FULL AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

The U.S. Air Force through the Weather Systems Branch (AFLCMC/HBAW) is the organizational activity responsible to procure Contractor Logistics Support (CLS) for the commercial Portable Doppler Radar (PDR) system designated as AN/TMS-2 (EWR-700XD) pursuant to a “Justification for Other Than Full and Open Competition”

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

This Individual Justification and Approval (J&A) is to award a new sole source Indefinite Delivery/Indefinite Quantity (IDIQ) contract and all associated Delivery Orders/Task Orders (DOs/TOs) for CLS services and Special projects for the Air Force’s fleet of PDR systems located at worldwide locations to LaPoint-Blasé Industries doing business as EWR Weather Radar (EWR) for follow-on continuous services. The current contract, FA8723-10-D-0001, was competitively awarded as a small business set-aside to EWR, a small business, in September 2009 for procurement of Commercially Available Off-The-Shelf (COTS) PDR items, and includes Interim Contractor Support (ICS) services for sustainment of the PDR systems. The contract period of performance expires in October 2014.

The new contract is a Federal Acquisition Regulation (FAR) Part 12 Firm Fixed Price (FFP) “D” type for CLS services and Special projects to be modified as necessary. The estimated award date is June 2014. The contract will have a maximum period of performance of five and a half years. The contract will contain provisions for base year CLINs, four one year option CLINs, and a six month maximum extension of services CLINs for CLS, CDRL, and Special projects.

DOs/TOs will be issued to execute actions. The maximum estimated contract ceiling is and contains the same level of support as the current contract.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS

The following services and supplies will be provided by EWR for CLS of the PDR program:

To meet the Air Force Weather Agency (AFWA) directed mission capabilities, CLS support of the fielded PDR is required. The contractor will provide (1) CLS, and (2) Special Projects for hardware and software obsolescence and system upgrades. This is required for maintenance of a common hardware and software configuration that ensures form, fit, and function commonality in operations, maintenance, and logistics among all AN/TMS-2 PDRs.

The Indefinite Delivery/Indefinite Quantity contract will have a maximum ordering ceiling of and a maximum period of performance of five and a half years from June 2014 to

December 2019.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

Statutory authority, 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1(a)(2)(iii)(A), with an application pursuant to FAR 6.302-1(b)(2), Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS

OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY

The AN/TMS-2 (EWR-700XD) PDR is a commercial Portable Doppler Radar COTS product manufactured by EWR that the Government procured using FAR Part 12 procedures under contract FA8723-10-D-0001. The PDR detects precipitation, collects and makes data available locally, and delivers weather data information to the AFWA. The PDR is interoperable with other weather sensors and provides consistent and relevant radar analysis information to joint operations decision makers.

The CLS contract will provide highly specialized support to the PDRs in order to meet operational availability requirements. EWR is currently satisfactorily performing all ICS requirements under contract FA8723-10-D-0001, ICS CLIN 0006. This follow-on contract provides for continued highly specialized CLS services, support and special projects for further development of the AN/TMS-2 (EWR-700XD) PDR to meet operational availability, IT interconnectivity, and IA security requirements. The software and hardware employed in the PDR systems is proprietary to EWR and PDR elements have and will continue to require system design changes, upgrades, and enhancements due to technical refresh of component capability, obsolescence, and diminishing component sources.

EWR’s highly specialized technical capability is based upon their proprietary data (hardware and software) of the PDR and their unique capability to maintain, modernize, and sustain the system availability. The contract contained the commercial data clause DFARS 252.227-7015 Technical Data-Commercial Items, pursuant to the prescription for usage in DFARS 227.7102-2 Rights in Technical Data and DFARS 227.7102-4 Contract Clauses. The license procured under the contract does not include rights in commercial computer software data. EWR has stated explicitly during market research that they will not negotiate with the Government or anyone else for acceptable terms for transferring such rights In accordance with DFARS 252.227-7015(b)(2) the government shall not disclose any such data outside of the government which includes using such data for soliciting CLS competition. The Government has limited technical data rights and restricted software rights for the PDR systems which are not sufficient for conducting CLS depot level maintenance.

XII. CONTRACTING OFFICER’S CERTIFICATION

The contracting officer’s signature on the Coordination and Approval Document evidences that he has determined this document to be both accurate and complete to the best of his/her knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete.
