DLA Land at Aberdeen Justification for Other Than Full & Open Competition (May 2018)

1. The Defense Logistics Agency (DLA) Land at Aberdeen is the contracting activity.
2. The action being approved is the acquisition of supplies/services on other than a full and open competition basis.
3. The supplies/services required to meet the using activity’s needs are described as follows:

Identify end item, weapon system, or class of item: This requirement is for the procurement of the two (2) Intelligent Power Technology (IPT) (digital) Generator Sets, Diesel Engine (Gensets) identified above. The Gensets are mounted on the Trailer Mounted Support System (TMSS) and provide power to the TMSS. The Standard Integrated Command Post System (SICPS) Family of TMSS, in which the Gensets are to be integrated into a turnkey, Non-developmental Item/Commercial system, is comprised of an environmentally controlled tent, an environmental control unit (ECU), a supporting power unit for the ECU, and a trailer. The Government requires three phased Gensets rated for 18kW and 33kW with an IPT feature that enables connectivity between generators, allowing for efficient power production also known as “smart grid” technology. The 18kW Genset will bolt onto the TMSS Medium trailer while the 33 kW Genset will bolt onto the TMSS Large trailer, both with no modifications.

Brief narrative supporting the situation and weapon system: This Justification and Approval (J&A) supports a solicitation using other than full and open competition procedures for a one-time, Firm-Fixed-Price (FFP) supply contract to procure the two (2) spares identified above. While the Gensets are commercially available Line Repairable Units (LRUs), the Government requires spare parts that are form, fit, and functionally compatible with the TMSS. Even though the TMSS is a part of the SICPS, the Government does not possess the detailed Technical Data Package (TDP) that describes the complete characteristics of the TMSS, which would be required for full and open competition. Currently, back orders exist and failure to award the proposed contract will detrimentally impact the components utilizing the Gensets.

HDT (92878), the Original Equipment Manufacturer (OEM), located at 30500 Aurora Rd, Solon, Ohio, owns the TDP and is the only known manufacturer of the Gensets capable of meeting the specifications of the TMSS.
HDT controls the configuration management of the Gensets required to meet the form, fit, function of the TMSS.
In an email to , HDT’s Manager of Business Development Operations, on August 7, 2020, the Contracting Officer asked if HDT was willing to sell the TDP and, if yes, to provide the estimated cost to purchase.
The response received on August 10, 2020, stated “HDT is not interested in selling the TDP for the listed Gensets at this time.”

6. Efforts to ensure that offers are solicited from as many sources as practicable are:
[X] The acquisition will be publicized using combined synopsis and solicitation procedures on beta.SAM.gov in accordance with Federal Acquisition Regulation (FAR) 5.203(a)(2). The standards set forth at FAR 5.207(c)(16)(ii) will be included in the posting to instruct all responsible sources to submit capability statements or quotations.
7. The Contracting Officer:
I hereby determine that the anticipated cost to the Government will be fair and reasonable based on the analysis of other than certified cost and pricing data pursuant to FAR 15.403-3(a)(1)(ii) and price analysis.
8. Market Research/Efforts to Obtain Competition:
In accordance with FAR Part 10, market research began with Sources Sought Announcement (SSA)/Market Survey Number Genset 20200114 posting on January 21, 2020. The only response received was from HDT. The Contracting Officer posted another SSA to beta.SAM.gov on August 10, 2020 and only the OEM responded. One independent distributer, B&H International (BHI) LLC, (CAGE 768R4) a Woman-Owned Small Business, can supply the HDT part as a reseller and stated they will provide a quote for this action.
Additional research conducted included searches of the internet, i2Log, WebFLIS, Haystack Gold, DLA Internet Bid Board System (DIBBS), Suppliers Performance Risk System (SPRS), with emails and phone calls to interested small businesses and the OEM. The research confirmed the Gensets are Commercial off the Shelf (COTS) Items that are available to the public with distributors. Without the complete TDP however, other interested offerors are unable to supply these spares to meet the requirements of the TMSS. Searches of i2Log, DIBBS and Haystack Gold shows no history of previous purchases of these spares.
