JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
41 U.S.C. § 1901

Atlassian Cloud Software – Jira Add-Ons
In compliance with Federal Acquisition Regulation (FAR) 13.501(a)(1)(ii), this justification uses the format at FAR 6.303-2 and is modified to state that the procedures in FAR subpart
13.5 are used.
1. Agency and Contracting Activity.
The Department of Homeland Security, United States Coast Guard (USCG), Aviation
Logistics Center (ALC) proposes to enter into a contract on a basis other than full and open competition.
2. Nature and/or Description of the Action being Approved.
(a) Nature of the action: USCG intends to procure on a brand name basis
Atlassian Cloud software with Jira add-ons for use at ALC.
(b) Name and address of the manufacturer:

(h) Background information about the requirement: The Atlassian Cloud software and Jira add-ons ins this requirement were previously purchased through purchase orders 70Z03823PM0000032 and 70Z03824PM0000020.
3. Description of Supplies/Services.
The Atlassian Cloud software identified in this requirement is required to ensure continued operations of USCG systems for ALC users. This requirement is limited only to the
Atlassian Cloud software and Jira add-ons manufactured by Atlassian Corporation. No

alternative software will be considered.

4. Identification of Statutory Authority Permitting Other Than Full and Open
Competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. §
1901 implemented by FAR Subpart 13.501(a), “Sole source (including brand name) acquisitions.”
5. Identification of Exception to the Buy American Act.
The Buy American Act is not applicable to this requirement.
6. Demonstration that the Proposed Contractor’s Unique Qualifications or the Nature of the Acquisition Require Use of the Authority Cited.
(a) Rationale for using the authority cited in section 4 of the J&A;
Atlassian Corporation is the Original Equipment Manufacturer (OEM) for the
Atlassian Cloud software and Jira add-ons identified in this requirement. Atlassian
Corporation is located in Sydney, Australia, and all rights to the data are proprietary

in nature. Atlassian Corporation does not contract directly with the government, so an authorized OEM distributor must be used for support in the United States. The
USCG currently utilizes the Atlassian Cloud software and Jira add-ons for daily operations in ISD. This software is used to support Agile and Development
Operations (DevOps), IT Service Management, and Work Management for the
USCG systems portfolio that ISD manages. This Atlassian Cloud software and Jira add-ons allow for full visibility of what each team is working on, management of product changes and updates in real time, 24/7 high priority, dedicated support with a guaranteed 30-minue response time, and enhanced security. Switching from this software to similar software would require a complete redesign of ISD’s processes and infrastructure, resulting in a significant amount of cost and administrative burdens.
(b) Details covering what events lead to the situation requiring use of other than full and open competition procedures including whether any portion of the work can be segregated to allow for competition.
Market research was conducted to see if any alternative software solutions would be acceptable for this requirement, however the results did not produce any suitable alternates. The results of the market research indicate other companies’ similar products lack the particular feature(s) required and do not meet, or cannot be modified to meet, the needs of the USCG. Specifically, none of the other products were able to interconnect and function with current USCG network architecture, maintenance platforms, and configuration.
(c) Summarize alternatives considered and why they will not work.
Procuring alternative software solutions were researched and considered, however they would require a complete infrastructure replacement with a significant increase in cost. Only the Atlassian Cloud software and Jira add-ons manufactured by
Atlassian Corporation will suffice for this requirement as the use of other products could result in interoperability, compatibility, interface issues that would preclude the system’s support team from providing efficient and effective customer support.
(d) Impact to the mission that would result if the J&A is not approved and, consequently, the product or service not provided.
If this justification is not approved, ALC runs the risk of major systems being shutdown and inoperable, resulting in delays and severely impacting ALC’s mission.
With ISD providing IT services to other USCG entities in addition to ALC, this could impact major systems USCG-wide. This would directly impact the USCG’s ability to conduct search and rescue, law enforcement, international ice patrol, marine environmental protection, marine resource conservation, and various other
USCG missions.

