrolytic Physical Scale Model facility in Key West. Using any software besides BEASY would require that those tests be repeated, at a total cost of $ , and a four year time period, in order to assure the accuracy of the any new software.
