About this file

This document contains a justification and approval for a sole source contract award. The Missile Defense Agency awarded a contract to Raytheon on July 29, 2022 for an unknown amount to complete the Critical Design Review for a high power microwave technology system. Raytheon has successfully performed the preliminary design review for this system and is uniquely qualified to develop the necessary critical design due to their expertise in this specialized area. The agency determined this follow-on contract is an affordable next step to further technology development and inform stakeholders on potential future investments. All data delivered under the contract will have government rights to use for potential future competitive efforts as deemed appropriate.

9. Any Other Facts Supporting the Use of Other Than Full and Open Competition (FAR

Part 6.303-2(b)(9)).

The research and development (R&D) efforts associated with the system-level CDR-T will push beyond the state-of-the-art non-kinetic defense capabilities that are available today. Raytheon has successfully completed the PDR-T for the system which further asserts their capabilities to develop the necessary CDR-T level designs.

10. Actions Taken to Remove Barriers to Competition (FAR Part 6.303-2(b) (11)).

Given budget uncertainties, completion of the CDR-T is an affordable milestone for MDA/DVS.

Results of the CDR-T will be used to inform the Agency, and other interested stakeholders, on whether future investments should be made in this particular high power microwave technology.

The next step for this technology would be the actual build of the MTT system, which could be executed by MDA or another Government organization, depending on funding availability. It can be anticipated for the build to be completed by Raytheon since they will have completed the design work for the system. All technical data products delivered under this contract will have

Government Purpose Rights or Unlimited Rights (unless written authorization is obtained for more restrictive rights from the Contracting Officer) should the Agency or another stakeholder consider a future competitive effort more appropriate.
