About this file

This document is a sole source justification for the procurement of seven BrightBeam ULTRA DUAL PLUS portable lasers and accessories from Laser Light Solutions by the Mission and Installation Contracting Command at Fort Gordon, Georgia on behalf of the Defense Forensic Science Center. The total estimated value of the procurement is $265,300. The justification cites that the BrightBeam ULTRA DUAL PLUS laser is the only system that meets the Defense Forensic Science Center's requirements for portability, ruggedness, and independent battery power needed to support latent print examination in expeditionary environments. Market research found no other lasers that meet the specified performance characteristics. A subsequent federal contract opportunity was awarded to an unknown vendor on April 30, 2020 for an unknown amount to fulfill this requirement.

FDO/ MICC Control No. Gordon 2020-3

SOLE SOURCE JUSTIFICATION

(Not Exceeding $650K)

1. Agency/Contracting Activity: Mission and Installation Contracting Command (MICC) - Fort Gordon, GA.

2. Description of Action:

Nature: New Requirement Follow-on Requirement Mod to Existing Purchase Order/Contract Number

Pricing: Firm-Fixed Price Time & Materials Cost

Funds: OMA Other Funds:

Name of Proposed Contractor(s): Laser Light Solutions Street Address: 20D Worlds Fair Drive City, State, Zip: Somerset, NY 08873 Phone: 732-979-2143

An acquisition plan is not required because this procurement does not meet the threshold at

Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).

3. Description of Supplies/Services:

a. The Defense Forensic Science Center (DFSC) requires the sole source purchase of seven BrightBeam ULTRA DUAL PLUS portable lasers with accessories.

b. The total estimated dollar value of the proposed action is $265,300.00

4. Authority: 10 USC 2304, 41 U.S.C. 1901, FAR 13.5 (a)(2)-- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reason for Authority Cited:

a. The Defense Forensic Science Center (DFSC) located at the Gillem Enclave in Georgia, provides forensic laboratory services to the Department of Defense investigative agencies and other Federal law enforcement agencies. The Forensic Exploitation Directorate (FXD) requires BrightBeam ULTRA DUAL PLUS lasers to support its forensic exploitation mission. The purchasing of these instruments and supplies will also ensure continuity of ISO 17025 ANSI- ASQ National Accreditation Board accredited processes at DFSC.

b. The ULTRA DUAL portable forensic laser from Laser Light Solutions is presently utilized by the FXD’s Forensic Latent Print examiners manning expeditionary laboratories located worldwide. The dual (monochromatic) Blue or Green 445 / 525 nm wavelength and the power output of 7W or greater are critical requirements for rapid and previously scientifically validated processing of latent prints in these expeditionary deployed environments.

c. The BrightBeam ULTRA DUAL laser is the only commercial-off-the-shelf forensic laser that has met the required contingency mission specifications for portability, rugged for field handling, and independent battery power supply. We have returned approximately five laser systems from overseas laboratory operations for repairs due to a lack of portability and damaged power supplies. We constantly experience issues with power supplied in certain OCONUS locations causing severe damage to the electrical components within existing laser systems. These repairs have been costly for each laser system (upwards of $8000 per system) and diminishes our mission capacity. These damages coupled with the lack of portability of the other commercial 98-pound laser has led us to identify the BrightBeam ULTRA laser family as a technically acceptable replacement for field use based on its battery powered capability and lightweight 15

lb. frame.

d. Laser Light is the manufacturer and sole provider of the BrightBeam ULTRA DUAL PLUS forensic laser light source and has provided a sole source letter.

e. Impact.

(1) Award to another vendor or manufacturer of forensic instruments with similar performance characteristics. This would will lead to mission degradations if those lasers are damaged or fail due to irregular power supply and handling in an overseas contingency environment.

(2) If other laser equipment were purchased from a different vendor, that equipment would have to be subjected to a lengthy and costly validation process before use and demonstrate the ability to provide the quality of results we obtain from the Laser Light brand equipment.

6. Actions to Increase Competition:

DFSC research scientists are continually researching sources of information and services to enable forensic examiners to conduct effective and reliable examinations. Market research consists of internet research, literature reviews, discussions with vendors, and other professional resources attending forensic science and technical conferences and industry events. If DFSC identifies a similar requirement, every effort will be made to compete it to the maximum extent possible.

To increase competition the MICC-Fort Gordon will continue to synopsize and conduct market research to ensure there are no other vendors that can provide the requirement. The Government will issue a sole source synopsis and address any responses accordingly.

7. Market Research:

Extensive research was conducted (Internet searches, telephonic communications, forensic conference exhibits, electronic communications, and literature searches) to determine the availability of alternative lasers. No other systems exist that meet the DFSC/FXD Latent Print Examination requirements, especially in a deployed setting No other company offers the sale of manufacturer certified warranty maintenance of the proprietary instruments produced by FEI Company. Only the Laser Light BrightBeam ULTRA DUAL PLUS solution was found. The vendor has provided a sole source letter.

Salient Characteristics:
