Justification and Approval for

FAR Subpart 6.3 Other than Full and Open Competition J & A Tracking No. 20-0009B - 2nd Amendment

This J&A is being amended at this time and the format is designed to show the prior history as well as the new requirement.

Paragraph 2, “Nature and/or Description of Action being approved” is amended

From:

Approval is being requested for a bridge contract extension modification of the Recovery Coordination Program to the incumbent Armed Forces Services Corporation for six (6) months to support the existing level of effort allowing for continuity in services for the Defense Health Agency (DHA), Deputy Assistant Directorate (DAD) Medical Affairs (MA). The current contract provides professional and management support services and expires on 16 January 2020.

The required procurement documents have been submitted to the PS-CD and CSD continues to work with the Contracting Division to amend the documents for a resultant follow-on competitive contract award for the Recovery Coordination Program (RCP). The bridge contract extension modification will prevent a gap in necessary services and will provide adequate time to complete the acquisition process for award of the follow-on competitive contract. The six (6)-month period of performance of this bridge contract extension modification will commence on 17 Jan 2020 thru 16 Jul 2020. . The estimated cost of this bridge contract extension modification is FY20 Operation and Maintenance funds will be used for this effort.

To:

Approval is being requested to extend the period of performance (PoP) of the current Recovery Coordination Program (RCP) bridge contract, HT0011-19-C-0006, to the incumbent Armed Forces Services Corporation (AFSC) to support the existing level of effort. This sole-source extension does not provide for new work or a change in scope, but is needed to complete work that is currently being performed. The current contract provides professional services for the Defense Health Agency (DHA) Deputy Assistant Directorate (DAD) Medical Affairs (MA) and is expiring on 16 July 2020. The extension will prevent a gap in necessary services and will provide the agency with sufficient time to complete the evaluation of offers and award a follow-on contract. The period of performance will be four (4) months followed by two (2) one (1)-month extension periods for a total of six (6) months with a period of performance form 17 July 2020 thru 16 January 2021.

Paragraph 3, “Description of Supplies/Services” is amended

Although there are other sources that can meet the Government’s requirements, none would have the infrastructure or expertise available to provide the administrative and operational support without significant delays, lead-time, incurred costs, duplication of efforts and substantial investments of time and resources by the Government. Therefore, a waiver was submitted to the Head of Contracting Activity as specified in paragraphs eight (8) and nine

(9) below. Waiver approval was granted on December 4, 2019.

Although there are other sources that can meet the Government’s requirements, none would have the infrastructure or expertise available to provide the administrative and operational support without significant delays, lead-time, incurred costs, duplication of efforts and substantial investments of time and resources by the Government. Therefore, a waiver was submitted to the Head of Contracting Activity as specified in paragraphs eight (8) and nine

(9) below. Waiver approval was granted on June 11, 2020.

Paragraph 6. “Efforts to Obtain Competition,” is amended

From:

A notice of action under this approval for other than full and open competition was not synopsized in accordance with FAR Subpart 5.2. Instead, a waiver was submitted to the Head of Contracting Activity as specified in paragraph five (5) above as well as paragraphs eight (8) and nine (9) below. Waiver approval was granted on December 4, 2019. However, proposals will be solicited for a follow-on contract upon the requiring activity’s completion of the requirements development for the follow-on contract.

The Government intends to issue a Bridge contract extension modification. Market Research was conducted July 30, 2019, using The System for Award Management as a routine course of action in pursuit of identifying competition for the follow-on contract and for price comparison for the Bridge contract extension modification. Five contractors were identified, four of which were small businesses. The sensitivity and complexity of the work coupled with the geographical requirements make this procurement challenging. Although there are other sources available that can meet the Government’s requirements, none would have the infrastructure or depth of knowledge needed to support the Warrior Care requirements without significant delays, lead-time, incurred costs, duplication of efforts and substantial investments of time and resources by the Government. This extension of services will prevent a gap in necessary services and provide the agency with time to complete the acquisition process for award of the follow-on contract. Therefore, a waiver was submitted to the Head of Contracting Activity as specified in paragraph five (5) above as well as paragraph nine (9) below. Waiver approval was granted on December 4, 2019.

This bridge contract extension modification is being implemented in order to keep current business operations and administrative services operational while the Government continues to work with the Contracting Division to amend procurement documents in order to subsequently award a follow-on competitive contract for the Recovery Coordination Program (RCP). A waiver was submitted to the Head of Contracting Activity as specified in paragraph five (5) above as well as paragraph eight (8) above. Waiver approval was granted on December 4, 2019.

