SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL

ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID: 36C249-22-AP-2488

1. Contracting Activity: Department of Veterans Affairs, VISN 09, James H. Quillen VA Medical Center, VA Police Service, Building 69, Room H110, Mountain Home, TN 37684. 2237# 621-22-3-4091-0048

2. Nature and/or Description of the Action Being Processed: This procurement is for the purchase of Install Avigilon Security Cameras NVR Servers and network switches. This purchase ensures compliance with HR1555, HSPD12 EPACS Mandate, VA Handbook 0730/4 and Physical Security Design Manual by installing Avigilon Security cameras and equipment in the IT Server Room 3A109, building 77. New equipment will connect to the existing Avigilon Security Cameras System. This will be a firm fixed priced purchase order in accordance with FAR 13.5 Simplified Acquisition Procedures for Certain Commercial Items. This will be a new contract and award, is not bundled, and will be sole source to Johnson Controls Security Solutions (JCSS).

3. Description of Supplies/Services Required to Meet the Agency’s Needs: This procurement is for the purchase of the below listed cameras, servers, and switches required to integrate with existing security systems. The below also includes warranty service. Under HSPD12-EPACS requirements, the ability and certification to work on the Security Systems at James H. Quillen VAMC mandates all work must be completed with oversight by a Certified System Engineer ICAM (Identity, Credential, and Access Management) PACS (Physical Access Control Systems) (Secure Technology Alliance), CSEIP company. Johnson Controls Security Solutions has this certification and is currently vetted through the Federal Government background security clearance protocols.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition

Requires the Use of the Authority Cited Above (applicability of authority): The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. James H. Quillen VAMC Police Services currently has approximately 550 Avigilon Security Cameras and 8 Avigilon NVR Premium Servers that are in compliance with HR1555. These cameras and servers were installed under contract 36C24921P0327 and the equipment is covered under a 5 year warranty period. Alternate security cameras/servers will not be compatible with existing systems nor guarantee compliance to meet House Resolution 1555. The new equipment must fully integrate with the existing system. In addition, use of any other company or products would void the warranties and services currently in place.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A notice of intent to sole source (RFI 36C249-22-Q-0380 was posted from 5/20/22-5/31/22 without response from interested vendors. Therefore this will be sole source award to JCSS.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer will conduct pricing analysis in order to determine price fair and reasonable, by comparing quoted rates to the Independent Government Cost Estimate (IGCE), review of historical pricing of the equipment awarded for other Medical Centers, and current market rates.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted: A search of the VetBiz Portal found 156 vendors. None of these are able to perform the contract due to the proprietary nature of the procurement. In addition a notice of intent was posted to contract opportunities without response from any interested parties. Therefore there is no reasonable expectation any other company could perform the contract. Contract will be awarded as a sole source in accordance with FAR 13.106-1 (b)(2).

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: James H. Quillen

VAMC must be in compliance with federal mandates HSPD12-EPACs, HR1555, VA Handbook 0730/4 and VA Physical Security Design Manual requirements. JCSS has demonstrated their ability to provide reliable service with local technicians who have previously installed all the current Avigilon Security Cameras System in use and still under warranty. JCSS is vetted through the Federal Government background security clearance protocols and is CSEIP certified.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: For future acquisitions of similar nature, thorough market research will be conducted to see if competition can be obtained.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
