Department of the Army Justification for Exception to Fair Opportunity Under
Multiple Award Indefinite Delivery Contracts
1. Contracting Activity: U.S. Army Contracting Command – Rock Island (ACC- RI), Rock Island Arsenal, Rock Island, IL 61299-8000.
2. Description of Action: Program Executive Office-Enterprise Information System Project Manager, Defensive Cyberspace Operations (PM DCO) requests a firm-fixed-price (FFP) contract modification for additional EnCase Endpoint Investigator training to FFP Task Order (TO) W52P1J-21-F-0360, which was awarded against the Computer Hardware, Enterprise Software and Solutions (CHESS), Information Technology Enterprise Software and Solutions 3 Services (ITES-3S) Indefinite-Delivery, Indefinite-Quantity (IDIQ) contract, W52P1J-18-D-A136, to CKA, LLC (CKA).
ACC-RI awarded TO W52P1J-21-F-0360 to CKA on 25 June 2021 for a total estimated value of for EnCase Endpoint Investigator Maintenance, along with optional Contract Line Item Numbers (CLINs) for training and professional services, for the EnCase Endpoint Investigator software licenses previously procured under a separate contract. In support of the Army’s Forensics and Malware Analysis (F&MA) mission, EnCase Endpoint Investigator software provides global Cyber Protection Teams (CPTs) with sensors, active detection, network analysis, threat emulation, forensic analysis, web scanning, planning and visualization tools allowing them to conduct live-box and dead-box forensics. Live-box analysis is a technique that preserves and harvests vital evidence from a computer's physical memory. Traditional cyber forensics have focused on dead-box analysis, but there is an emerging methodology for live-box analysis. In order to conduct dead box forensics, units must ship the physical hardware in question to Fort Gordon, GA for analysis. Live-box forensics can be conducted over the network, eliminating shipping costs and reducing mission time.
EnCase Endpoint Investigator allows the CPTs to conduct both live and dead box forensic analysis. The only known source of certified maintenance support, training, and professional services for EnCase Endpoint Investigator is through OpenText, Inc.
(OpenText). Therefore, PM DCO required that all maintenance support, training, and professional services be provided by OpenText or a Certified OpenText Partner to meet the quality of maintenance, training, and professional services required to meet PM DCO’s mission. A Letter Request for a Task Order Proposal (RFTOP) for the original requirement was posted to and competed against CHESS ITES-3 small business vendors that could quote EnCase products. This RFTOP was issued as a brand-name for EnCase products under the purview of Justification for Exception to Fair Opportunity - Brand Name Under Multiple Award Indefinite Delivery Contracts Control Number 21-051 in accordance with (IAW) Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B) and FAR 16.505(a)(4), The supplies or services to be ordered are unique or highly specialized by brand name. under CHESS ITES- 3S is capable of providing the supplies or services required at the level of quality

Price analysis will be performed on the pricing data IAW FAR 15.404-1(b)(2)(ii), comparison of the proposed prices to historical prices paid, whether by the Government or other than Government, for the same or similar items, and FAR 15.404-1(b)(2)(v), comparison of proposed prices with the Independent Government cost estimate. As this a commercial item, certified cost or pricing data is not required per FAR 15.403-1(b).