Historical data. This contract was previously awarded to AFSC.

1. A Justification and Approval Tracking JA16-0011 (Award HT0011-16-C-0003) was approved on December 15, 2015, citing the authority of FAR 6.302-1(a) (2) (iii) (B).The tasks in this action are ongoing work on contract vehicle W91WAW-11-D- 0031 under Task Order 2E08 which was competed under full and open competition.

The Department of the Army vehicle ended on 26 January 2016. With the Department of Army vehicle expiring on 16 January 2016 the Agency began preparations for a new contract award. However, in late 2015 the agency encountered delays due to significant changes through requirement development, solicitation, and evaluation of offers to a competitive follow-on contract.

2. A Justification and Approval Tracking JA17-0029 (Award HT0011-17-C-0004) was approved on December 19, 2016, citing the authority of FAR 6.302-1(a) (2) (iii) (B). There have been significant changes through requirement development, solicitation, and evaluation of offers to a competitive follow-on contract. The follow-on was solicited as a 100% small business set-aside for full and open competition after exclusion of sources and posted to the Federal Business Opportunities portal.

Competitive offers were received, for the consolidated award for Warrior Care. The Government was in the source selection evaluation process when a number of issues were discovered by the Government regarding the re-compete. The Government undertook a number of actions as a result which included the cancellation of the solicitation and the source selection evaluation process.

3. A Justification and Approval JA18-0017 (HT0011-18-C-0010): Award HT0011- 18- C-0010 was approved on December 19, 2017, citing the authority of FAR 6.302- 1(a) (2) (iii) (B). The cancellation of the previous solicitation, and the Government response to the issues discovered, have delayed the development of the requirements and preparation of a solicitation for a follow-on contract.

4. To aid in identifying a way forward an Integrated Product Team (IPT) was initiated.

The Warrior Care IPT was tasked to review the functions of the three separate warrior care contracts (Disability Evaluation System (DES), Recovery Care Coordination Program (RCP), and Program Support including its sub-programs, and to make actionable recommendations. A number of recommendations have been made, to include one overarching recommendations which are currently being considered by the Government. As a result of the Warrior Care IPT conducting their work, the recommendations issued by the Warrior Care IPT, and Government consideration of the recommendations, the development of the requirements for the follow-on contract have been delayed.

5. A Justification and Approval JA19-0011B (HT0011-19-C-0006): Award HT0011-19- C-0006 was approved on December 31, 2019, citing the authority of FAR 6.302-1(a) (2)

(iii) (B). The cancellation of the previous solicitation, and the Government response to the issues discovered, have delayed the development of the requirements and preparation of a Solicitation for a follow-on contract. The current contract provides professional and management support services to the Defense Health Agency (DHA), Deputy Assistant Directorate (DAD) Medical Affairs (MA) and expires on 16 January 2020. The Clinical Support Division (CSD) and Warrior Care, aligned under DAD MA, are in the process of developing requirements for a long-term contract solution. The bridge contract extension modification will prevent a gap in necessary services and will provide the agency with time to complete the requirements development and the acquisition process for award of a follow-on contract. The period of performance of this bridge contract modification extension will be a six (6) month extension beginning on 17 Jan 2020 thru 16 Jul 20.

5. A Justification and Approval JA 20-0009B (HT0011-19-C-0006): Award HT0011-19-C- 0006 was approved on December 19, 2019, citing the authority of FAR 6.302-1(a) (2) (iii)

(B) month Bridge Contract with (1) six month option period to support the existing level of effort. This sole source award does not provide for new work or a change in scope. Approval is being requested for award of a bridge contract to the incumbent – Armed Forces Services Corporation (AFSC) to continue work currently being performed under being performed under contract number HT0011-19-C-0006. The current contract provides professional services to the Defense Health Agency (DHA), Deputy Assistant Directorate (DAD) Medical Affairs (MA) and is expiring on 16 January 2020. The Clinical Support Division (CSD) and Warrior Care, aligned under DAD MA, has submitted the required procurement documents to the Contracting Office Division (COD) Falls Church (FC) and continues to work with the Contracting Division to emend the documents in order to initiate a solicitation, convene a source selection board, and award a new contract for the Recovery Coordination Program (RCP). The bridge contract will prevent a gap in necessary services and will provide the agency with time to complete the acquisition process for award of the follow-on contract. The period of performance of this bridge contract will be six months beginning on 17 Jan 2020 thru 16 Jul 2020.
