About this file
This justification and approval document outlines a sole source award to General Dynamics-Mission Systems for parts and technical services in support of the Joint High Speed Vessel Remote Surveillance System and associated components aboard Military Sealift Command vessels. The estimated value of the contracts covered by this class justification is $XXXXX using fiscal year 2022 funds. General Dynamics-Mission Systems is designated as the original equipment manufacturer and system integrator for the key integrated systems aboard Joint High Speed Vessels, including the Remote Surveillance System, and possesses the proprietary software and technical expertise required for maintenance and modernization of the critical safety equipment. The justification cites the statutory authority for commercial item and simplified acquisition procedures to award sole source contracts to the original equipment manufacturer without full and open competition.

J&A Control Number: _N104-21- Q- 2211 _
CLASS JUSTIFICATION AND APPROVAL (J&A)
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
Contracting Activity: Department of the Navy, Military Sealift Command (MSC).
Description of the Action Being Approved: Award of contracts and purchase orders on a sole source basis for General Dynamics-Mission Systems (GDMS) parts and technical representative services in support of MSC vessels.
Description of Supplies/Services: MSC requires Original Equipment Manufacturer (OEM) parts and services to support overhaul and modernization of the JHSV Remote Surveillance System (JRSS) and associated subcomponents for the EPF Class Ships. The actions executed under this class J&A have an estimated value of $XXXXX using fiscal year (FY) 2022 Funds.
Statutory Authority Permitting Other Than Full and Open Competition: The statutory authority for commercial procurement procurements greater than $150,000.00 will be 41 U.S.C. 1901€(2) as implemented by FAR Part 13.501(a), Simplified Procedures for Certain Commercial Items, Sole Source—including Brand Name. Section 815 of the National Defense Authorization Act (NDAA) of Fiscal Year 2015 makes this authority permanent. The statutory authority for simplified acquisitions less than $150,000.00 will be FAR 13.106-1.
Rationale Justifying Use of Cited Statutory Authority: General Dynamics Mission Systems is the OEM designer, integration, certification authority, and subject matter expert of multiple integrated systems for the Joint High Speed Vessel (EPF) program. Specifically, the JHSV Ship Computing Environment (JCSE), JHSV Remote Surveillance System (JRSS), JHSV Interior Voice Communication System (JIVCS), JHSV Entertainment & Training System (JETS), and the JHSV Wireless Internal Voice Communication System (JWICS).
MSC does not have the manufacturer or technical information to properly evaluate non-OEM services or components. Additionally, MSC does not have the capability to determine equivalency of non-OEM services/components when compared to the OEM services/components. The JRSS system requires special proprietary software for the full functionality of the ship's CCTV surveillance system. The required technical expertise unique to these electronic components resides with the OEM. The authorized vendor has access to parts, software, technical data, and drawings required for the technical support and modernization of the systems.
Safety Management Systems (SMS), number 10.6-002-ALL, lists the propulsion, and associated safety systems as critical equipment. Failure of JHSV Remote Surveillance System (JRSS) and/or associated subcomponents would impact the operation of the propulsion, auxiliary, or safety equipment systems. This failure would restrict the ship to port and prevent its performance of required mission. Proper refurbishment and maintenance of the installed JHSV Remote Surveillance System (JRSS) is critical to the safe operation of MSC vessels.
Description of Efforts Made to Solicit Offers from as Many Potential Sources as Practicable: IAW FAR 5.201(b)(1)(i), the Government intends to issue a synopsis and solicitation on FEDBIZOPPS for each separate procurement, with the intent of awarding a firm fixed price contract or purchase order.
Determination of Fair and Reasonable Cost: The Contracting Officer will determine the contract prices to be fair and reasonable using price analysis techniques described in FAR 13.106-3 or 15.404-1, as appropriate on a per solicitation/contract basis.
Actions to Remove Barriers to Future Competition: For the reasons set forth in Paragraph 5, MSC has no plans at this time to compete future contracts for the types of supplies/services covered by this document, and there are no actions planned to remove or overcome the brand name requirement. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
Description of Market Research Conducted: General Dynamics Mission Systems is the OEM design, integration and certification authority, and subject matter expert of multiple integrated mission systems for the Joint High Speed Vessel (EPF) program.