7. Description of Efforts Made to Ensure that Offers are Solicited from as Many
Potential Sources as is Practicable.
(a) If an announcement is being planned for posting in SAM.gov, provide the estimated date of publication.
After approval of this Justification for Other than Full and Open Competition, a combined synopsis/solicitation will be advertised on SAM.gov website and will include a statement that all responsible sources may submit a quotation or capability statement which shall be considered by the agency.
(b) If an announcement will not be published, identify the applicable exception under FAR
5.202.
The exception under FAR 5.202 do not apply to this requirement.
8. Determination by the Contracting Officer that the Anticipated Cost to the
Government will be Fair and Reasonable.
The Contracting Officer anticipates prices for this procurement will be fair and reasonable based on competition as it is expected multiple quotes will be received for this requirement.
Pricing provided from any vendor will be evaluated based on competition (FAR 13.106-
3(a)(1)) received and past purchase history (FAR 13.106-3(a)(2)(ii)) to ensure the resultant purchase order is in the best interests of the government.
9. Description of Market Research.
(a) Describe the market research techniques used, results, date when the market research was conducted, and how it was used by the contracting officer to determine price reasonableness.
Market research was conducted between August and September 2024 by performing internet searches, researching possible strategic sourcing vehicles, a search on the interagency contract direct portal, governmentwide acquisition contracts (GWAC), review of AMMIS database past purchase history, searching required sources of supply (Unicor, AbilityOne, and GSA Advantage). This research provided negative results.
The USCG researched similar cloud services software offered by Microsoft, GitLab, and
IBM, however none of these alternatives utilize the Jira add-ons required. The Atlassian
Cloud software and Jira add-ons are already established within the USCG C5ISC data center and the USCG is expanding the add-ons in this requirement to properly perform program management for enterprise customers. No other software on the commercial marketplace is capable of providing the current setup the USCG utilizes with the Atlassian software identified in this requirement.

The USCG reached out to identified partners of Atlassian Corporation and identified that multiple small businesses (Clovity, Inc. and Joltec LLC) were capable of providing the
Atlassian Cloud software and Jira add-ons identified in this requirement. A Rough Order of
Magnitude from each to assist in developing the Independent Government Estimate.
This procurement was also forecasted on the APFS website as F2024067435 on 4
September 2024. No companies have contacted the USCG do date to request information on this APFS entry.
The USCG has determined that issuing the proposed purchase order to any small business capable of providing the Atlassian Cloud software with Jira add-ons identified in this requirement represents the best value for the government.
(b) If market research was not conducted, state why.
Not applicable. Market research was conducted in accordance with FAR Part 10 from
August through September 2024.
(c) If patents, copyrights, and/or intellectual property are applicable to the acquisition, describe the circumstances for acquiring a patented or copyrighted product on the representation of the intellectual property holder that has not been licensed for resale.
Patents, copyrights, and/or intellectual property are not applicable to this acquisition.
This information is proprietary to Atlassian Corporation, and they have maintained the position they are not willing to sell this information.
10. Any Other Facts Supporting the Use of Other Than Full and Open Competition.
None.
11. A Listing of the Sources, if Any, that Expressed, in Writing, an Interest in the
Acquisition.
APFS F2024067435 has been published and to date there has not be any interest expressed in this requirement from any additional sources.
12. A Statement of the Actions, if Any, the Agency May Take to Remove or
Overcome Any Barriers to Competition Before Any Subsequent Acquisition for
Supplies or Services Required
The USCG does not possess the technical data required to foster full and open competition for the Atlassian Cloud software and Jira add-ons identified in this requirement. Due to the proprietary nature of the identified Atlassian Cloud software and Jira add-ons of this requirement, the government has little to no leverage on overcoming the brand name barriers for this acquisition. The USCG will continuously conduct market research on the possibility of acquiring the data rights for the identified software to promote full and open competition.
