JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department

2. Description of the Action Being Approved

Award of a firm fixed priced contract on a brand name basis for critical equipment to be used by the Strategic & Computing Systems Department (A) Cyber Technologies & Software Systems Division (A40), Cyber Situational Awareness Technologies Branch (A43), manufactured by multiple vendors. This is an urgent request to meet mission needs.

3. Description of Supplies/Services

An authorized reseller will be providing the following customized equipment:

The Government's minimum needs have been verified by the certifying technical and requirements personnel.

The estimated cost of the proposed contract action is $462,347.74. The types of funds to be used for this procurement are Fiscal year 2016 (FY16) Research, Development, Test, and Evaluation, Air Force, funds.

5. Rationale Justifying Use of Cited Statutory Authority

The Mission Assurance Decision Support System (MADSS) Program, which is a Program of Record for Cyber Situational Awareness (SA), requires critical equipment to be used by a team of application and software developers for the development, deployment, and sustainment of the MADSS system. The required hardware and configuration is uniquely compatible with the existing environment and allows for the program to mimic the externally-hosted operational system environment for the purposes of MADSS development, staging, testing, performance metric collection, and emerging problem replication and resolution. This “mimicry” is difficult to attain, since we cannot get visibility into the exact configuration of the production host environment.

Successful testing was conducted using an alternate system configured by the requested vendor. With this procurement, necessary capabilities can be on line for the urgent demand without component inconsistencies that would be injected with alternate brands. Inconsistencies cause unacceptable outages to the operational system, program schedule delays, cost overruns and work stoppage that ultimately undermine MADSS projects and mission requirements.

Several recent events have created an urgent requirement for the upgrades described in this procurement to be delivered by 1 June 2017 so the capabilities required can be operational by 31 August 2017. Clearly, the urgency to upgrade the current system is significant. If an alternate vendor’s product were to be utilized, set up time would be a minimum of 7 months due to inconsistencies. There would be impact to missions during inevitable operational system outages, but that is difficult to quantify, so just the increased Dahlgren effort during those 7 months is quantified here: 7 months for two dedicated Band-3 level technical personnel estimated at $303,000; Deployment-caused operational system outage labor loss of productivity (just Dahlgren cost - not including the cost for all user commands worldwide); one week minimum per release; 25 band-3 personnel, two releases estimated at $236,200 for a total of $538,536 that could not be recovered through competition. With a 1 June delivery and another 2 months to operational status after that, MADSS will be finally able to meet the above-described demands, which should be in full force by August 2017.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Market research was performed via internet searches/3rd party vendor review and research. Specific system configuration and testing was performed on the required equipment as well as vendor research to ensure the equipment listed will meet the operational performance requirements. Additional testing was also performed using similar equipment but failed to meet minimal performance expectations. Market research was also performed online to find authorized resellers and has shown that there are multiple authorized resellers available for this equipment.

In accordance with FAR 6.302-2 (a), unusual and compelling urgency, the requirement was not solicited. When the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Dahlgren Contract Division has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Division will assess whether competition for future requirements is feasible.
