| SUBJECT: | Sole Source/Brand Name Justification / Limited Source Justification for Use of Other than Full & Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT) |
I. BACKGROUND
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.
2. FAR 8.405-6(b)(1) states Brand name specifications shall not be used unless the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.
3. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
4. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.
II. DESCRIPTION OF ITEM OR SERVICE
NSWCCD Code 882 is requesting the purchase of a state-of-the-art Pressure Sensitive Paint (PSP) measurement system. This system includes cameras, lenses, LED lighting, software, cables, mounting hardware, pressure sensitive paint formulations, applicator, and pulse generator, etc. In-person training services by the vendor are included so that we know how to operate the system correctly and effectively. This system is needed for collecting critical surface pressure data in the Subsonic Wind Tunnel at Carderock to support Navy testing goals. The required delivery date is April 30 2024 due to project deadlines for required testing. Due to the unique nature of this technology and the very limited market for this capability, it appears that there is only one vendor that sells a complete PSP system. Therefore, the suggested manufacturer for this system is:

Code 882 will be conducting wind tunnel testing to support the USCG, the NSWCCD Unmanned Aerial Systems (UAS) Lab, and programs such as SSNX. To understand vehicle aerodynamics and performance, detailed and accurate surface pressure measurements are critical. A state-of-the-art technique for measuring surface pressures accurately using pressure sensitive paints has been developed, but since this is a fairly new technology in a rather small niche market, to date it has usually only been available to researchers that understand the complex chemistry required to mix and use these unique pressure sensitive paints effectively. However, one company, Innovative Scientific Solutions, Inc (ISSI) has put together a complete pressure sensitive paint measurement system for sale, and ISSI also offers training on how to apply and use the system for accurate pressure measurements. Acquiring a system such as this is a key component to opening up avenues of research and revenue streams for the center, and will result in more detailed and complete surface pressure measurements in the wind tunnel that will greatly benefit Navy programs such as SSNX.
A search for other pressure sensitive paint systems was done via reviewing technical literature, by web search, and in consultation with scientists and engineers in Code 80 and academia. While companies that sell certain components that are used in pressure sensitive paint systems do exist, there is no other company that sells a complete pressure sensitive paint system, and no other company that provides training on the use of such a system. Also, some of the components that are available from these other companies do not meet the technical requirements for use in an effective pressure sensitive paint measurement system.
